Honorable Mayor and members of the Court d'Alene City Council.

My name is Bridget Hill, and I've lived at 338 Military Drive for over 40 years.

Good evening.

Many of us are here tonight.

Um residents who share an alley between Military Drive and Park Drive in the foregrounds.

We are here to respectfully request your review and enforcement of the Court d'Alene Solid Waste Services contract following Republic Services' decision to eliminate alley trash collection for certain households.

We also respectfully request that alley service be reinstated while this review takes place.

Here are some of our concerns.

Schedule A Section C2 states that as a general rule, service is to be provided through alleys unless the alley does not have through access.

Routing challenges and equipment limitations are operational matters.

And the contract places responsibility for routing and equipment on the contractor.

If the city received notice and approved this change, the residents were not informed at the time and were not given an opportunity to raise concerns or participate in the process.

We respectfully request documentation of any such notice and approval.

And if the city did not receive notice or provide approval, then this change would constitute a breach of contract by the contractor.

Even if the city accepts Republic's interpretation, other contract requirements were not met.

First, the contract requires proper notice to the residents.

Contractors must notify all affected customers during two weekly routes before a change.

In our alley, some homes were tagged while others were not.

None were tagged twice.

And several residents learned of the change only through neighbors.

Go ahead.

Second, the contract requires that service be provided in a manner that is convenient, safe, and free of nuisance.

Many homes lack paved or accessible routes from the alley to the front street, and some are fully blocked by fencing or structures.

This change poses serious safety risks due to snow, ice, and uneven terrain, and also would require costly property modifications for some homeowners.

In conclusion, we are asking the city to review this change by confirming contract compliance, enforcing its provisions, and restoring alley trash service while this issue is reviewed.

And it would be great to include the affected residents in this resolution process.

This is truly a colossal waste of time.

We are the city's customer.

The citizens of Court d'Alane are the customer of the City of Court d'Alane.

Republic Services is a vendor.

On October 15, 2024, every one of you except for Councilmember English was in present at the meeting when Ryan Waller, the area president of Republic Services, addressed the council.

He was very interested in court à lane garbage for quite some time.

He made that clear.

And all of this obviously is available on YouTube.

You can watch it for yourself.

October 15, 2024.

He expressed to all of you that they were a very large company.

He also promised each of you to continue the high level of service that Court of Lane Garbage had provided the citizens.

I think for nearly 50 years they had been in business, and for 16 years Courtalane Garbage was the supplier of garbage services.

And he hoped that you would vote for two additional three-year extensions at that meeting on October 15, 2024.

The vote was taken immediately after Mr.

Waller spoke with you, and it passed unanimously.

And the council meeting was concluded.

So here we are, 15 months later.

And this is what we get from the city's vendor.

Okay.

This is not my vendor.

I write my check to the city of Court Elaine.

So from the city's vendor, 85 households got this sticker.

And this sticker reads attention customers, effective January 1, 2026.

Please move all totes to the street.

Per uh Bridget's conversation or her testimony, uh, we have received alley service for approximately 50 years.

Uh it says due to impassable conditions, we will not be servicing from the alley any longer.

How do I know that this is a lie and these are not impassable conditions?

Because the week following that this sticker was placed on our totes, uh, the trucks went through as they have for the last 50 years and picked up our garbage.

Um, where is the city on all of this?

And I know you're not the city.

The city administrator is silent.

The city has created a monopoly in terms of allowing only one vendor, and that's fine.

But it gets worse if I choose to no longer because they've discontinued my service.

I'm almost done.

Uh I don't get to go to another vendor, and I don't get to cancel.

So there's a real um overt responsibility on the part of the city to make sure that the city is protecting the customer being the citizens, because I can't even quit their service.

Uh there are 16 billion dollar a year company, and they're in the process of bullying us and making our city just a little bit uglier because nobody wants to see cans.

That's why alleys were designed.

Leave the cans in the alley.

So please tell the city administrator, and I know he's still on, I don't know what he's on, but he's he's not reachable.

But will you please tell him to be like a good parent and have the vendor uh comply with the terms of the contract?

I drove on the alley today with no problem leaving there my house because that's where my garage is at.

So we'd ask you to please reconsider this and have a further discussion and review into trash pickup.

Hello, I'm Catherine Boss.

I live at 328 Military Drive, um, 40 years now, and I appreciate the opportunity to be able to bring this to your attention.

I just wanted to follow along with my neighbors on the issue of the trash.

I never received a sticker.

I happened to be out of town the weekend that they went through.

I received no notification about this change.

Um, nothing in the mail, and um no sticker because my trash can wasn't out.

I didn't get one the next week, but my garbage was picked up as usual.

It wasn't until this Monday that they skipped us because we were in the alley.

Um I just wanted to say that it's not simply an inconvenience to us.

It is that our neighborhood is old neighborhood, and it was built in the old way of all of the car issues revolve around the alley.

So we access our homes from the alley, our garages are in the alley, and we don't have driveways in the front.

Most most of the neighbors.

Um I remodeled my house in the 90s, and when I did, I put in more parking off the alley at that time.

We had a lot of trouble with uh street parking because for one thing it's one-way streets down there, so it cuts the parking in half, and then with the college, which now we have resident only parking, but it just continued that process of everything is uh developed around the alley.

So a lot of neighbors don't have any access from the back of their house where you keep your trash can to the street.

So I just wanted you to take that into consideration.

Uh we live at 335 Park Drive.

My wife Barbara and I sent an email to all of the council members this last week and uh expressed our concerns about the change that uh Republic Services bestowed upon us.

And so I'm not gonna but I'm not here to repeat that.

And uh I think some of my other neighbors uh gave a good explanation of what we what our concerns are, but I am here to read a um a letter that uh one of our other neighbors asked to be delivered tonight from Jonathan Burns.

Jonathan and his family live at 316 Military Drive, so they live on the other side of the alley from where we are.

Uh one household that's affected of services was recently uh decision was to halt the um alley pickup to certain homes under the auspices of the safety and liability mitigation.

I'd like it to be known that I spoke at length with this is this is Jonathan speaking here, not Bill.

Uh Jonathan says he spoke at length with Republic Operations Manager Jeff, along with another neighbor, Jim Cook, who you heard from just a little while ago.

And in that conversation, the operations manager made it clear the republic could safely continue to service it as it's been provided for at least the last 50 years, but it would cost them some money.

They'd either have to put a second person on the truck to assist in spotting, or they'd need to buy a new truck designed to fit into smaller spaces.

And while these options are not cheap, Jeff said that it would only amount to pennies per household over the length of their current contract.

That was Jeff's uh comment.

It's clear the Republic is uh keen on improving safety and limiting their liability going forward, both which are both worthwhile goals.

However, it's also clear that they are willing to do it by placing another an unnecessary burden on their customers, us.

Uh while my house is has access from the alley to the front yard.

So uh Jonathan says he could bring his trash to the front.

He says many of my neighbors do not, including people who are on both sides of my home.

Um our neighborhood is not designed to keep our cans out front, like many neighborhoods that have front-facing garages.

Please direct the city attorney and administrator to look into this matter as quickly as possible and negotiate a reasonable solution to our to the to uh uh to this situation on our behalf.

So um and you know it's kind of a hard to imagine what really happened, you know, from a month ago to now that makes it that drastic.

But it has been uh quite an experience, and I'm not quite sure to do what to do now.

This is the approval of a five-year lease agreement with Bowie LLC for concession server services at the Harbor House.

We've had our contractor at the Harbor House since 2016.

So the Bowie, I call them the Booy Boys.

They're they're young enough to be my sons.

So um they've done an excellent job.

They're very creative.

They do a great job at servicing the public um with their food fair, they're sort of our ambassadors as well, so they're right at the entrance of Tubbs Hill.

They get a lot of people coming by that are new, and so they're they're really good about uh interfacing with those folks and giving them directions.

And so they came to me a while back earlier this year with this idea or concept to they wanted to go year-round.

And so we went through a few iterations.

I I think I mentioned this at Park and Rec.

I went dad mode on them a little bit because I didn't quite understand the model of their business and suggested they would maybe do a modified um option to do winter rather than just doing it all the time.

And but the third time they said no, Bill, we'd like to do this, it's okay.

You're on your own, gentlemen.

So I did what I thought I should do as a dad, but nonetheless, there they would like to do this, and I think it's it's um they have some things they need to do within the HVAC system and it is noted in the in the staff report.

Uh they have some things to do for TED in building, and I have some things they need to do for fire, as well as the outside seating area and then the exchange system within the Harbor House itself.

They will not be able to operate winter operations until all of those codes are satisfied by both of the building and fire department.

They'd like to get going ASAP because they want to open this uh spring in March and then have that uh ready for next year this time or this year in in I guess it would be uh October and November and through through the winter.

So with that, I'll stand for any questions.

Oh one one one thing I do need to note, I apologize.

In in your exhibit, it shows a location for they have a in their agreement, they have mobile um access to take out in the park and sell some water ice cream chips, that kind of stuff.

They uh in the years past have been near the splash pad.

They'd like to have an additional location which would be closer to their operation so they could um supply that cart easier from that spot.

And I think it's fine wherever they want to be within the park staying off of Front Street if there is an activity that they wanted to get closer to with the mobile aspect of that.

I I'm I'm all good with that.

And just bring it to your attention that it may be at two different locations.

Um, Bill did bring this to Park and Rec, and my fellow commissioner Bridget is here tonight.

And we did get to we c affectionately call them the buoy boys at our meetings.

Um great, great group, and they've done wonderful business for us in the park, and I think the public really enjoys what they bring to the city.

And and so uh we unanimously approved bringing it forward to council, hoping that you would all see the same value in it that we do.

Okay, I'm gonna be that guy.

Um a couple things.

I love the Bowie Boys too, and I love going down there.

I I have musicians that I adore watching that play there.

And I think they do a great thing and they are top quality service.

But I've long said that I think that we need to re-examine our lease rates and prices.

And in uh in this staff report, there wasn't anything that said what their expanded square footage was.

So I was trying to kind of figure out how would we really compare this to another waterfront restaurant that was operating year-round, um, that didn't have to pay to plow their parking lot, that didn't have a lot of overhead that other restaurants would.

And is, you know, regardless of their reduced menu or how great they are to tourists or not, uh a lot of our other retailers in Courtal Lane are the same.

And so I I felt like this seemed like a really good rate for this expanded square footage and the multiple opportunities they have.

And I don't think they even have to service the restroom that's serviced by the city of Court Lane.

So there's a lot of expenses that the city takes on and we'll take on more.

And so I'm just wondering what your conversations were regarding comparable lease rates.

So we went out to bid on this, and so we are bound by bidding laws.

And so I agree with you a hundred percent.

If everybody would like to come to us and give us a larger dollar amount, I'm all for that.

But this went out to bid, and so they are on uh an increase by the C the CPI.

And so they started out, I think, at uh 16, or it was less than 16, it was 14, went to 16.

They're at 19.

This is doubling their rate.

Um we have not expanded their footprint, their footprint's the same.

We've expanded their time.

So they actually occupy the space right now with seating that they want to put in some sheeting and create a space that's warmer but still have view of the lake.

So I guess that's it's not an expanded footprint, it's just extended season.

Well, I'm not sure.

That's um I I guess it was just important for me to express that thought to you, Bill.

I think we've talked about this before.

Sure.

In that I think that is um premium lakefront property, and I I feel like we do need to go out to bid, but we need to be able to look at that and and make sure that you know that there are people who might be really interested in operating something like that.

And this is kind of turned into a full-time restaurant now.

So it's different than um a food truck, like we usually go out to bid for a vendor services.

So I just wanted to express that I hope we keep a keen eye on what those lease rates look like.

So yeah, this is this is a higher rate, but this is what we negotiated with the boys, and they're agreeable to it.

And um, I hear what Kiki's saying.

I I agree 100% that we maybe it's a bidding process, and here's a real good example.

You talk about the food truck.

So at Independence Point, we have a food truck.

We've had food truck there for the last 35 years, and we went out to bid.

We didn't get any bidders.

And so fortunately we had one guy that came in really late, and that's the pizza guy that's there now, Rafi.

And here's another example is that we had uh vendor locations at Atlas, and we had one bidder for four locations.

We I set a minimum bid at five grand, thinking somebody come in at ten, because everybody at that time was really wanting food trucks, right?

Well, I brought it forward, and this board, this body here chose to reduce the taco vendor's rate by a thousand dollars because he was the only vendor.

So Paul Mason's great guy had good food.

He was only there a year, he paid four grand.

And I was expecting vendors to be you know pounded down at doors to be there for ten grand a piece, but we do what we can, we're fair about it, and and abiding by the law and and the bid, you know, the bid laws that we do.

So another question for comparison, the uh like with the food truck vendors on a Sherman.

Yes.

How how is that working and how do those rates go and things?

Well, that's not our property, but I know that I used to go there for the the hockey truck there, yeah.

And they have since left and opened up a brick and mortar.

So I don't know how well that's that's going for those folks there.

Good evening, Mayor McEvers and Council members.

Uh Mayor McEver's, I tried to make that title as long as I could, so you could chew on it for a minute.

But um, yes, we come forward tonight to talk about uh some improvements that we need to make to our sidewalks.

ADA uh codes require us to do that.

The last four years we've been very busy on uh doing inlays, overlays, things like that, and the ADA code state that we are required as we do those repairs to upgrade the sidewalk facilities.

So we've been very busy the last four years.

We've been trying to come up with a plan, and so we are ready to go.

Um these are some random locations if you look at them.

Uh you don't see any of those yellow domes in there.

We're required to have those at the top of the uh ramp, if you will, there should be a flat spot, a turning spot or a landing, as they call it.

And we need uh upgrade these ramps.

Uh some spots don't even um have a ramp, as you can see on the bottom there.

There's actually a location where it's just a curb.

So uh we've done some asphalt repairs in these locations, and we've been working on evaluating the condition of our sidewalks.

There is some loopholes to where if a ramp was put in to ADA compliance at the time that we can, you know, do some minor upgrades to it.

Most of the locations that we are calling out right now uh are in serious need of some uh upgrades.

Right here on the top of this diagram.

This is what HMH used.

They have uh this to uh evaluate the ramps, but this spot right here is the turning space, you know, that gets difficult.

We don't always have uh right-away to put an extra flat spot there, and so there's different styles of ramps we might have to use.

Um obviously the slope of this ramp area right here is important, the dome.

Uh and we need to calculate the wings.

You know, they need to be those wings need to be two to eight percent slope.

Um there is some scenarios where it can be more.

Um, but these are all areas that we need to address.

Um this map is showing the areas that we have addressed, so each of those can have anywhere from one to four ramps that would need service.

We have evaluated at this point 125 locations in this bid package.

We are hoping to address 50 of them this year.

Uh what we would like to do is put it out to bid, and if it comes in under what we expect, then we will add to it off of this list.

And then we will continue to as we do these asphalt projects moving forward.

We're gonna try and lump these in with the mill and inlay projects.

Uh the mill and inlay goes a lot faster than doing all of these ramps.

But it's time we've been working on this.

We came uh to City Council in February of 25 to bring HMH engineering on board to help us uh evaluate and uh decipher where we need to go.

Um, all of these areas are in areas that we've done new paving in the last four years.

So there's other areas this professional service agreement uh for Corlain pedestrian ramps um to help with the bidding process uh from HMH engineering.

I mean, what you were showing us was old ones that worked, right?

Right.

It it the ADA requirements can change annually, they can change five years.

I mean, we're a little bit behind on this, that's why we're trying to push to do 50 at one time.

Uh but we have some spots that really need to be addressed.

So uh yeah, it ch it changed every year.

We get a new copy, and we just we'll see what we got to do.

There's a few items that we need to do when we start a new session of council.

And one of those items is to silence our phone.

The uh time means everything.

The other item um is uh by statute, we have to elect a council president.

The council president currently is uh Dan English, your term's up, sorry.

Yeah, that's what I hear.

Yeah.

And so uh council president serves as the mayor pro Tim when the mayor is unavailable or when the mayor is conflicted.

So that's pretty much we'll run the meetings, we'll sign documents and stuff like that.

There's really no fabulous prizes or pay increase involved.

But I will take nominations for a council president.

Now I would like to, before we move on with some committee assignments, and that's pretty much gonna be it.

But uh, I just wanted to say a few words that uh this is his last official council meeting, and how much I appreciate you, and the city appreciates you and the job you've done for us.

Um when Chief White uh before he came here, the police officer, there was a police officer who approached me and said, uh, you know, Guken, you have to help us out.

And this is was weird to me because I was just elected.

And I had no clue what was going on.

But this gentleman, this officer stood uh sat with me and told me all the stuff that needed to be fixed at the police department, and there was a lot of concern there.

I did a lot of ride-alongs.

And then the opening came up uh available.

We needed a police chief, and I was part of the crew that uh interviewed the candidates, and you just jumped off the screen.

I mean, seriously, it was a Zoom thing, and you're coming in from Mesa, Arizona.

And it's like, whoa.

Like, wow, this is the guy.

And you are the guy.

You did just such a tremendous job as our police chief.

Crime is down over 70% in the time you've been there.

You have this this model of policing that just frightens the bad guys.

They don't do bad things here.

In fact, I met with some officers and I asked them, I said, what what is it, you know, what are your complaints about being a police officer?

You know, what are your complaints about being a police officer?

What can we do better?

And they said, Well, we just there's no crime to fight.

And that's that is a great problem to have.

So, on behalf of me, because I I initiated this on myself.

Um, which maybe I'll let you guys know in this.

And we made him pay for all of it too.

I paid for this.

So I would like to present you with the first of what I hope will be several of these.

This is the key to the city.

I think you deserve this, and you no longer have to jimmy open the door.

We have a presentation, and now we have the committee assignments and appointments.

We've been waiting for.

Good.

Uh these committee assignments will be as follows.

So originally we have this committee called the General Services Public Works Committee.

It used to be two separate committees that met twice a month.

That's four times.

We're just down to two times a month.

And I wanted to rename them committees A and B, but I think I'm going to keep the first one as General Services, and the second one is public works.

So, because that's what we call them anyway.

So the General Services Committee will be the first meeting of the month and will include Councilmember Council President Evans as the chairman and Council Members English and Wood.

The attendees of the public works committee, the second meeting of the month will include Councilmember Miller as chairman, and Councilmembers Gabriel, and then new council member as well.

If you do want to uh switch committees, you just need to let staff or me know ahead of time that you're you know you're changing, and that's fine.

And any changes will be done by seniority.

Um and here are the committee assignments.

These are the uh committee assignments required by city code.

So councilmember Wood will be assigned to the Sick Leave Bank, Panhandle Area Council, and the Parks and Recreation Committee, Councilmember Evans to the Pedestrian Advisory Committee, Councilmember Gabriel to the CDA TV Committee, and to the KCEMS Joint Powers Board, Councilmember Miller to the Historic Preservation Committee.

Um the new council member will be appointed to the parking commission, which is the the worst one, and that's why I hope you get it.

Uh the mayor will continue to represent the city on the KMPO board.

Other appointments and continued representation are not direct appointments, and these include Yeah.

So they do don't worry, I'm getting there.

Uh Councilmember Wood shall represent the city on the Cordelaine area economic development corporation or jobs plus.

Councilmember Evans shall retain her seat on the Arts Commission and ignite CDA.

She will also represent the city on the Centennial Trails Foundation.

Councilmember Gabriel shall represent the city for the Association of Idaho Cities.

Councilmember English shall continue to serve on the library board and will represent the city at the Lake City Center.

Councilmember Miller will retain her seat on Ignite CDA and represent the city at Joint Chambers and the NIBCA.

And like I said, those those are not, I mean, those are not in our code, those are just liaisons.

We will continue those relationships.
