Case number 231, 2025, a request by Crockett Engineering Agent on behalf of Troy Miller Properties LLC or owner for approval of a site-specific PD plan and new statement of intent, SOI, to be known as Ashford Place.

The 24.13 acre subject site is located directly north of the terminus of Sagemore Drive and is currently zoned PD plan district.

The rezoning establishes a development plan for the parcel, inclusive of 77 single-family attached dwelling units.

Additional lots depicted on the plan are designed for common areas.

This case was previously tabled at the July 10th, 2025 Planning and Zoning Commission meeting.

Uh the purpose of that tabling request is to allow for the applicant, uh, given the volume of public comment that has been submitted uh with the published uh report, uh, to have an opportunity to meet with the actual residents in the neighborhood and those that are concerned with aspects of the proposal.

Um depending on the outcome of the public meeting that the applicant would like to have, uh facts that are within the current staff report that has been published may be modified, and we would recommend that this item be tabled to allow for those opportunities for public engagement uh between the residents and the owner to occur.

I don't see why we continue to put it off because I'm not gonna be convinced by some politician at a at a neighborhood meeting that um everything that was promised us when we bought this property is going to be uh taken away or destroyed because of somebody's desire to make a profit.

Case number 221-2025, a request by SSE Simon Strumpf Engineering agent on behalf of Bartley Stevenson Trust owner for approval to permanently zone 1.33 acres of land from Boone County RS single family to City R2 two-family dwelling zoning upon annexation.

The subject site is located east of the intersection of I-70 Drive Southeast in Easter Lane and includes the address 7098 I-70 Drive Southeast.

This case was tabled at the July 10th, 2025 Planning and Zoning Commission meeting.

We sent out property owner letters on June 23rd, and we sent out 19 of them to properties within 185 feet of the site.

So here's an aerial of the subject site.

So currently we are looking, this is east of exit 131 or St.

Charles Road, uh, whichever is easier for you to locate.

And the site is fronted off of the uh frontage road that's along the southern side of I-70.

Uh there is a shared access driveway on the site that runs to separate properties that are not pertaining to pertaining to this case.

Um that's the stem there on the eastern side of the lot.

So the applicant is currently seeking to approve R2 zoning upon annexation.

Uh it's currently zoned residential single family uh joining the property.

We have city uh planned development to the north, we have residential single family to the west and south in the county, and commercial general to the east of the subject site.

Uh this isn't for the merits of the actual permanent zoning case, but just for context for uh why the annexation is being considered.

Uh, it is contiguous by the PDZ PD zoned property that is north of I-70.

Uh this was annexed in 2008.

The uh applicant came to us and it indicated that their intent is to put a two-family home on this site and connect to city sewer service in the process of that as well.

Uh this case was tabled to gain legal lot access or legal lot status uh upon annexation in the county.

So they're going to do all of their surveying before the annex, so that way they don't have to follow this up with a further subdivision action once they are in the city.

Uh there's no current development on the site itself, but there is a single family home to the south of there that would be accessed via the same driveway that this property was accessed at right now.

Um they are seeking R2, which is not necessarily 100% congruent with residential single family in the county.

However, given that it is next to commercial zoned properties to the east and then uh single family zones to the west, we consider this a inappropriate step down of zoning from what's currently existing at the subject site.

Um given that there's no development on the site, it does not create any nonconformities by requesting R2 upon annexation, and then all of the utilities and emergency services are currently provided by the county.

Uh in conclusion, you know, upon staff's analysis, we believe that this proposal is consistent with the surrounding land use, the existing use, and the merits of the Columbia Imagine Comprehensive Plan.

Staff's recommendation is to approve the permanent zoning request to R2 for 7098 I-70 drive southeast upon annexation.

Our next case and last case for the evening, case number 250-2025, a request by Stephen Dupree owner to allow 207 West Briarwood Lane to be used as a short-term rental for a maximum of eight transient guests and up to 210 nights annually, pursuant to Section 29-3.3 V V and Section 29-6.4 M2 of the Unified Development Code.

The point two six acre subject site is zoned R1, one family dwelling, and is located on the west side of West Briarwood Lane and is approximately 585 feet north of Ivy Way and is addressed 207 West Briarwood Lane.

It's kind of located in the middle of the block there on West Briarwood Lane.

We have Stadium Boulevard to the west at the top of the screen.

The surrounding homes are similarly zoned R1 as well.

And they're also single family homes.

This property is zoned R1 and is currently the primary residence of the applicant.

This is a four-bedroom, three-bathroom home.

The max occupancy allowed per the IPMC would be eight.

In 2024, the uh applicant stated that the home was used for four nights.

Upon research, all 28 parcels within 185 feet of the subject site are currently owner-occupied.

And with that being said, there are two administratively approved short-term rentals within 300 feet of the property.

For it being administratively approved, it would not have to go through the public hearing process.

And we want would one have to be owner-occupied, and two, it would be allowed no greater than 120 120 nights of rental.

And those both those properties uh allow an occupancy of up to eight as well.

There are also no open code violations associated with this property.

As mentioned, the designated agent currently lives on the property, though they have the intention to move and operate the property as a short-term rental full time upon the decision of the condition use permit.

We received zero response to the public notification.

And the property currently has a driveway and parking pad that would support the required uh guests, which on there is within the driveway, there's about five spaces, and within the attached garage, there's uh two.

So in total, there are seven uh spaces that would be able available.

In conclusion, the condition use permit analysis supports approval.

The short-term rental regulations provide an oversight means to address any impacts.

Approval supports broad policies, strategies, and plans and actions of the comprehensive plan.

And staff's recommendation is to approve the requested short-term rental condition use permit subject to a maximum of eight transient guests and a maximum of 210 nights of annual rental usage.

This is my third year now, and I would like to keep it that way.
