Commission members, you may recall that our last meeting we gave Allie some guidance uh on this particular application, and um she's provided us with a draft resolution of approval.

BRT Sconset LLC application for revised special exception, revised site plan approval for an existing previously approved cluster development, the ridgetop sections 4A2B3 and 4A6 in the RA40 zone, 10 Damia Drive, F09036, special exception number 589.

So again, pretty standard for the cluster development.

I know we just saw one for one and three Pembroke.

So I'm gonna jump straight into number six, which is that standard condition for the HOA.

Um, basically that they file the declaration and that it be referred to the Department of Planning and Zoning as well for review, um, just to ensure that the ownership maintenance of easement areas and the private drives um are well maintained by the HOA.

Then jumping to number nine, it is the standard to extend municipal water and sewer facilities that the applicant has to obtain approval from council.

Um then we have the standard staff report conditions, um, construction sequencing plan in number 12 was really important, just due to the existing housings houses up there.

Um, so we just want to make sure that everything is good on the construction sequencing.

Um, number 13.

We worked with the applicant on this as well a little bit, just to make sure that they can um start grading and drainage and foundations um prior to getting this verification from their engineer.

Basically, going off of Kelly's staff report, engineering staff report um that is conditioned.

The engineer needs to verify that the storm drainage systems are properly maintained and functioning as designed.

Um so we're allowing with this permit here, we're allowing allowing the applicant to start with grading and drainage permitting as well as um foundation permits.

But as soon as they start to go into the structure permit, which is the building itself, that's when they have to verify that the storm drainage systems are functioning properly.

And then number 18 is going to be the condition for the fire marshals.

As the commission is aware, there was some discussions about the widths and the concern for fire apparatus to get through the private drive.

So this is just going to verify that the as built maintains that minimum of 20 feet width of unobstructed roadway.

And I think that covers all the project specific conditions.

You mentioned in 13, the sort of chronology of permits.

First one is the grading and drainage.

And the third is the structure before they start building itself.

So the the intent here is to is to give them a little flexibility to let them start with the grading and drainage and foundation and then get to the structural permit after it's inspected.

The foundation here is really important because that's when the water and sewer hookups happen as well for each dwelling.

So it does allow a lot to happen just prior to the actual building of the structure itself.

Um we have another thing on the dock, another item on the docket where the city of Danbury is coming back to us for a referral to do just the same thing.

So my question is in this case, because we're approving this this um resolution.

So um planning commission grant approval in May of 2025 to permit the expansion of the existing outdoor storage and storage of building materials at two Great Pasture Road.

Um there are portions of the property that are located within the numbered AE flood zone of the still river.

Um the base flood elevation for that zone is 355.4 feet.

Um they were not proposing any changes to the existing building.

This was strictly um expansion of that outdoor storage area um on the site.

Um so that finished floor elevation of the building remains the same at 363.4 feet, which is eight feet above the base flood elevation.

Um with all the site work into account, there is a total cut of 334 cubic yards.

Um so the proposed project results in no net fill below the hundred year floodplain.

Okay, so the Department of Planning and Zoning granted site plan approval in December of 2025 to permit the construction of a 12-unit garden apartment development um with associated site improvements.

The municipal sewer main currently exists in Liberty Street and terminates approximately 200 feet away from the subject property.

Um staff has no objection to this request of the sewer extension along Liberty Street to the subject property.
