At the web-based Zoom meeting held on May 6, 2026, the City of Danbury Planning Commission voted to give the above reference petition a positive recommendation for the following reasons.

This proposed change to the land use classification for phase 10 to permit construction of a fire station is consistent with the plan of conservation development POCD directive to enhance public safety and community service accessibility.

Additionally, it addresses a documented deficit in the emergency response infrastructure on the city's west side.

Okay, so before I delve into the actual petition, let me give you a little bit of background about what's going on.

So the Zerb Master Plan, it's has been going on for almost 24 years, and it is on the west side of the city.

I have a map here, but I will have a more detailed map later on.

What I would like to emphasize here is that the applicant is the planning department on behalf of the whole city.

Usually the master plan is amended by the applicant, however, in our case, we have the authorization authorization from the two owners for the city to actually go ahead and apply for the petition.

So a little bit of background here.

The reserve started back in 2002, so it's almost like 24 years now.

Back in 2004, there was a comprehensive vision to the master plan.

Following that in 2016, and I have it here on the slide, there was an addendum to the 2004 master plan.

Following that in 2021, there were a visions to the 2016 addendum.

So as you see, lots of changes happened over the years.

The latest one, which is the one that we are working on now, is the one you see here.

It was applied for in 2020, and it was advised back in 2021, was approved by the zoning commission.

As you see, it doesn't look very professional.

The changes were done by hand, and I'm sure you have seen it in the packet we sent you.

This is just how it was done, and we are trying to clean it up as well.

So, what are we exactly talking about?

If you look at the left-hand side, you will see 11 different phases.

The total acres of the whole master plan is almost 546 acres.

And you can see here, I know it's too small, but if you look closely, you will see what happened or what is proposed to have in each phase.

What we are focusing on here is phase 10, which is the one I don't know.

This is the one we are talking about.

So it's at the intersection of their vote and old edge barrier, and it's a corner lot, it's about 18.2 acres.

However, that being said, it has a lot of wetland, it had a wildlife corridor.

The land is not even, it has a big slope.

So, what could actually be built on it wouldn't exceed 10,000 square feet?

So, what are we doing here now?

I'm gonna move on to the next slide.

If you look at the table here, and I admit it's too small, but I wanted to show it on one slide.

Can you see phase 10 here?

Yes, all that we are trying to achieve is if you look all the way to the right-hand side, you will see that this phase was meant for office.

We are trying to move this to be 10,000 square feet for what we call neighborhood community facility, which is the fire station.

We are not making any other substantial changes.

Along the same line, if you recall, I said at some point we are trying to clean up the document as well.

What you see here, for example, is the number of units being built, and when it was approved, of course, this is a little bit outdated because the last time this table was updated was back in 2021.

We want to update the numbers, are not accurate.

Along the same line, if you look at the tables here, this is actually the number that we have so far.

So you want to update tables just in terms of numbers, we are not making substantial changes.

So that's in a nutshell what I wanted to talk about.

But since we are talking about what you received from the planning commission, as mentioned in the report that was allowed by uh the chairman, the one that came from the planning commission.

Yes, what we're trying to achieve is in line with our POCD policies.

As you know, when we look at any changes, we have to look at our POCD policies and to see if it's consistent or not.

Of course, having more emergency services is in line with one of the main goals of our POCD, which is providing emergency service everywhere in the city.

I'm sure you must know it by now, but we have a deficiency in the West side of the city.

The west side has been actually expanding, and we need to catch up in terms of fire uh having an additional fire station.

That leads me to the final point, which is if you are to approve the petition, please add a new condition that access and exit for the site will have to come from the east side, meaning from old edgebury.

This was a condition of approval by toll brothers as well, and it has been the plan all along that when we build it, the access and the exit out of the site will be coming from the east side, not from the neighborhood.

Um, on page five of the just curious, yes, on page five of the uh of the petition, uh, where you have the phase 10 where you have the strikeout and then you have the uh new language, yes.

So it the master plan has it as offices, banking, business services, no profits, and you're changing it to neighborhood retail services and community facilities, right?

So, but then it says if the fire station is not developed, it can still be used for offices, banking, business services, no profits.

Why didn't you just create it where it says offices banking services no profits as it stands, and also add neighborhood retail services and community facilities?

Um in the event we have to revert back to it, are you gonna be coming back to this commission?

So you are absolutely right.

We could have done it the way you are talking about, but the way we did it is because we are 85 to 90 percent sure it will be built as a fire station.

Okay, it is I understand that, but you understand where I'm coming from portion of it.

I work in the planning profession, so we have to look ahead.

So this is more like you know, in just in case it's unlikely, we don't have to come back to you guys saying, Hey, can we amend it again?

Okay, um, the other thing that I have to talk about is um it says here all on the toll brothers letter, uh, all development in the above phase shall have ingress and egress exclusively from old Ridgebury Road.

That I'm interpreting as the development and construction of the firehouse will only come from old Ridgebury Road, and this firehouse should not be restricted from traveling through the project should an emergency take place, for example, a car fire on Sawmill Road or God forbid any emergency where Ridgefield may need our assistance or Brewster or anything like that.

So I'm reading this to say all development in the above phase shall have ingress and egress exclusively from old Ridgebury Road, and I don't think it in my opinion, it means anything more than that.

Further, this commission cannot condition an approval, so we're gonna have to rely on you to make that language that we approve without having to condition it, correct?

Yes, so what we'll you'll be doing is that you say approval and you add the sentence that toll brothers would like to have, and later on we will add it.

But as an incidental, I would mention that as far as I know, you will keep the one on mill plane.

It's more like an expansion, it's a needed one because there has been a lot going on in the uh on the side.

All what we're time to do is we know from our engineering department that the site will work fine for the fire station, but once this is done, there will be a sign plan application, including construction, not at this stage.

It has been, as the director pointed out, nearly 24 years, which means next November, not this November, but next November.

November 27, it will be 25 years.

It'll be literally 25 years since we sat in chambers and approved this.

And the approval was always intended, I believe, back then.

It was a long involved meeting, but I think it was always intended to have uh facilities like fire stations and police stations up there at some point, particularly when the uh project was finished.

And thank God we haven't needed one up there yet.

Uh, but I would certainly like to see one built before we actually need one.

To that end, the uh taxpayers have committed 10, 15, 20, 25 million in a recent bond to do such a fire station somewhere on the west side.

And I think it's always been understood that that fire station on the west side would primarily be servicing uh the largest development on the west side, which is the reserve.

So, what better place to put a fire station than actually in the reserve?

There was a lot of talk about putting one on Mill Plain.

And we all know the situation with Mill Plain, you get stuck in traffic, and God forbid there's a fire on the west side, or there's a fire in the reserve, and the fire trucks can't get to the fire because there's an accident on Mill Plain, or the highway stumping cars because there's an accident on 84 or it's backed up.

So put one where you need one, and if you're gonna need one in the reserve, and at some point, undoubtedly it will be needed, put one in the reserve.

So that's the background.

I support the petition.

I support the concept of having a fire station.

However, I I do have concerns about the conicil.

Uh all due respect to Toll Brothers, the city of Danbury taxpayers are the ones that are footing the bill.

If Toll Brothers wants to buy the parcel and build a fire station, they can then decide how they want to exit and entrance fire engines, which I suppose they could have a private firehouse up there.

But the taxpayers are doing this.

I'm not entirely comfortable with a prohibition of having an emergency exit at the firehouse that leads directly to reserve road.

I I I mean, there's there's a million scenarios where I can see fire trucks leaving and heading south to Ridgberry Road and getting stuck on Ridgebury Road because of a storm, a tree came down or whatever.

Meanwhile, there's a disaster happening in the reserve that they can't get to.

Councilman Rotello, if I can't, that's not that's not an issue.

It's all they're only talking about during the construction of the firehouse.

If if if that can if the city of Danbury, uh I'm not talking about regular back and forth uh three o'clock in the morning rolling fire trucks down reserve road, because I understand it's a private road and they don't want the excess wear and tear.

I I just want to be assured that if there is a need to roll a truck into the reserve, they can enter from that parcel to reserve road without running a foul of some uh prohibition that toll brothers may have considered.

That's telling me that the development of this phase, the construction of this phase until the day a certificate of occupancy is granted, they're gonna be coming in and out of Old Ridge Railroad.
