5:46

Next on the agenda is my statement about how the hearing is going to proceed this evening.

5:52

I am going to read this so I don't forget anything.

5:56

This is a public meeting, which means that no general public comment will be accepted, but each of the respondents and the code enforcement officers here tonight and any witnesses each of you call will be able to present evidence to me regarding each case and the violations of the Deltona City Code that are being alleged.

6:14

I am an attorney and appointed by the city commission to render decisions in these code enforcement cases to determine if a violation of the city code exists and what fine will be imposed, if any.

6:26

If you are here for a massey case, you might see that next to your case number on the agenda.

6:32

That means that I will be determining solely whether you have come into compliance in a timely manner in accordance with the previous order, the special magistrate issued in your case and will not be reopening the case to determine whether or not a violation existed in the first place.

6:48

Any decision I make this evening will be put into a written format in the form of an order.

6:53

A copy of my written order will be provided to the city and then mailed to you as

Unassigned speaker

6:58

well.

Speaker 1

6:59

It is important to note that for any order I issue, you may appeal by filing a written notice of appeal with the circuit court within 30 days of the execution of my order pursuant to Florida statutes, section 162.11.

7:15

The procedure of the hearing today will be governed by Chapter 162 Florida statutes.

7:21

Formal rules of evidence shall not apply, but fundamental due process shall be observed and shall govern the proceedings.

7:28

Hearsay is admissible, but only to support other competent and substantial evidence.

7:33

If you are a respondent, you will be able to testify.

7:36

Tell me what you think I need to know about your case, present evidence, and witnesses.

7:48

For each case, I will call the case number, and the city will proceed first.

7:53

The city has the burden of proving that the code violation exists.

7:57

Then you will be allowed to respond.

7:59

For each case, I intend to admit the case file and the PowerPoint presentation that will be shown for the case.

8:10

If you did not, please let me know when I call your case.

8:27

And I do have a couple of cases here that I will announce that have been withdrawn or continued.

8:34

So let me read those

Unassigned speaker

8:35

off.

Speaker 1

8:36

The following have been withdrawn.

8:38

DEL 25-040, Massey case, 912 Halstead Street.

9:04

So if you're here for any of those cases that I just read, you do not need to stay.

9:09

Your case will not be heard this evening.

9:20

So if you're able, please stand and raise your right hand.

9:26

Do you swear to tell the truth, the whole truth, and nothing but the truth?

9:29

If so, please say I do.

9:32

Thank

Unassigned speaker

9:32

you.

Speaker 1

9:38

All right.

9:39

I have no uh ex parte communications to disclose and uh no announcements to make, so we will proceed on with the cases.

9:53

Okay.

Unassigned speaker

10:00

All right, I have fire 2002-2025, 1200 Daltona Boulevard Suite 48.

Speaker 4

10:13

This is Robert Arnold representing the defendant in the action, I guess.

10:23

And we had requested a continuance because we had submitted the paperwork, so I don't

Unassigned speaker

10:28

know

Speaker 4

10:28

if we're required to have a whole hearing or if we

Unassigned speaker

10:33

could

Speaker 4

10:34

have this put out 30 or 60 days.

10:37

It's our first time on.

Speaker 1

10:40

Okay.

10:41

Um, and so for the city, uh, are you amenable to the request for continuance?

Speaker 5

10:48

No, we

Speaker 1

10:49

are not.

10:50

Okay.

10:51

Um what is the reason for the request for a continuance,

Unassigned speaker

10:56

sir?

Speaker 4

10:57

We submitted uh revised plans on July 18th, and in order for the city of Daltona and the um to review those to let us know if we are issued a permit.
