Summary of Proceedings

Deltona Regular Commission Meeting – October 6, 2025

The City of Deltona Regular Commission Meeting convened on Monday, October 6, 2025, at 6:30 PM in the Deltona Commission Chambers. The meeting included presentations, approval of a firefighter collective bargaining agreement, several ordinances, and appointments. Commissioner Santiago was absent. The meeting adjourned at 8:05 PM.

Presentations and Proclamations

  • Domestic Violence Awareness Month: Terry Ellis presented on behalf of Dana McCool, highlighting domestic violence statistics in Volusia County (fourth in the state with 562.9 incidents per 100,000, above the Florida average of 314), discussed challenges including lack of shelter space, need for transitional housing, and announced a dedicated victims advocate for Deltona.
  • First Step Shelter: Executive Director Dr. Victoria Fahlberg presented the shelter's services, including a 100-bed facility, a Safe Zone for law enforcement drop-offs, and housing programs. Reported that since opening five and a half years ago, 2,162 people entered the shelter, 1,072 were housed, and 93% remained housed. The shelter currently partners with nine cities (all east of the county). Discussion ensued about serving Deltona residents and possible partnership.
  • National Community Planning Month Proclamation: Read by Commissioner Nabicht, proclaiming October 2025 as National Community Planning Month in Deltona.

Consent Calendar (Items 8A–8F)

  • Approved by a single 6-0 vote. Includes: Third quarter reports of advisory boards; approval of minutes for September 3, 8, 15, and special meetings September 22; Team Volusia Economic Development Corporation Cooperative Agreement for 2025-2026 (Resolution 2025-148); Stormwater improvements contract with Pegasus Engineering for $195,930 (Resolution 2025-149); several proclamations (Extra Mile Day, Fire Prevention Week, Breast Cancer Awareness Month, Florida City Government Week, Italian Heritage Month, and an added Hispanic Heritage Month proclamation for Deltona Lakes Elementary); and a presentation request for a Potential Business Operations Center & Multi-Agency Resource Center (MARC) to be on the October 20, 2025 agenda.

Public Comments & Testimony

  • On Collective Bargaining Agreement (Item 7A): A resident requested all records, advertisements, meeting audio and transcripts for the negotiations.
  • On Consent Agenda (Item 8C – Team Volusia): Brandy White criticized the lack of cost-effectiveness analysis for Team Volusia membership, offering free assistance to perform a CEA or CBA. Commissioner Howington responded, citing new Economic Development Director John Cox and potential $40M projects, and offered to arrange a meeting with Team Volusia.

New Business

  • Firefighters Collective Bargaining Agreement (Resolution 2025-150): Approved 6-0. Previously, Commissioner Nabicht requested a Florida Commission on Ethics opinion regarding his voting eligibility (due to his former firefighter status and son’s employment); the City Attorney stated no conflict exists. The one-year contract runs from October 1, 2025 to September 30, 2026. Discussion included the 10% base-rate wage increase (saving ~$300,000 compared to base-plus-longevity), the smooth negotiation process, and the need for a successor agreement.

Ordinances and Public Hearings

  • Ordinance No. 28-2025 (Lobbyist Registration, first reading): After discussion, the initial motion to approve failed 3-3 (Mayor Avila, Vice Mayor Heriot, Commissioner Nabicht in favor; Commissioners Avila-Vazquez, Colwell, Howington opposed). Commissioners expressed concerns that commissioners were not required to file lobbying logs and that principals were exempt. A subsequent motion to refer the ordinance to a workshop passed 5-1 (Vice Mayor Heriot dissenting).
  • Ordinance No. 34-2025 (PUD minimum parcel size, second reading): Tabled to the October 20, 2025 Regular Commission Meeting. No action taken.
  • Ordinance No. 30-2025 (Amendment to Chapter 74 – Land Development Code, first reading): Approved 5-1 (Commissioner Howington dissenting). The ordinance designates the Planning and Development Services Director as administrative authority for plats/replats per SB 784, establishes an Urban Infill Redevelopment Program, and expands citizen participation meeting notifications from 300 to 500 feet.

Key Outcomes

  • Votes:
    • Resolution 2025-150 (Fire CBA): passed 6-0.
    • Consent Agenda: passed 6-0.
    • Ordinance 28-2025 (motion to approve): failed 3-3.
    • Ordinance 28-2025 (motion to send to workshop): passed 5-1.
    • Ordinance 30-2025 (first reading): passed 5-1.

  • Staff Updates: City Manager promoted Jordan Smith to Community Development Services Director, overseeing planning, zoning, housing, and the building department. City Attorney noted a draft micromobility ordinance (SB 462) was sent to VSO for comments.
