The City of Deltona held its regular commission meeting on June 1, 2026 at 6:00 PM in the Deltona Commission Chambers. Vice Mayor Avila-Vazquez was absent. The meeting included the swearing-in of five new firefighters, consideration of multiple consent agenda items, public hearings on three ordinances, and an appointment to Team Volusia. Key decisions included approval of a $3.8 million engineering contract for water reclamation facility expansion and adoption of an ordinance regulating small wireless facilities.
The following items were approved unanimously (5-1, Commissioner Nabicht voted against) after being pulled for separate discussion: Items 7-A (approval of minutes from May 4 and May 18, 2026), 7-B (Resolution 2026-46 for nuisance abatement contracts), 7-C (Resolution 2026-44 for paving city water/sewer parking lots and Bristol Court for $109,490), 7-F (proclamations for Faith and Family Month and DHS Girls Flag Football), and 7-G (presentation by Volusia County Hispanic Association on June 15). Items 7-D and 7-E were pulled for separate votes.
Item 7-D - Engineering Services for Eastern Water Reclamation Facility Expansion The commission debated Resolution 2026-43 to award a $3,822,362 contract to Kimley Horn for design, engineering, and permitting to expand the plant from 1.5 MGD to 3.0 MGD. Staff confirmed that only one qualified respondent (Kimley Horn) responded to the 90-day RFQ. To verify fair pricing, staff compared the bid to the similar Fisher plant RFQ and to previous work with Kimley Horn. The estimated total construction cost is around $34 million. Commissioner Howington expressed concern about consistently receiving only one bid via the DemandStar platform and asked staff to explore other advertising options. The motion to approve passed 5-1, with Commissioner Nabicht opposed.
Item 7-E - Road Milling/Resurfacing and Pavement Markings Resolution 2026-45 authorized purchase orders with CWR Contracting ($3,035,582.74) and Fausnight Stripe & Line ($65,613.55) for milling, resurfacing, and permanent pavement markings. Commissioner Howington confirmed that the contractor is not the same one that performed poorly on Howland Boulevard. The city is piggybacking on Volusia County's contract with CWR and Seminole County's contract with Fausnight. The motion passed 6-0.
Ordinance 06-2026 - Small Wireless Facilities Regulations (Second & Final Reading) This ordinance updates Chapter 82 to establish regulations for small wireless facilities in rights-of-way, as required by state law. City Attorney Jordan Smith explained it aligns with Florida Statutes and federal law. Commissioner Heriot questioned whether the ordinance allows cell companies to place micro antennas in any right-of-way, including in front of residences, and noted the state mandate. Commissioner Colwell asked about design standards and protections; staff cited lighting standards and co-location encouragement. The ordinance passed 4-2, with Commissioners Heriot and Nabicht opposed.
Ordinance 05-2026 - Trap, Neuter, Return (TNR) Program (Second Reading) The city attorney requested deletion of this item (Ordinance 05-2026) to allow legal staff to revise the language before returning for a future second reading. This action was approved via the earlier deletion by consent.
Ordinance 20-2025 - Barndominiums, Metal Buildings, and Storage Containers (First Reading) This ordinance would amend the Land Development Code to regulate metal buildings in residential and commercial zones. Commissioner Nabicht made a motion to table the ordinance, seconded by Commissioner Heriot. The motion passed unanimously (6-0), tabling the item.
Item 9A - Appointment to Team Volusia Executive Committee and Board of Directors Commissioner Heriot moved to appoint himself as the city's representative, stating his desire for the position. Commissioner Howington moved to appoint the City Manager instead, arguing that other cities use their manager and that she was the only commissioner currently on the board. Commissioner Howington's motion died for lack of a second. Commissioner Nabicht seconded Heriot's motion, which passed 4-2. Voting for: Heriot, Nabicht, Santiago, Mayor Avila. Against: Colwell, Howington.
City Attorney Jordan Smith announced that pending antitrust litigation against major fire apparatus manufacturers (REV Group, Oshkosh Corporation, Rosenbauer America) has been consolidated into a multi-district litigation (MDL) in Wisconsin, approved April 3, 2026. The suit alleges price fixing, production suppression, and sharing confidential information from 2016 to present. The city is gathering information and expects to recommend joining the MDL within a month, noting that triple damages may be available. Commissioner Heriot asked how many city apparatus may be affected; the attorney said at least two or three large purchases.
City Manager recognized Dana McCool for organizing a bike safety helmet giveaway for children before summer. He announced a groundbreaking ceremony for pickleball courts at Harris Saxon Park on Wednesday, June 3 at 9 AM, with basketball courts, walking trails, pavilions, and a splash pad to follow.
