But you're running.

8:00

It's all right.

8:17

And to republicans, one nation under God.

8:22

Indivisible with liberty and justice for all.

8:34

Each and every one of you to the September sixteenth regular meeting of the Egan City Council.

8:39

This is our second and final meeting of the month of September.

8:49

That said, uh, we have a fairly brief agenda tonight.

8:52

Um we're going to follow up a fairly brief meeting with a closed session as well.

8:57

And our attorney Bob Bauer will tell us all about that when we get to the end of our content for this meeting.

9:08

No, Mr.

9:08

Mayor.

9:09

Move to adopt the agenda's presented.

9:10

Second.

9:11

Moved and second, and any further conversation on the agenda.

9:15

And opposed nay, that motion carries, and we have an agenda.

9:18

We have no recognitions and presentations tonight, so I'm going to go right into our consent agenda.

9:23

Are there any members of the public who are here on an item that appears in the consent agenda?

9:27

And wanted to say an item address separately or had questions.

10:00

I got uh two items I would like to discuss on this.

10:02

I see you guys are gonna uh receive the draft for the final assessment.

10:08

I just think that the council and the residents shouldn't have to pay for any advanced warning signs that uh McNamara would have charged the council because I was told that this construction zone was a mobile work zone.

10:22

Mobile work zones don't need advanced warning signs, and so we shouldn't have to pay for them.

10:27

Also, I think the council should consider reducing the residents portion of it by what they would have had to pay if they would have had to install uh temporary crosswalks for pedestrians and bicyclists and people with handicaps.

10:44

None was installed in this neighborhood.

10:47

None was installed along Galaxy Avenue, which is a 45 mile an hour zone.

10:52

You cannot have these people walking out, traveling out in the lane of traffic.

10:57

None was provided, and it should have been provided basically by ProAG Pedestrians right of way, accessibility guidelines, uh pedestrians, and the state of Minnesota Department of Engineering and the Minnesota Council of Disability agrees with me that that should have had been done when they started tearing up the corners of the crosswalks, and when you guys actually did the close the sidewalk on that pond that's off of uh just north of Covington on Galaxy.

11:35

And can I get your name again real quick?

11:37

What's that?

11:37

Your name again?

11:38

My name's Dwayne Boudorak.

11:40

Dwayne, thank you.

11:42

Okay, that's all I got.

11:45

Uh Russ, um, I assume you probably talked to Dwayne already about these concerns.

11:50

Uh yeah, we've talked uh we've had discussions previously, yeah.

11:54

Okay.

11:54

Uh can you respond to that and uh whether or not this final assessment can see can contains those charges and um what if any concerns you have with it?

12:03

Uh Mr.

12:03

Mayor and Council members, the uh second, I'll take them in reverse of what should they were stated.

12:10

So I think the request is for something for getting a reduction of a cost that didn't occur.

12:19

So I think what is being requested is something that we can't do because there was no payment made for uh what uh Dwayne is stating should have been done, it should have been included as part of the project.

12:34

So there's there's no cost, though I don't have a bid necessarily uh that references that um so that would be challenging for me to do.

12:47

Um and then the other part as far as advanced construction signs.

12:52

Uh I think the you know we have uh a cost for that.

12:56

Um it's included uh with traffic control, but there's potentially a cost that could be determined or pulled out of that.

13:04

Um and I think the request that's being made is that it should residents shouldn't be assessed for that portion of the contract costs.

13:13

That's that's the warning signs portion.

13:16

Uh and whether or not it was warning signs or that's yeah, that's it's uh traffic control signage.

13:21

Uh councilbagen.

13:23

With those advanced warning signs um a change order or deviation from the awarded contract?

13:29

No, no.

13:31

Okay.

13:34

Okay.

13:35

Additional questions.

13:39

All right.

13:40

Um just one thing.

13:42

I in obviously there's nothing we can do retroactive, but in the future, maybe work um a little more closely with our contractors to make sure that you know, like not all four corners are being done at the same time so that people do still have a path to the extent that it's possible.

14:00

I understand that in complex construction projects where they're tearing up a lot of curb um and using the opportunity to install the proper ADA infrastructure that that might not be possible, but um sometimes it slips a little bit, and it's good to give them a reminder.

14:18

Okay.

14:20

Additional comments, questions?

Public Comments & Testimony

  • Dwayne Boudorak addressed the council regarding the draft final assessment reports (specifically for Project 1571, Ridgecliffe area). He argued that residents should not be charged for advanced warning signs on a mobile work zone and that the city should reduce the residents' portion to account for the lack of temporary crosswalks for pedestrians, bicyclists, and people with disabilities, particularly along Galaxy Avenue (a 45 mph zone). He stated that PROAG pedestrian right-of-way accessibility guidelines and the Minnesota Council of Disability supported his position.
  • Director of Public Works Russ responded that no payment was made for temporary crosswalks, so a reduction for a cost that did not occur is not possible. Regarding warning signs, he noted that traffic control costs include signage and that it could potentially be separated out, but the request is that residents not be assessed that portion.
  • Councilmember commented that while nothing can be done retroactively, future projects should coordinate with contractors to avoid closing all four corners of intersections simultaneously where possible to maintain pedestrian access.

Discussion Items

  • Veterans Housing Award Recognition: Councilmember acknowledged and thanked Councilmembers Fields and Supina for attending the Minnesota Veterans Assistance Council award presentation at the Minnesota Twins game on Sunday, September 14, 2025 (Veterans Appreciation Day at Target Field). The City of Egan was recognized for its commitment to veteran housing in the development off of Ron. Councilmember noted the “combat duty” of watching the Twins.
  • Closed Session Announcement: City Attorney Bob Bauer announced two closed sessions to discuss: (1) Arvinson and Damron vs. City of Eagan (lawsuit commenced by those individuals) and (2) the Gopher Resources condemnation case (commenced by the city earlier in 2025). He clarified that the Gopher Resources condemnation case is separate from other Gopher Resources news items. The council agreed to enter closed session after the regular meeting.

Key Outcomes

  • The consent agenda was adopted unanimously (motion and second, no opposition noted).
  • The council did not take any action on Dwayne Boudorak’s comments; the items remained in the consent agenda as approved.
  • The council moved into closed session after concluding the regular meeting to discuss the two listed lawsuits. The regular meeting was not adjourned prior to the closed session.
