Eagan City Council Meeting – March 3, 2026
The Eagan City Council met on March 3, 2026, at 6:30 p.m. at the Eagan Municipal Center. The agenda was shortened by the withdrawal of a Comprehensive Guide Plan amendment (Item VII.A). The council approved consent items, held three public hearings, approved a conditional use permit, and adopted a resolution opposing an ICE detention facility in the city.

Public Hearing A – Certification of Delinquent Nuisance Abatement Bills
- City staff reported 13 properties with delinquent false alarm invoices totaling just over $4,500 and 11 properties with delinquent nuisance abatement invoices totaling over $24,000. All required notices were published and sent to affected owners. The council closed the hearing and approved the final assessment roll, authorizing certification to Dakota County for collection with property taxes.
Public Hearing B – Certification of Delinquent Utility Bills
- The city had approximately 791 utility billing accounts with delinquent balances totaling just over $219,000. If certified, 5% interest is added. The council closed the hearing and approved the final assessment roll, authorizing certification to Dakota County for collection with property taxes.
Public Hearing C – Variance at 4950 Parkside Circle
- Applicants Susan and Tom Fleming proposed converting a section of existing deck to a screened-in porch. Existing building coverage was 2,702 sq. ft. (19.8% of lot area). The proposed 189 sq. ft. porch would bring total coverage to 2,891 sq. ft. (21.2%), exceeding the 20% maximum by 1.2%. Staff recommended approval, noting the variance is a minimum necessary, the lot exceeds minimum size, and the porch is consistent with R1 zoning. The Flemings expressed excitement to move to Eagan and cited the desire to enjoy views of Lebanon Hills Park. The council approved the variance unanimously, subject to staff conditions.
New Business – Conditional Use Permit (CUP) for LIVIT Site & Structure
- Applicant Tim Johnson sought a CUP to allow outdoor storage of landscape vehicles, equipment, and materials, and to allow off-site outdoor storage at 3486 and 3500 Dodd Road (zoned I‑1 Limited Industrial). The back parcel (3500) had a prior Interim Use Permit (IUP) for two shipping containers and a fitness area. The new proposal would replace the IUP for the containers, relocating them to a 4,300 sq. ft. fenced area screened with heavy‑duty privacy slats. The front parcel (3486) would serve as the office for the landscape business. The site plan also included a new trash enclosure and landscaping.
- Councilmember Bach noted the previous expectation that the shipping containers would be removed, but acknowledged the new screening and a condition making the CUP null and void if the two parcels are severed and sold separately. City Planner Schultz confirmed the fence would be 6-8 feet tall with heavy‑gauge slats and evergreen plantings. The APC had recommended approval with conditions. The council approved the CUP subject to those conditions.
Legislative/Intergovernmental Affairs – Resolution Opposing ICE Detention Facility in Eagan
- City staff reported that no request for an ICE detention facility has been received or considered by the city, but a site could be purchased or leased privately. Following resident requests at prior meetings, the council adopted a resolution opposing the establishment of such a facility in Eagan. The resolution will be forwarded to Representative Craig and both U.S. Senators.

Item A is uh a comprehensive guide plan regarding uh the property at thirteen sixty Lone Oak Road. Um it's for a multi-family development. So if you're here on that item, uh you should just know that that item has been withdrawn uh from proposal and the council won't be considering that tonight. Um and uh um so I just wanted to give you that heads up uh and hope you didn't come out for it because um you could be other places, I guess. The city code does allow for collection through certification of delinquent nuisance abatement bills that are not paid at the February 2nd council meeting, a public hearing was scheduled for this evening. All notices have been published in the legal newspaper and letters have been sent to all affected property owners informing them of this hearing and the proposed assessment. Uh the city has 13 properties with delinquent false alarms invoicing um invoices totaling just over $4,500 in total. Uh the city has uh eleven properties with delinquent nuisance abatement invoices totaling over 24,000 dollars. So finance director Feldman is in the audience if you have any questions.
