Oh perfect.

18:29

All right.

18:30

A little worried there that I had the wrong in-person day, but it looks like uh we're on the right track here.

18:37

So new recordings going at the city side.

18:39

So I think we can get started then.

18:41

It's the official hour, three o'clock PM for the record.

18:43

It's December eleventh, twenty twenty-five.

18:45

I'm Phil Albrex Hearing Examer for the City of Edmunds.

18:49

Today we've got a couple hearings to hold.

20:00

Recording has been ongoing.

20:01

Repeat the file number or anything.

20:02

Okay.

20:03

So uh all right.

20:04

So we're in a conditional use program for the Edmund School District and uh the hearing format will be the same as the next hearing, which is uh we'll start off with a staff presentation and is gonna be Ms.

20:14

Haas gonna be doing that one today.

20:17

That's correct, yes.

20:18

All right, and then uh once uh she's done uh summarizing her staff report, we'll move on to the applicants if they want to add any comments.

20:25

It's not required, but if the applicants want to say something, they'll have that chance after Ms.

20:29

Haas is done.

20:30

After that, then we'll go for why we're here today, which is to hear from the public.

20:34

We got uh people participating virtually and in the meeting room.

20:37

Everyone will be uh have an opportunity to speak who wants to, certainly give you that chance.

20:42

After that, we go back to Ms.

20:43

Haas to answer any questions people had during their testimony, and uh she can also uh provide rebuttal evidence that she finds necessary to complete the record.

20:52

And then finally, applicant gets final word, final opportunity to present rebuttal evidence, and I get a couple weeks to issue a final decision with a small allowance for the holidays.

21:01

So that's uh that's pretty much it in a nutshell.

21:04

Now, by state law, I'm only allowed to consider evidence that's put in the record today that we were all on the uh same page about what information is used to come up with the uh the final decision.

21:13

I'm not allowed to talk to staff or applicant or anybody about the project, and and I certainly have not done that.

21:19

I'm gonna share my screen real quick on the exhibit list that's in the staff report that Ms.

21:25

Haas put together.

21:27

Uh her staff report is based on a lot of um uh study and public input, including the zoning maps, the application materials, uh the notices that were provided, site plans and the environmental review, uh determined it was determined environmental impact statement is not necessary for this project.

21:43

We got some draft architectural plans and uh critical error determination and engineering uh division memorandum as well as public comment.

21:52

So in addition to the staff report, that's uh with 12 attachments.

21:55

Does anyone need to see those documents or have any objection to their entry in the record?

22:00

If you do, if you're in a meeting room, just wave your hand, say that you'd like to see one of these documents, or if you're attending virtually, click on the virtual hand at the bottom of your screen and not seeing any takers.

22:10

So I'll go ahead and admit uh the staff report in exhibits one through twelve.

22:14

Ms.

22:14

Hoss, let me swear in at this point, just raise your right hand.

22:16

Do you swear a firm to tell the truth, nothing about the truth in this proceeding?

22:20

Correct, yes.

22:21

Okay, go ahead.

22:26

And I'll get to let's start with the slideshow.

22:30

Um hello everyone, my name is Rose Hawes, associate planner.

22:35

I also have um my tech support here, who's also my colleague uh uh Tristan Sewell.

22:41

Oh sorry.

22:42

So the wrong one, is that no, that's a correct one.

22:46

And so if you really stump me, there's two of us here to answer any questions.

22:52

Let's go ahead and start it without that.

22:55

Okay.

22:56

So uh for first on the agenda here is a conditional use permit uh for the Edmonds School District.

23:04

So the Edmonds School District proposes to construct an approximate 5,984 square foot accessory place structure that is proposed to be approximately 23 feet in height, and that will be attendant to the existing Edmonds Elementary School.

23:22

And Tristan, if you go to the next slide for me.

23:26

And then as Mr.

23:28

Ulrex um already laid out uh the agenda today is um obviously this staff presentation.

23:34

We're gonna have applicant testimony, public testimony, additional discussion and adjournment.

23:42

Um so this is um a land use permit.

23:47

So only one land use permit was submitted under file number PLN 2024 0083.

23:53

It is a conditional use permit for height.

23:56

Uh conditional use permits are type three uh decisions, type 3B, um, in which the hearing examiner will make the the conditional use decision following this public hearing.

24:09

We're using criteria within the Edmonds Community Development Code 2005.

Summary of Proceedings

Edmonds Hearing Examiner Meeting: Play Structure and Subdivision - December 15, 2025

The Edmonds Hearing Examiner held a hybrid meeting on December 15, 2025, to consider two land use applications: a conditional use permit for a covered play structure at Edmonds Elementary and a preliminary conservation subdivision for Madrona Manor. Both hearings included staff presentations, applicant testimony, public comments, and will result in written decisions to be issued within the next few weeks.

Public Hearing: PLN2024-0083 – Edmonds Elementary Covered Play Structure

  • Staff (Rose Haas) recommended approval of a conditional use permit to increase the height of an accessory covered play structure from the LDR zone’s 15-foot limit to 23 feet. The structure, approximately 5,984 square feet, will be built on an existing paved play area and is consistent with the comprehensive plan and zoning code.
  • Applicant (Cami Anderson, Shocky Planning Group) stated the project is the final play shed from the 2021 levy, bringing equity to all elementary schools. She confirmed the district concurs with staff’s recommended conditions.
  • One written public comment from an adjacent property owner raised concerns about height and views, but no oral testimony was offered.
  • Hearing Examiner Phil Albrex noted the project appears straightforward and likely to be approved, with a decision expected within two weeks.

Public Hearing: PLN2025-0003 – Madrona Manor Preliminary Conservation Subdivision

  • Staff recommended approval of a seven-lot preliminary subdivision (down from the initial eight-lot proposal due to acreage discrepancies). The project involves combining three lots into seven, with conservation design preserving critical slopes, trees, and stormwater infiltration. A sidewalk will be installed along 232nd Street.
  • Applicant (Sherry Anderson, Village Life Homes) agreed to proceed with seven lots and highlighted clustering, tree retention (over 50%), and multiple infiltration galleries for stormwater management. Civil engineer Tom Abbott (Solid Ground Engineering) confirmed full compliance with the stormwater manual and no off-site discharge.
  • Public comments: Three community members spoke or submitted questions:
    • Chris Burgess (adjacent neighbor) asked about tree protection, traffic speed on 232nd, and requested a copy of the landscape plan.
    • Joanne Noel (adjacent neighbor) raised concerns about existing stormwater flooding, fencing between properties, and utility line impacts. Staff and applicant noted that stormwater will be fully infiltrated on site and that sewer/water connections are on 232nd, not affecting her lines.
    • Dave A (virtual participant) asked about lot dimensions and stormwater direction; engineer clarified all runoff is infiltrated on site.
  • Hearing Examiner emphasized that the stormwater manual requires no increase in off-site flows and that the city’s tree retention standards are robust. He encouraged the applicant to stay after the hearing for additional neighbor questions.

Key Outcomes

  • Both hearings were concluded with the record closed. Written decisions will be issued within 10 business days (by end of December 2025).
  • For the play structure: the examiner indicated likely approval.
  • For the subdivision: approval of a seven-lot plat is expected, subject to conditions including civil improvements, tree protection, and stormwater compliance.
