Welcome to the Planning and Zoning Commission meeting of uh June first, 2026.

Um tonight we will be hearing petitions uh thirty-six-twenty-five and thirty-seven-twenty-five and zero six-twenty-six.

Um before we move on to the agenda, I just want to go over um the process for tonight's meeting um and also discuss the role of the commission and the procedures.

Um so as a reminder, the planning and zoning commission is an advisory body to the city council.

The job of the commission is to review development proposals and determine whether a proposal meets the applicable standard of review.

Um and then uh the commission will um first hear uh from city staff on each project, and then we'll be uh allowed time to ask questions of city staff.

And then we'll invite the applicant to come forward and provide a brief overview of the proposal, and then the commission will have the opportunity to ask questions of the applicant.

And then after that, we will open the hearing to the public for questions and comments.

Um during that uh period, please come forward, state your name and spell it, and then provide your address, and then public comment should be addressed to the commission, and um we will be taking notes um and keeping track of any questions that arise and uh allow staff or the applicant to respond to those questions if they so choose.

Um and then once we've uh heard from all parties, the commission will then deliberate, vote, and then pass on that recommendation to City Council.

Staff is simply requesting that the petition 11-26 uh regarding 80 North State Street, that's the conditional use to establish an amusement and recational service, uh, more specifically the evil intentions haunted house.

So staff is requesting that that petition be continued to the next regularly scheduled meeting, which would be uh Monday, July 6th at 7 p.m.

And that's simply to allow for more time for staff to review the the last submitter.

All right, so the next item before you is the application by the Emmanuel Church of Elgin, also known as the Larkin Avenue Baptist Church, uh, is the applicant and property owner who is requesting approval of a map amendment and planned development as a conditional use with departures from the LG Municipal Code to establish the property with the existing single family residence located at 1172 Larkin Avenue as a separate zoning lot from the church property with the rezoning from CF Community Facility District to RC2 single family resident residence district.

All of this at the property that's known as 1152 to 1172 Larkin Avenue.

As usual, we'll start with the uh general location of the subject property.

This property outline in yellow is about 1.25 acres.

Uh it's on the north side of Larkin Avenue, as you can see between Melrose Avenue on the west and Aldean Avenue on the east.

Uh the property zone CF, community facility district, as it's home to the Emanuel Church of Elgin.

Uh as you can see the properties to the north and south have this yellow shade over.

Those are zoned RC2 residence conservation district, and they uh primarily include single family homes.

Uh the property to the east, uh directly to the east across Aldean is zoned NB, neighborhood business district.

That's a vacant commercial property that was formerly a gas station and a repair shop.

And then to the west across Melrose is the former Larkin Center.

That's on PRB, Planned Residence Business, that is now home to uh several multifamily buildings.

So the subject property on the top here is the bird's eye view looking to the north.

Uh is improved the L-shaped church building that's got the address of 1152 uh Larkin Avenue.

It also includes a one-story office building, uh sort of administration building in the middle here with the address of 1158 Larkin Avenue, and then the church's parsonage, which is the single family residence here in the far west end with the address of 1172 Larkin Avenue.

Property also has a surface parking lot in the back with 50 parking spaces.

Uh that parking lot has full access to Melrose Avenue and then a second access in the back of the church.

It's a one-way access to Aldean Avenue.

The single family residence has its own two-car detached garage, but its own access to Melrose Avenue.

So the church is proposing to establish this the former church's parsonage, the single family residence on the property as its own standalone property.

Once the property sort of becomes its own standalone property, then it needs to be rezoned to residential zoning classification for that single family family residence to be in conformance with the zoning ordinance.

So there, that's why the applicant is requesting the approval of the rezoning of that part of the property to RC2 residence conservation district.

And that zoning classification would match the zoning across the street, which is also RC2.

The general the property lines between the church parcel and the single family residence parcel would follow the existing six-foot-high solid fence that is on the property.

The resulting church parcel, however, would not comply with the resulting site design requirements, as this now would be the new property lines for that parcel.

That parcel would be 45,738 square feet, and requires coupled departures from the site design requirements for the CF community facility district.

That's the reason the church is requesting the approval of the planned development as a conditional use.

Obviously, the church has improvements within those 26 feet.

On the north side, there's the parking lot that is actually about 0.6 feet from that new lot line.

And then again, the existing shed is about two and a half feet from that from that property line.

The applicant is not proposing any uh improvements to the church property or the single family residence.

We have our analysis of the standards for map amendments, so for the rezoning, as well as for the planned development and for the conditional use is in the packet.

I'm an attorney, and I'm representing the Emanuel Church.

I have with me Richard Sander.

He is the lead pastor and the resident of the house that's being discussed.

And he will also subsequently be the buyer of that house from the church.

And we also have one of our trustees, Aliana Narve Narvez, and a deacon Ladana Spurlach are here in support.

I think staff explained pretty much what we're doing.

We have a campus and we're trying to separate the parsonage.

Uh nonprofits are you know struggling financially.

Uh this frees up the the value of that uh parsonage can be put back into the church.

Um it facilitates uh future um pastors that no longer uh would want to live in a parsonage, um may already have their own residence and that type of thing.

Um so I think I think it's so it's vital to the church and it's consistent consistent with the trends um in churches.

Um I don't know if you want to add anything to that, or I mean the staff's done a great job of uh detailing you know the the interaction of the two zoning codes that's uh all done by them.

The there's you know the variations are minor, or some of them might seem major, but it's just the existing parking lot is already right next to this to this house.

The house itself has uh you know, a large lot.

There's all those uh similar residences north of the church property and then across the street to the south.

So I think it's I don't I don't think it's uh detrimental to the community.

And this this house was originally part of the the neighborhood and not part of the church, but the church uh grew over time and acquired that house and added parking as well.

Um he's hoping to retire before too long, and and but continue to stay active with the church and stay in the house.

Let me just say something about that.

Um I just retired.

Um I was a bi vocational pastor, meaning I had a full-time job.

I retired from that last September.

Um, and uh remain as I guess you'd call it a part-time pastor at the church.

It is a small congregation.

Um, we've we've lived in the house 30 years.

Um if I had known I was gonna stay at this church for 30 years, we would have bought a house a long time ago.

Um, but as I approach my retirement from my full-time job, um, I really don't see a point when I'm not going to be living in Elgin until Laird's comes to pick me up.

I mean, my my dad died in his home at 88, so um, you know, we've we become very involved, we've made a lot of friends here.

Um I put on the red suit and do a lot of things in the city for Christmas.

So this is my home.

Okay, so I don't I can't tell you what I'm gonna be doing, obviously health-wise, but I have no intentions of you know, this is home for a while anyway.

Okay, I was just curious why why I was suddenly getting divided, but also I just wanted to make sure that there was no issue with that lot line and the parking lot for future.

I I'm happy that you mentioned that previous to the pastor living there, it was considered residential, it was separate from the church.

Uh it went paved in uh I believe it was 1999, so I'm not sure exactly about lot lines between the house and the church at that point.

Um not really, to be honest with you.

Um, like I said, it's it's in my mind I'm gonna be there for a long time, so let my kids deal with it after I die, I guess.

There's privacy fence between the residents and the parking lot, it's about three feet.

That's a very common situation, you know, through that part of town, the old part of town.

Um the church campus, if you call it that, you know, it started with a church and then they added on over a period of time.

I couldn't uh lay out when they bought the various parcels, but that's considered the side of the house, correct?

So this is the application by Wayside Cross Ministries as applicant and Wayside Cross Ministries title holding company is property owner.

We're requesting approval of one a plan development as a conditional use that incorporates and amends ordinance number G109 06 and grants departures from the LG Municipal Code.

And two, conditional uses to expand the existing emergency shelter and to establish a transitional housing facility, all within the existing light industrial building, commonly referred to as 1730 to 1740 Berkeley Street.

So we'll again start with the general location of the subject property.

This is a 1.17 acre property that is zone GI General Industrial.

It is on the north side of Berkeley Street, about 670 feet or so east of 2nd Street.

This is in the southwestern industrial park of the city.

As you can see, all surrounding properties have a sort of a light purple shade over them.

The properties to the west, east, and to the south are uh GI or PGI industrial districts, whereas the properties to the north are CI commercial industrial district.

To the north uh are several one story light industrial buildings, uh primarily with uh uh special trade contractors.

To the south is a 246,000 square foot building that is home to a uh a packaging wholesaler.

Uh to the east is a one-story multi-tenant light industrial building that shares uh full access to Berkeley with the subject property, and then to the west is the uh trucking terminal by uh RL carriers.

So here's a bird's eye view looking west.

So the subject property is improved with uh one one story, approximately 21,000 square foot light industrial building.

Uh it has multiple tenants and tenant spaces, and it also includes 40 parking spaces generally on the side and in the back of the building.

The property has, like I said, one full access driveway that is shared with the property to the east, and then there's a second uh access driveway that's on the west side of the building that's generally a one-way access to Berkeley.

So in 2006, the city approved by ordinance G109-06, the establishment of an emergency shelter within the units A and B of this property of this building, and that emergency shelter was subsequently established in 2007.

This is the unit A, and then the unit B.

Over the years, uh Wayside joined PADS and uh so they now together operate this shelter.

Uh the shelter was recently sort of split pads services uh 30 people and then Wayside primarily uh PAD services primarily overnight, uh up to 30 individuals, and then Wayside provides primarily daytime services for up to 30 individuals.

So that shelter for up to 60 persons was approved in 2006.

Um recently, both Wayside and PADS acquired additional tenant spaces.

Uh Wayside acquired this, it's known as unit C, and they use it for storage, and PADS similarly acquired this unit F that is also uh used as a separate tenant space for general warehousing and storage.

Um two other tenants spaces are in the building.

One is already uh vacant, uh, the other one the tenant the turn the lease expires at the end of August.

So PADS and Wayside are now requesting approval to expand within the entire building, uh the services, and then to service uh up to 180 persons, 118 persons instead of 60.

So this is a proposed uh expansion.

The on the left is the phase one expansion.

So uh pads would generally stay within their uh units A and F and provide services for up to um 40, I believe 40 people.

Uh this is the uh yes, a in the A and F.

Uh they would continue to have eight staff members and excuse me, it was up to 48 individuals.

Uh this space is approximately 8,185 square feet.

Um they would continue to provide primarily overnight services, however, they would also provide some daytime services coordinating with other uh area nonprofit agencies that uh help people that experience homelessness.

Wayside uh would stay within the rear portion of the building, they would occupy the remainder of the building.

That's about 12,943 square feet, and they would establish uh what's known as a transitional housing facility up to 70 persons.

So that total is 70 plus the 48 for for pads would be 118 persons.

Uh this wayside facility would be uh similar to the facility that they operate in Aurora.

Uh it simply provides housing and residential recovery program that is a five-step program that they can provide more details about.

Uh but it's for both men and women.

30:40

Uh, individuals have to be admitted to the program, and they generally reside here in dorm style living quarters.

Uh they have a variety of programs, job training, um, counseling services, and sort of spiritual and and motivational support.

Pads would have 10 professional staff members and up to three what they call resident assistants.

These are individuals that have gone through the program and are in the later stages of the program where they're actually serving as employees of the facility.

You may recall that Wayside uh petitioned the city to establish this transitional housing facility at 890 North State Street.

That was approved by the city council in December of last year.

However, after that approval, they were not able to come to terms with the owner of that property, and they had to forego on that initiative.

So they they switched back to this facility.

Wayside actually owns the entire building.

So the phase one improvements would be primarily on the interior of the building, uh, except for closing of several um overhead garage doors on the north side on the east side of the building that would open up additional space for parking.

They would increase the number of parking spaces from 40 to 44, and then they would also construct a refuse collection area in the back.

Phase two in the future would include construction of two additions, one in the front, about 600 square feet for pads uh that would provide additional support areas, and then one in the back for wayside that would be about 1,500 square feet.

That would be the uh donation collection center.

So the proposal, so here's a proposed elevation that generally shows the infill of the overhead uh garage doors that would be filled in with the masonry that would match the exterior of the existing building.

Uh and then here's the floor plan that generally shows that this is the front on the left side and then the back for wayside.

This area in the front before the addition is constructed would be used for uh outdoor playground equipment for for children as pad services, some families with children.

Uh that location is one of the departures needed by this proposal.

Uh the that's the location of the playground equipment.

It's only allowed in the rear yards, they're obviously proposing that in the front.

The other two departures that are needed.

The first one is the setback.

So the existing building is about 20 feet from the front property line.

The addition would match that same setback of 20.7 feet, where 25 is required.

So uh that's that's the one departure.

And then finally, the number of parking spaces is based on the number of beds uh with 118 persons.

That's there this type of facility is required, one parking space per two beds, and then plus one per employee.

Uh that leads to a total of 77 parking spaces required.

They would have only 44 on site.

Uh, staff is comfortable with this request because uh individuals that come to these uh facilities generally do not own personal vehicles, so it's generally uh just the the parking needs are for staff members and uh sort of random volunteers every so often.

So the 44 parking spaces can more than satisfy the needs of the facility.

Uh the uh requests meets needs to meet the standards for planned developments and standards for conditional use.

Uh our overview of the standards is in the packet, and staff recommends approval uh subject to the conditions in the packet.

I believe there's one condition worth mentioning, and that's that no outdoor storage of any kind would be permitted, and the applicant is not proposing any, and I believe that's the only condition worth noting.

Um we appreciate the uh commission and uh city council, and I know you folks have worked with us for years, and uh we're thankful for all the approvals that you've done in the past.

Uh as uh Demir mentioned, things did not work out with the building on State Street.

So uh once we knew our two additional tenants that are at the end of the building were gonna vacate, that provided an opportunity for us.

So uh we also have a representative here from PADs if you have any questions.

And so we do work hand in hand with PADS.

Uh we have a spiritual component, they have other components, but we do kind of the same thing to the for the most part.

Uh they have women and children.

Right now we're operating with men only.

Uh we we have, as Demir mentioned, a five-step program, basically, it's basically phases, five phases.

The first three phases are really a program where when those phases are up, they essentially graduate, but they can stay on board and work.

We also here, unlike in our Aurora facility, we have a part-time work program for the gentlemen that are there as well.

So our program, at least for Wayside, uh, we like to call it a life transformation program.

And uh we have guys there that have all sorts of issues and problems.

Uh we are separate from the issue of uh that was mentioned was a good question about um the Lexington Hotel.

Uh we know some of the folks that are over there at the Lexington, they might have been with us when we remember we were at Fremont Street and we had a day program, and now we have an overnight program.

So we have a different kind of structure and a different kind of operation.

But uh we are seeing an increase.

So we started overnight last uh basically December, and lately we noticed things are picking up.

So we're at about 66% occupancy based on the 30 beds, and so that's why we're looking for this opportunity to expand on the wayside side uh with another 40 giving us 70, and I believe another 18 on the pad side giving you 48.

So that'll increase things significantly, and part of the plans also call for a more extensive kitchen area because we'll be feeding a lot more people.

So those are completely separate issues, the LGIN, the city's program and housing of the yes.

Well, I uh in a sense we are in that there's a couple of task force out there.

I know um there's a homeless task force that meets, they have a Zoom call every so often.

We all we do talk and uh you know trying to see what's going on.

This the challenge for us and maybe for pads as well, is our program is very structured.

So there are a lot more for lack of a better term, restrictions, uh things that we put in place to help these folks move on from their current situation.

So some folks are not interested in coming on board.

The ones that we do have are committed to what they're doing, and uh, if they don't like what we're doing, basically they can move on.

We're not a prison or anything like that, but uh we're finding we have a good group of gentlemen there, at least on the wayside side, and um they've accepted that kind of break off from their current situation.

So not to say the Lexington program isn't good, but it's different.

Originally it was meant for the Elgin facility, which was a day center only to be a feeder to the full program in downtown Aurora, uh, which is a full seven month seven month to two-year program.

And so uh, you know, we we don't uh we don't it it makes it doesn't make any sense to have someone go through a seven month program and graduate and then we say goodbye, you know.

So we allow them to stay up to two years and we're finding them housing and jobs and uh these are the things that we transition people back into society and and uh so um but now Elgin will be uh less of a feeder to us.

So this work program we have, they can work part-time starting the second month, they're there.

So it will be not a dependent storage, it will be just a point to receive that and sort it out and move on.

Um but I also just want to say, you know, in our Elgin, I hope that Elgin is not using that code enforcement as a weaponizing form of enforcement.
