So, yes, I met with uh Inspector Lukey at the property what month and a half, two months ago?

So the owner found out about um the violations towards the end of February.

So once he found out about this, he and I started working on a timeline and game plan to get repairs made.

So where we're at right now, we've gotten two estimates already, and we're waiting on several more to come in.

Um he has an application in process right now to refinance the building.

Uh he does have a fair amount of equity in the property, so he will need to raise cash to make the need repairs.

Uh there's an appraiser coming to look at the property in two weeks, and then he's also considering some other financing options in case his current application with the bank falls through.

So he is taking efforts to get reasonable quotes and prices and a game plan in place to make the required repairs, and he's right now just looking at ways to pull together the cash to do this.

Well, so your client found out in February.

And he's just now trying to get financing, he's just now trying to get this stuff going.

Well, I mean, we've been working on it since the end of February, getting estimates, and he's been working on financing.

I mean, we're talking magnitude of 100 to 125,000 for where the bids are coming in right now.

So he doesn't have that cash in his bank account to pull out and start the work immediately.

So I mean he's he's very cooperative and he wants to get something done.

Um it's just a matter of having the appropriate time to find the best contractor, get work on the best prices, and then establish a timeline to do it.

Well, that's a good question.

He I've assisted him in getting two estimates, and he's he has a contractor coming to look at the building today.

Uh, and then he's got two others that are in the process of looking at as well.

I don't know when his loan application when he'll get any kind of answer on that.

I know he started working on financing shortly after he found out about this.

Sanders, it's it sounds like your your client you know ha has an interest in repairing that the property.

Do you have or do you have any objection to us having the repair order entered just as a mechanism for ensuring that the repairs are done?

Can you explain what that means exactly?

Essentially, the if a repair order is entered, it acts as a mechanism which allows the building commission to bring you or your client back at intervals to do updates.

Um if no repair's been done, we can seek enforcement of a civil penalty.

Typically, the initial similar penalty is a $500 penalty amount.

Um the repairs be done, then there's really no penalty that will be other than having a occasionally appear at these type of hearings.

Does it mean that you guys would pull in your own contractors to do the work?

No.

Um what kind of timeline do you establish with that?

What the hell I want you to want me bears on this.

Are there neighbor complaints on this property?

Uh yes, it initially came in as a mayor's complaint from a neighbor.

So really he he can't give you legal advice on these items.

What I can tell you is is that if there are neighbor complaints, it expedites the need for a resolution.

So I mean what the attorney for the building commission is doing is trying to, you know, get you I mean, you to amically agree and then not have to have a hearing, but the reality is is that I mean he can request a hearing, like right now, and we could have that hearing, and then I would make a decision on whether or not that repair order should be granted or not.

Usually with a repair order, not usually, with the repair order, they're not going to send their own contractors out to make that those repairs.

But the timeline when you have neighbors having issues with the property, for whatever the reason is, it's it's significantly expedited.

And so at least that's that's how I view it.

And so if the evidence is presented to me and there are neighbor complaints, that's one factor that would go into okay, what's the timeline for getting this getting these things done?

So I would say, you know, what what do you want to do on uh on on this?

Do we want to it it's Mr.

Sanders isn't gonna be able to control I mean I I don't he I don't want to speak for him, but it doesn't sound like he's gonna want to contract or gonna want to bind his client to any type of repaired timeline.

Basically, yes.

I mean, I I'm not sure this is the first time I've ever done this, so I don't know what our options are.

Other than to tell you that progress is being made to get uh bids, costs, get all that stuff lined up so that then a decision can be made on the best path to follow.

So, you know, he is he wants to keep the building, he wants to get the repairs done, uh, he wants to do it in a very timely manner, but he's weighing his options right now as far as raising capital and selecting the contractor to do the work.

Um and unfortunately, this I mean, I think this has been going on maybe for a year and a half, as I understand it, but he did not find out until he was notified by his mortgage company at the end of February, and then he sent a letter to us, and usually that's because he has an update of the auditor or the assessor because whatever whatever address is on those records, the county's records is where they send the notices.

So that wouldn't be an issue on the building commission's part or the county's part, it'd be an issue with him.

Right, true, very true, but again, um until he knew about the issue, he wasn't sure that he didn't know there was an issue until he learned about it.

So that's concerning too because he's not going to the property to look at see what's going on with the well, with all due respect, he lives in California.

He's recently came out of the Navy.

I mean, there was times where he was at sea for six months.

Um he's a good young man.

Uh he's he wants to do the right thing, but he can only do what he knows.

Um, I think another thing that would have helped is the building commission has the rental registry, which clearly indicates that we are the property management company.

I don't think that rental registry was ever referenced in this case with this situation.

So you know, that would be helpful in these kind of situations.

And I'm and I'm sure that there's a number of things they could they could have probably done, but in the end, it's the property owner's responsibility to make sure their property is maintained.

So understanding all of that, we're not going to make his problem their problem.

So what I would say is I'm going to grant your continuance.

I'm going to give you 30 days to come up with a plan and time frame, see if there's something that can be worked out on this property.

And Max, you had in your email today, you said um a meeting on the twenty July 23rd that um yeah, that just reflected if the the repair order was affirmed.

It's like a five-gallon jug that you would fill up a water thing with, and there's questionable fluids in it.

I know there's been several attempts by our office, uh, other nonprofits and health department.

Yeah, and other government agencies trying to reach out to the property owner who resides in Florida to get some resolution on this trailer on the trailer court.

So it's kind of where we're at today with it.

Your Honor, I will say that the Attorney General's office has filed a uh a lawsuit against the property owner for the park.

Uh unfortunately there's been no progress in that lawsuit.

Based on the evidence presented today and the testimony from the building commission court find that the structure is a public nuisance.

It's a hazard to public health.

It's an impaired structural condition and makes it unsafe to persons or property and vacant or blighted and not maintain it in a mirror that will allow for human habitation occupancy or use in the requirements of statute or ordinance.

My authority is derived from Indiana Code 36-7-9, the Unstate Building Laws and Ordinances enacted by the City Council of Evansville. I have authority to issue civil penalties up to $5,000.
