0:36

That's just for all my charity.

0:45

Call the roll.

0:47

Sure.

0:48

Mr.

0:49

Knapp.

0:50

President.

0:51

Ms.

0:51

Conan.

0:52

Here.

0:52

Ms.

0:53

Coral.

0:53

Here.

0:54

Miss Yanko?

0:55

Here.

0:55

And Mr.

0:56

Dufferin is not here yet.

1:00

Um under procedural review, I just thought it would just jump in and add a couple of things since we have law director here.

1:08

Is that maybe um after we go through review of Article 7, or we could do it before we we can roll back to um Article 7 when we discussed the law director and we could had some questions and things we could talk about.

1:22

And I think that one's gonna take more discussion anyway.

1:26

Um and then um Lisa for what we're trying to do is we we've got a running uh word document, thank you, Sharon, of the things we're looking at, but we want to get through all articles and then we're gonna go back and curate that to come up with those things we believe are substantive and material.

1:46

And I still kind of get stuck on.

1:48

I mean, it's going into the ballot that these ought to be significant things that are addressing an issue of modernization, whatever those are.

1:56

So that's our attempt.

1:58

Because I so we I didn't want to give you something to look at when it some of those things may just drop off because we don't think they're material.

2:06

And then I think what we'll end up doing is have a a second document that we would send to the council and mayor, which would be things maybe that we were not addressing here, but that we that should be thought about, or I'll call them out of scope things.

2:22

I think like um job descriptions should be refreshed annually, and so we're gonna put some things in recommendations.

2:29

Um but anyway, that's the process that we're trying to do so we can get to a good list, work through it the language as best we can, and then you'll get get it to you for your um final touches and help get it prepared for both council and hopefully on the ballot.

2:45

Yeah, sounds good.

2:46

I mean, I'm happy to answer any questions tonight that you have about the law director position or interpretation of the charter in that regard or you know, anything about that.

2:57

Um I can't remember how I got invited tonight.

3:00

I know the mayor said to me I think it might be time for you to go.

3:03

He said that, but I think also somebody on the commission messaged me and asked me to come.

3:09

Okay.

3:09

And um, and then I had been I've been following along, like Sharon has been sending me the minutes, and I've been kind of following along and answering questions that uh every once in a while when you guys would ask me.

3:19

Yeah, um and then I I think I gave you some.

3:22

So last year Stowe and Barbadon went through their huge undertaking, and so I gave you some suggesti I or I guess I could it went out of suggestions, it's just like things they changed.

3:33

Um and so yeah, I'm happy to.

3:35

I kind of came, I tried to come prepared tonight.

3:37

Okay, but I might also have to say, let me think about that or let me look that up.

3:41

Yeah, no, that's why I think it might be over time, because I said I think we're still trying to figure it out.

3:46

And I did take the time today to review the video in detail on the law director section.

3:53

And a lot of the things that have come up here came up back then.

3:56

Yeah, and I think what they ended up with was the best thinking that they had.

4:00

Yeah, and so I don't know if there's a lot of substantive changes that we can make.

4:05

Yeah.

4:05

Um it's challenging, and uh and for me it was uh revelation in that because it's elected position, I'm I'm used to looking at a job description and it's there isn't one, so therefore then in a chart or something and try to build guardrails, I guess.

4:20

And that was just a little different for me, so now I'm finally up to speed.

4:24

So anyway, that's kind of how we're gonna proceed through.

4:26

Okay, sounds good.

4:27

And we're gonna try to move.

4:28

I said quickly.

4:29

Um, I think once we get past article eight, we should move pretty quickly, and then we'll circle back and start working through original one.

4:38

Plus, I think as we get later in it, we're probably gonna change some of the thoughts on some of the earlier uh questions that we had.

4:45

So can I just say before I mean I don't know if I this is out of turn, but like the general big picture overview that I got is just what you said, which is that we're kind of rehashing uh 2018, you know, 2019 kind of opening old wounds.

5:00

I don't know if that's a good thing.

5:00

Maybe it is time to look at it and just see where we are.

5:02

I'm I would love to give you my perspective of what my experience has been with this.

Charter Review Commission Meeting - March 23, 2026

The City of Green Charter Review Commission met on Monday, March 23, 2026, at 5:03 PM in Council Chambers. The meeting focused on reviewing Article VII (Boards and Commissions) of the city charter, with extended discussions on the Civil Service Commission, the Parks and Recreation Board, and the Law Director position. The commission approved the minutes from the March 9, 2026 meeting and heard from invited guests, including Law Director Lisa and Parks Director Valerie Wax Carr, about proposed language changes. No public comments were offered.

Consent Calendar

  • Approval of Minutes: Motion to approve the March 9, 2026 meeting minutes carried unanimously (5-0).

Discussion Items

  • Procedure Review & Process: Chair Robert Duffrin outlined the commission's process: review all articles, then curate a list of substantive changes for the ballot, with a separate recommendations document for items deemed out of scope (e.g., annual job description refreshes). Law Director Lisa was present to answer questions.
  • Article VII, Section 7.3 – Civil Service Commission: Commissioner Betty Konen reported on her research into civil service systems, noting that Green operates a hybrid model (some positions at-will, others civil service). Kimberly Bear, a Civil Service Commission member, provided statistics: the city has 153 total positions – 117 classified (civil service) and 36 unclassified. Discussion revealed that the board of education has not historically made appointments to the civil service commission, defaulting to the mayor. The commission took no action but flagged the issue for future consideration.
  • Article VII, Section 7.4 – Parks and Recreation Board: Director Valerie Wax Carr and board member Dan Pollock presented proposed language changes to reflect the board's advisory role, driven by a lawsuit that clarified the board cannot make spending decisions. The lawsuit, which the city won, established that the board is purely advisory; however, charter language suggesting otherwise created legal exposure. Proposed changes strike provisions that required the board to develop spending plans and instead state the board "shall serve in an advisory capacity to the mayor and city council." Commissioners debated whether to simplify further by removing redundant clauses. The commission agreed to review the lawsuit decision at the next meeting and consider additional edits. Mayor Rocco (who arrived late) was briefed on the discussion.
  • Article VII, Section 7.5 – Law Director: The commission revisited the Law Director section, which contains detailed qualifications and duties. Law Director Lisa explained that the current arrangement (elected, part-time, with a minimum 20 hours) works well, providing independence from political pressure. She argued that the extensive qualifications language is overly restrictive and suggested simplifying to basic requirements (licensed attorney, residency, good standing) while leaving operational details to ordinance. She noted that part-time status attracts quality candidates who can manage their own schedules. Commissioners expressed interest in editing the section, with some supporting a complete rewrite. The discussion also touched on the city's use of a lobbyist (Van Scoyoc Associates) for zip code issues, which came out of the law director's budget. The commission will invite Law Director Lisa back for further discussion after formulating proposed changes.

Key Outcomes

  • Approved minutes of March 9, 2026.
  • Parks Board Language: The commission will review the lawsuit decision and consider further edits at the next meeting (April meeting, during Article VIII budget discussion). Director Carr and board member Pollock will return with adjusted language.
  • Law Director Section: The commission plans to discuss potential edits internally and then invite Law Director Lisa back for a dedicated session to refine the charter language.
  • Civil Service: No changes proposed; the commission noted the issue for future review.
  • Adjournment: The meeting was adjourned by motion at approximately 6:30 PM, after about 1.5 hours of discussion.
