The Planning and Zoning Commission met on Wednesday, June 17, 2026, at 6:00 PM in the City of Green Council Chambers. The commission considered four development proposals, a text amendment regarding drive-thru facilities, and routine business. All items were approved unanimously.
26-17 Federan Lot Split (4500 Mayfair Road): Gerald Fetterin requested a variance to the lot width-to-depth ratio for a proposed lot split. The existing 5.6-acre parcel would be split into a 3.45-acre lot (purchaser) and a 2-acre remainder. The variance was needed because the depth (approx. 740 feet) exceeded the maximum allowed (382 feet) given an 85-foot width. Staff noted an existing capped oil well facility with an easement likely to be removed. The commission approved the variance contingent on submission of survey documents showing all existing easements.
26-19 Akron's Finest Mulch ID Sign (4590 Massillon Road): Mario Halasa sought final approval for an identification sign and landscaping plan for a mulch satellite yard. The sign is 17.5 square feet, two-sided, within the Greensburg special sign district, meeting height and lighting requirements. The landscaping includes perennials, evergreens, boulders, and a split-rail fence. Staff recommended approval. The commission approved with a condition to stake the fence location to verify setbacks.
26-21 The Chapel Community Room (1800 Raber Road): Representatives Sarah Johansson and Joe Schaefer presented a proposal for an 8,500-square-foot community room (400-person capacity) with exterior public restrooms and a patio. The project is a conditional use in R-1 zoning. Staff recommended conditional approval; final engineering had been received. One parking spot (formerly a handicapped space) would be eliminated due to width concerns. The commission approved the conditional use certificate, contingent on removal of the parking spot and verification from the FAA regarding crane use.
26-22 Dairy Queen (4015 Massillon Road): Josh Drummond (architect) and Aaron Haller (Parfait Properties) presented a 2,900-square-foot Grill & Chill restaurant with a drive-through, 46 indoor seats, 22 patio seats, and 35 parking spaces. Phase one of a master plan; phases two and three (including a contracted OAK Clinic and future uses) will be reviewed separately. Staff noted tight truck turning movements and pedestrian crossing of the drive-through. The commission debated the location of the iconic red spoon (visible from Massillon Road) and the width of the site entry. The applicant noted deliveries occur early morning, and the spoon can be relocated. The commission approved the site plan subject to conditions: comply with engineering and fire comments, install a Knox box, and obtain required permits. Chair requested the applicant consider moving the spoon to a less visible location.
26-25 Land Development Code Text Amendment (Drive-Thru Facilities): The proposed amendment requires a dedicated bypass lane for new drive-thru facilities to allow vehicles to exit the queue. It would not apply to routine maintenance. The amendment was requested by the mayor and councilman Spate. Commissioners discussed whether a single bypass lane per site is sufficient, especially for dual-lane drive-thrus. A motion passed to recommend approval to city council with the addition of language specifying that one bypass lane per site is required.

Good evening. We're gonna start with item number 2617, the Federal Lot Plot split. Um is a representative from the project here? Yeah. You want to come up here, state your name and address for the record, please? Tell us a little bit about your project. So my name is Gerald Fetterin. Um currently live 873 Guinevere Circle. Um looking to purchase a play and I think it's 4450 Mayfair Road. Um looking to purchase a you know, split this lot to be able to purchase a partial of it from uh the current owner, uh Mr. Barber. Uh so we need to get a zoning approval, I guess, because of the um the lot distance or depth to width ratio. Um so kind of this is the the current layout we're looking to to try to get. We would like to purchase the the 3.45 acres. Um kind of be able to build a house towards the back of it, connect to the sanitary sewer on the side of rain tree there. Um leave the the current owner, Mr. Barber, you know, two acres that he still has enough frontage to be able to do what he would like to in the future if he wants to sell. So okay, great. Thank you. Uh staff report. Okay, yes. So um this would be a request for a variance to the width to death ratio. Uh given the configuration of that existing 5.6 acre parcel. Um with the uh the flag lot that Mr.
