Okay, good evening everyone.

0:17

It is Thursday, June 18th, 2026.

0:20

I've got 601 in the evening.

0:22

We're scheduled for matters that are appending before the Board of Zoning Appeals.

0:26

If you would then please rise with me and we'll say the Pledge of Allegiance.

0:32

Pledge allegiance to the flag.

0:36

And to the Republic for which we say one nation under God.

0:43

Thank you.

0:44

Please proceed.

0:47

Mr.

0:47

Incarvati.

0:48

Here.

0:49

Mr.

0:49

Spate.

0:50

Here.

0:50

Miss Newbert.

0:51

Here?

0:52

Mr.

0:52

Awadala.

0:53

Here.

0:54

Schultz, absent.

0:55

Miss Prescafor.

0:57

Yes.

0:58

Excellent.

0:58

All right.

0:59

Welcome everyone.

1:00

Uh the matters that we do have will tend to take in in the uh in the numerical order that they appear on the agenda.

1:06

So we'll start that way.

1:07

When we call your case, we'll bring you forward and we'll have you sworn in and we can make your presentation.

1:14

The first matter that I've got is VZA 2026-12, Donald Sedlock and Haley Burke at 3747 Chesterfield Drive in the City of Green.

1:23

Here are the pellets, Donald Sedlock and Haley Burke at that address in Green are requesting a variance to allow a driveway that is a width of 26 feet within 10 feet of the road right away to remain as constructed.

1:34

This does not comply with Green Codified Ornus Chapter 157 of the Planning and Development Code.

1:39

Specifically there, we're 157.1347B3B, which specifies that a maximum driveway width of 24 feet within a 10 feet of the right-of-way.

1:49

So the applicants are requesting a two-foot variance to permit the 26-foot driveway to remain.

1:54

Specifically stated the variance request before the board is a two-foot variance to permit a 26-foot wide driveway within 10 feet of the road right-of-way, which has already been installed.

2:04

All right, welcome.

2:05

If you'd raise your right hands for me, you swear or firm and tell the truth, the whole truth, and nothing but the truth in this matter before the board.

2:10

Yes.

2:10

Well, okay.

2:11

Can I get your name, please?

2:12

Donald Sedlock.

2:13

Haley Burke.

2:14

Okay.

2:15

So since we're kind of already drifting towards that presentation, absolutely.

2:19

And you'll see that there is a camera above you, a little white dot or X on on there.

2:24

That'll grab whatever you've got down below it.

2:26

And if you would just share that mic, that'd be awesome.

2:28

So we've got our our zoning matter before us, the appeal.

2:32

Uh what happened here and and why did we need the extra.

2:35

Yeah, thank you.

2:36

Um first thank you for hearing us and uh our apologies for being here after the fact with uh request for a variance.

2:45

Absolutely not what we were hoping to do or uh the order that we would want to do things in.

2:50

We did um uh home renovation and we did a uh garage addition.

2:56

We worked with a um a builder and architect to get this all squared away and designed and built.

3:03

During that process in those conversations, we were operating uh with the understanding that the all of the permitting was going to be handled by the builder.

3:12

Um and we believed that that uh it included the work with the driveway.

3:18

Uh it wasn't until after the fact that I had reached out to um the city for some other matters that we realized this was incorrect.

3:26

So we're here today to remedy this, hopefully, and um make it make this right.

3:30

But what happened is um as we built the as we built the house here, or as the as we built this garage edition, which is um kind of reflected um with this square here, that was permitted.

3:46

And then the blue piece here is an overhang.

Green Board of Zoning Appeals Meeting – June 18, 2026

The Green Board of Zoning Appeals (BZA) met on Thursday, June 18, 2026, at 6:01 PM in the Council Chambers. Board members present: Robert Incorvati (Chair), Sherry Neubert, Samer Awadallah, and Robert Speight. Andrew Shultz was absent. Also present: Zhila Pezeshkpoor (Assistant Director of Planning) and Renee Wilcox (Secretary). The board considered five variance requests and approved all unanimously. The meeting concluded with approval of the May 21, 2026, minutes and adjournment.

Business Items

TMP-5394 – BZA2026-0012: Donald Sedlock & Haley Burk, 3747 Chesterfield Dr.

  • Request: A 2-foot variance to allow an existing 26-foot-wide driveway within 10 feet of the road right-of-way (code max 24 feet). The driveway was constructed without the required permit. Appellants cited aesthetic reasons and accessibility for family members with mobility issues. Assistant Director Pezeshkpoor noted the city is updating its code to permit 30–36 foot driveway widths.
  • Vote: Motion to approve by Neubert, seconded by Awadallah. Passed 4–0.

TMP-5395 – BZA2026-0013: Translucent, LLC (on behalf of Dorothy Farkas), 4442 Broadley Cir.

  • Request: A 12-foot rear setback variance to construct a 12×10-foot covered deck, leaving a 28-foot rear setback (40 feet required). The property is pie-shaped, and the deck would be minimal with 4×4 posts. Two letters of support from neighbors were received.
  • Vote: Motion to approve by Speight, seconded by Neubert. Passed 4–0.

TMP-5396 – BZA2026-0014: Thomas DeMinico, 3849 Heron Watch Dr.

  • Request: A 10-foot rear setback variance to build a deck, leaving a 10-foot rear setback (20 feet required). The homeowner explained they previously lived in a three-story house and experienced falls; they now need a flat deck. Plans have been reviewed by Summit County Building Standards.
  • Vote: Motion to approve by Awadallah, seconded by Speight. Passed 4–0.

TMP-5397 – BZA2026-0015: Larry Beyes, 852 Redwood Dr.

  • Request: A 4-foot right side setback variance to place a 16×10-foot shed with a 4-foot patio, leaving a 1-foot side setback (5 feet required). The homeowners worked with neighbors to preserve views of the golf course; a letter of support was submitted.
  • Vote: Motion to approve by Neubert, seconded by Awadallah. Passed 4–0.

TMP-5398 – BZA2026-0016: James & Laura Brott, 3526 Mayfair Rd.

  • Request: Two variances: (1) to permit a detached garage in the front/side yard (required rear yard) and (2) a 10-foot height variance for a garage 28 feet tall (max 18 feet). The garage could not be placed in the rear due to well, septic, and irrigation systems. The second story is for storage and plant starting. Materials will match the house, including cedar shakes and a metal roof. Neighbor support letters were received.
  • Vote: Motion to approve both variances by Speight, seconded by Neubert. Passed 4–0.

Key Outcomes

  • All five variance requests were approved unanimously (4–0).
  • The minutes from the May 21, 2026, meeting were approved as submitted (motion by Speight, passed 4–0).
  • The next BZA meeting is scheduled for July 16, 2026.
