0:51

First one I have is BZA 2026 17.

0:55

Pamela and Corey Harbin at 2424 Linden Drive here in the City of Green.

1:00

Or appellants, Pamela and Corey Harbin at that address, are requesting a three-foot height variance to permit fencing of six feet in height to be placed in the frontage of Pine Lake Trail, where three feet's a maximum amount allowed.

1:12

That does not comply with Green Codified Ordinance Chapter 157 of the planning and development code.

1:16

Specifically there, it's 157.085 C1A fences.

1:22

And specifically stated the variance requests a three-foot fence height variance to permit six foot fencing in the front yard of a parcel with two frontages.

1:31

And who's here on that matter?

1:32

Okay, you guys.

1:33

Well, welcome you forward to that podium.

1:35

We'll swear you both in.

1:37

You'll notice there's a small X there.

1:39

If you have anything that you wish to display, and we have your materials, so we've looked at those two, but uh you are you're welcome to slide it on the X and it'll grab it.

1:48

Uh and if you wander away from the podium with that mic, please pick up the handheld mic so that we can make sure we got our record going.

1:56

But if you would you raise your right hands for me.

2:01

Do you swear a firm to tell the truth and the whole truth and nothing but the truth in this matter before the board?

2:04

Yes.

2:05

Okay, can I get your names, please?

2:06

Pamela Harbin.

2:08

All right, thank you.

2:08

Yeah, go ahead.

2:09

Pamela Harbin.

2:10

All right, and your name's Corey Harbin.

2:11

Okay, and that address is a good address for you, good mailing address too.

2:14

Yes.

2:14

Okay, the the nature of the appeal.

2:17

Why do we need why do we need the the height in the fence?

2:21

Um so our main item is for safety.

2:24

Um we have a two-year-old son, and unfortunately, our unique property sits on a corner with four point intersection with having the two front yards.

2:38

We have no backyard for him to play in.

2:41

Um, a three-foot fence.

2:42

Um, he is three feet right now, so he is able to climb that in any capacity.

2:48

Um that is the main reason of why we are requesting this is for safety concerns to expand and have more area for him to play and for us to actually live and enjoy our property and our home.

3:03

Excellent.

3:04

And as you noted, you're on a corner lot, and that's where that requirement kicks in.

Green Board of Zoning Appeals Meeting - July 16, 2026

The Board of Zoning Appeals held a meeting on Thursday, July 16, 2026, at 6:00 PM in the Council Chambers of the City of Green Central Administration Building. The Board considered two variance requests and approved minutes from the previous meeting. All votes were unanimous (4-0) with Board Member Samer Awadallah absent.

Public Comments & Testimony

  • Pamela and Cory Harbin (appellants, 2424 Lyndon Dr.) requested a 3' fence height variance to install a 6' tall wooden privacy fence along their second frontage on Pine Lake Trl., where 3' is the maximum allowed. Ms. Harbin cited safety concerns for their 3-year-old toddler who is starting to climb. They noted the fence would connect to an existing shed in the side yard and that they had coordinated with the gas company regarding a marked easement. They submitted a letter of support from neighbors.
  • Micah Done (appellant, 980 E. Nimisila Rd.) requested a variance to construct a 12' x 16' barn-style shed in the side yard, where accessory structures are required to be in the rear yard. Mr. Done explained that the rear yard has a steep 10-15' slope, making it impractical to place a shed there; the only flat area is on the side. He stated the shed would match the house in appearance. Neighbors submitted letters of support noting similar terrain challenges.

Discussion Items

  • Board questions on the Harbin fence: Board Member Neubert asked about the side yard and tree line. Ms. Harbin indicated the fence would be placed under trees and connect to the shed. Board Member Shultz advised confirming gas line markings; Ms. Harbin confirmed the line is marked and she has been in contact with the gas company. No opposition was expressed.
  • Board questions on the Done shed: Board Member Speight asked if the shed would match the house. Mr. Done deferred to his wife for color selection. Board Member Shultz asked about setbacks; Secretary Wilcox clarified that any accessory structure must meet the minimum 5' side setback. No opposition was expressed.

Key Outcomes

  • Motion by Board Member Shultz, seconded by Board Member Speight, to approve the Harbin fence height variance as requested. The motion carried 4-0.
  • Motion by Board Member Neubert, seconded by Board Member Speight, to approve the Done shed variance with the condition that it meet the 5' minimum side setback. The motion carried 4-0.
  • Approval of meeting minutes from June 18, 2026: Motion by Board Member Speight, seconded by Board Member Incorvati. Carried 4-0.
  • Adjournment at 6:12 PM.
