Item 3: KLA Holdings Administrative Appeal
KLA Holdings appealed a notice of violation for three ordinance violations after recombining 42 lots into one parcel at 1300 Allen Ridge Road. The appellant argued no physical change, no subdivision, and no permit applications; the city argued conversion to multifamily use required site plan and subdivision approval. After deliberation, the board found an error in the application of Section 9-4-10 (only one principal use on a lot) but upheld violations of Section 9-4-142 (failure to submit development plan) and Section 9-5-6 (lots created contrary to subdivision regulations). A motion to modify the decision by removing the 9-4-10 violation and affirming the other two carried on a 6-1 vote. The board will prepare a written decision by the April 20 special meeting.
Item 4: Cannon Administrative Appeal – Withdrawal
Edwin Keith and Ashley-Nicole Cannon requested to withdraw their appeal of a notice of violation for sign ordinance infractions at 2306 Charles Boulevard. The board approved the withdrawal unanimously.
Item 5: Crystal Smith Special Use Permit – Child Daycare (Drop-in Care)
The applicant sought a special use permit to operate a drop-in daycare at 618 East Arlington Boulevard. Staff noted compliance with the Future Land Use Plan and recommended approval with conditions: all activities indoors, compliance with NC General Statutes on child care, and a change of occupancy permit. The board approved the permit unanimously with those conditions.
Item 6: Greenville Preparatory Academy Special Use Permit – Continuance
The applicant, Greenville Preparatory Academy, did not appear. The board continued the matter to the April 20, 2023 special meeting without objection.

And Hanya Format. Present. We have quorum. And Madam Chair, all members present tonight are voting members for tonight's meeting. Okay. Thank you. Is there approval of the minutes for the month of January 26th? They were included in our meeting packet. Is there a motion? So moved. Is there a second to that motion? Second. Okay. It's been moved by Ryan Purdle and second by Chris Lilly. All those in I was just going to say there is a approval of the agenda that I believe was right before that. So I apologize. All right. Let's back up. Is there a motion to approve the meeting agenda? Hold on. Should I say? Yes. So in front of you, um, you have two requests for two agenda items in front of you. Um, the first one is a request from uh the petitioners for item number two. They're asking to continue their item till April. And then the second one, I'll just go ahead and tell you you have a request from Ashley Nicole Russell or Canon. That's item number four. She's asking to completely withdraw her item. Okay. So what we're gonna do, we're gonna approve the agenda as it is printed, and then we will deal with those items individually in a second. Okay. Is that fine with everybody?
