Greenville Board of Adjustment Meeting Summary – February 23, 2023

The Greenville Board of Adjustment met on February 23, 2023, at 6:00 PM in City Hall Council Chambers. The board considered continuances, administrative appeals, and special use permits. Key actions included modifying a notice of violation against KLA Holdings, approving a child daycare special use permit, and scheduling a special meeting for April 20, 2023.

Consent Calendar

  • Approval of Agenda: Motion carried unanimously.
  • Approval of Minutes (January 26, 2023): Motion carried unanimously.

Public Comments & Testimony

  • Rizzuti Continuance: Opponent Ms. Squires stated she was fine with a March continuance but preferred not April; she later agreed to either date.
  • KLA Holdings Appeal: Extensive testimony from appellant attorney Robert McNeil, owner Leslie Pagliari, city planner Shantae Gooby, city attorney Emmanuel McGurk, and Pitt County Tax Administrator Russell Hill. No other public testimony.
  • Crystal Smith Application: No opposition; applicant Crystal Smith and assistant Stephanie Williams presented the proposal.
  • Greenville Prep Academy: No applicant appeared.

Discussion Items

Item 2: Rizzuti Special Use Permit – Continuance Request

The applicants, Richard P. and Meridith Rizzuti, requested a continuance for their special use permit to operate a multi-purpose center at 500 Elizabeth Street, 414 Latham Street, and 702 W. Fifth Street. Staff recommended continuance due to a heavy docket. Opponent Ms. Squires preferred March but accepted April. The board voted to cancel the regular March 23 and April 27 meetings and hold a special meeting on April 20, 2023, exclusively for this case. The continuance was granted.

Item 3: KLA Holdings Administrative Appeal

KLA Holdings appealed a notice of violation for three ordinance violations after recombining 42 lots into one parcel at 1300 Allen Ridge Road. The appellant argued no physical change, no subdivision, and no permit applications; the city argued conversion to multifamily use required site plan and subdivision approval. After deliberation, the board found an error in the application of Section 9-4-10 (only one principal use on a lot) but upheld violations of Section 9-4-142 (failure to submit development plan) and Section 9-5-6 (lots created contrary to subdivision regulations). A motion to modify the decision by removing the 9-4-10 violation and affirming the other two carried on a 6-1 vote. The board will prepare a written decision by the April 20 special meeting.

Item 4: Cannon Administrative Appeal – Withdrawal

Edwin Keith and Ashley-Nicole Cannon requested to withdraw their appeal of a notice of violation for sign ordinance infractions at 2306 Charles Boulevard. The board approved the withdrawal unanimously.

Item 5: Crystal Smith Special Use Permit – Child Daycare (Drop-in Care)

The applicant sought a special use permit to operate a drop-in daycare at 618 East Arlington Boulevard. Staff noted compliance with the Future Land Use Plan and recommended approval with conditions: all activities indoors, compliance with NC General Statutes on child care, and a change of occupancy permit. The board approved the permit unanimously with those conditions.

Item 6: Greenville Preparatory Academy Special Use Permit – Continuance

The applicant, Greenville Preparatory Academy, did not appear. The board continued the matter to the April 20, 2023 special meeting without objection.

Key Outcomes

  • Rizzuti Item: Continued to April 20, 2023 special meeting. Regular March and April meetings cancelled.
  • KLA Holdings: Appeal granted in part; violation 9-4-10 reversed, violations 9-4-142 and 9-5-6 affirmed. Written decision to be presented at April 20 meeting.
  • Cannon Appeal: Withdrawn.
  • Crystal Smith: Special use permit approved with conditions.
  • Greenville Prep Academy: Continued to April 20, 2023.
  • Procedural Votes: Board affirmed proper notice, ordinances in effect, and officer authority for all items.
