Summary of Proceedings

Hampton Planning Commission Meeting - December 15, 2022

The Hampton Planning Commission met on December 15, 2022, to consider several rezoning and use permit applications, hear public comments, and receive a youth planner report. Key actions included deferring two applications to January 2023 and approving two use permits with conditions.

Consent Calendar

  • Approval of minutes from the previous planning commission meeting: Motion carried with all members voting aye except Dr. Coleman, who abstained.

Public Comments & Testimony

Item 22-13 (Restaurant Use Permit): No public speakers were signed up. The applicant was present for questions.

Item 22-20 (Mental Health/Substance Abuse Treatment Facility): Four individuals spoke:

  • Ryan Dudley, Crisis Director for the Hampton Newport News Community Services Board (applicant): available for questions.
  • Carl Gaborick, representing Sentara (property owner): expressed support for the application.
  • Ron Clark, Clinical Administrator with the CSB: available for questions.
  • Raymond Tripp, Executive Director of Coliseum Central Business Improvement District: expressed support for the use but concern about the location. He proposed additional conditions including license plate reader cameras, connection to HPD real-time crime center, restrictions on signage content, and use of contract security with criminal justice certification rather than HPD resources. He noted the board was not given adequate opportunity to discuss the location prior to the zoning change.

Discussion Items

Item 22-8 and 22-1 (Rezoning and Use Permit for Lincoln Park Site): Staff presented a request for deferral to the January 19, 2023 meeting, supported by the applicant. The application proposed to rezone 16 properties totaling 22.78± acres from multiple residential RM district to downtown business DT1 district with conditions, permitting approximately 380 multifamily dwelling units, 118 townhome units, and 6,000 square feet of light commercial uses. The commission voted unanimously to defer both applications.

Item 22-13 (Use Permit 22-13 – Restaurant Extended Hours): City planner Davis Pemberton presented the staff report for a use permit to allow extended hours of operation and outdoor dining at 4111 West Mercury Blvd. The property is zoned C2 district. Staff recommended approval with 16 conditions. The proposed outdoor dining area is approximately 75 square feet. Commissioner Brown expressed concern about potential noise from outdoor dining due to proximity to single-family homes (70 feet from the rear yard). Chair and others noted the city's noise ordinance and the importance of supporting businesses. The applicant proposed outdoor dining hours until 12 a.m. on weekends and 5 a.m. to midnight on Sunday. After discussion, Commissioner Brown moved to amend condition 7 to align outdoor dining hours with indoor hours. The motion was seconded and approved unanimously (7-0).

Item 22-20 (Use Permit 22-20 – Mental Health/Substance Abuse Treatment Facility): Chief Planner Donald Whipple presented. The facility, located at 300 Marcello Road, would be a 24/7 operation within a repurposed 20,000+ sq ft building. It includes 16 single occupancy rooms for 3-7 day stays and a 23-hour observation room with 6 recliners. It would serve individuals under emergency custody orders and walk-in voluntary patients. The site is adjacent to single-family homes with a vegetative buffer. The Hampton Community Plan recommends mixed use; staff found the proposal consistent. Staff recommended approval with 11 conditions, revised after the published packet. Commissioner Garrison raised privacy concerns (HIPAA) regarding proposed license plate readers. City attorney advised that several conditions proposed by the Coliseum Central BID (license plate reader, real-time crime center connection, signage content restrictions) lack legal nexus or raise First Amendment issues. Commissioner Coleman noted the site is a centrally located vacant asset. The commission approved the use permit with revised conditions 6-0-1 (Commissioner Brown abstained).

Key Outcomes

  • Item 22-8 (Rezoning) and 22-1 (Use Permit): Deferred to January 19, 2023 meeting. Unanimous vote.
  • Item 22-13 (Use Permit 22-13): Approved with 16 conditions, including amendment to condition 7 to align outdoor dining hours with indoor hours. Vote: 7-0.
  • Item 22-20 (Use Permit 22-20): Approved with revised 11 conditions. Vote: 6-0-1 (Brown abstained).
  • Youth Planner Report: Presented by Kira Reed, covering Youth Voice committee activities, grants applications (including YMCA Youth and Government, YMCA Leaders Club, Hampton High School GSA), and upcoming events including a "Let It Glow" holiday social on December 19, 2022. The meeting concluded with holiday well-wishes.
