Don't forget your mic.

Speaker 4

6:48

I got it.

6:49

Okay.

6:49

Thanks for the reminder, though.

6:50

Yeah, if Mark out.

6:52

I'll try my best.

6:54

With Mark out, I'll take the lead on this.

6:57

Really, uh, what this uh is being brought.

7:00

It's a uh a potential revenue source for the city of Hastings.

7:04

Uh it was asked for by council during the budget process to look at those additional uh revenue sources that we do have available to us to help uh cover uh some of the ongoing city expenses.

7:16

Uh so it's being brought today for discussion of council.

7:19

Really, I guess, uh at least from my perspective, the two things that we're looking for from a staff perspective is uh one is council just generally interested in pursuing a restaurant tax.

7:30

What are your thoughts, concerns with that at a high level?

7:34

And then if uh council is uh interested in that, uh we'd also be interested to kind of understand what uh what percentage uh they would uh like to see uh on a potential uh uh excuse me uh uh potential ordinance going forward.

7:50

So that's really kind of what we're looking for.

7:51

And with that, I'll open up to discuss uh for discussion of council.

7:54

I do have uh thank you for putting that up.

7:57

Uh this is was present uh handed out to council, I believe uh Mark sent this out to council last sometime last week.

8:04

Uh and so this is uh some figures as to you can see based on a percentage, uh, what that equate to for a uh total uh revenue to the city based on previous years uh sales, and then also has some uh other cities uh and what they collect and or what their percentages are uh to for kind of a uh diving off point, I suppose as

Unassigned speaker

8:29

well.

Unassigned speaker

8:31

So

Speaker 4

8:31

with that, I'll turn it back over

Speaker 2

8:36

discussion from council.

8:38

Maybe we should start.

8:39

Are we even interested in a restaurant tax?

8:42

We'll start with that question, maybe.

Speaker 5

8:44

Uh Jesse, can you remind me?

Summary of Proceedings

Hastings City Council Worksession: Restaurant Tax and E-Scooter Ordinance Discussions - October 20, 2025

The Hastings City Council held a worksession on October 20, 2025, at the Hastings Municipal Airport, beginning at 5:30 PM and adjourning at 7:03 PM. The meeting focused on two discussion items: a proposed restaurant tax and an ordinance regulating lightweight e-scooters, e-bikes, and hoverboards on public property.

Consent Calendar

  • The agenda for the October 20, 2025 worksession was adopted unanimously via roll call vote.

Public Comments & Testimony

  • No members of the public spoke during citizen communications.

Discussion Items

  • Restaurant Tax: City Attorney Jesse Oswald presented the restaurant tax as a potential revenue source to address the city's $2 million annual general fund shortfall. A table showed estimated revenue by percentage (e.g., 1% would generate approximately $500,000 annually). Council members expressed varied positions: Some supported the tax as a luxury tax on those who can afford to eat out and a way to capture revenue from non-residents (over 60% of patrons at some establishments are from outside Hastings). Others opposed it as an additional burden on Hastings families. After debate, the consensus was to pursue a 1% restaurant tax. Staff was directed to clarify which businesses and venues would be subject (e.g., cafeterias, school concessions, museum, water park) and to bring the ordinance back for consideration in November.
  • E-Scooter, E-Bike, and Hoverboard Ordinance: Oswald reviewed proposed changes to the city code, including defining a business district where these vehicles are prohibited, restricting operation on roads with speed limits over 25 mph, allowing use on trails unless signed otherwise (max 25 mph), and requiring groups of three or more to ride single file. Council discussed the need for lights when operating after dark, ultimately favoring a requirement for front and rear lights. Several members suggested reducing the trail speed limit from 25 mph to 15 mph for safety. The police department vetted the ordinance. No helmet requirement was included due to enforcement challenges; instead, an education component through schools was emphasized. Mayor Beckby requested the ordinance be placed on the next council meeting agenda for a vote.

Key Outcomes

  • Restaurant Tax: Council reached consensus to move forward with a 1% restaurant tax. Staff will research definitions of taxable entities (e.g., cafeteria, concessions, vending) and present the ordinance for a vote in November. Councilmember Hoffman requested an annual review of the percentage.
  • E-Scooter/E-Bike/Hoverboard Ordinance: Council directed staff to incorporate amendments including a front and rear light requirement for nighttime operation and a 15 mph speed limit on trails. The final ordinance will be presented at the next regular council meeting for approval. An education campaign led by the Public Information Manager and police department will accompany the new regulations.
