  • A motion was made by Commissioner Wostal, seconded by Commissioner Cohen, to approve the Consent Agenda. The motion carried 7-0. Items approved include:
    • B.1 (RZ-PD 26-0437): Rezone of 13.79 acres on E 92 Hwy from AI & AR to PD, subject to conditions.
    • B.2 (MM 26-0556): Major modification to PD on 8.66 acres at 6605 E Hillsborough Ave.

Public Comments & Testimony

  • On Regular Agenda item F.1 (MM 23-0132, GL Acquisitions Corporation/Pebble Creek Golf Course), three members of the public testified in opposition. Emma Zemborski, a resident within 500 feet of the property, argued that additional ex parte communications beyond the one cited in the remand violated due process. Leslie Green, an adjacent property owner, contended that the limited remand did not cure the unfair advantage created by ex parte communications. David Winker, representing Save Pebble Creek, argued that the ex parte communications were pervasive and that the remand was based on a false premise of a single, one-way communication when records showed multiple emails. All requested the board deny the application or require a reapplication. Applicant Jay Kramer rebutted that the record was clean and the board had properly followed the law. The planning commission and zoning hearing master had recommended approval.

Discussion Items

  • Item F.2 (RZ-PD 26-0558, TC Florida Development) : Application to rezone 9.777 acres at 11102 N 301 Hwy & 11404 Walker Rd from AR and PD to PD, to allow 150,000 square feet of manufacturing/warehouse/distribution. Staff, Planning Commission, and the Zoning Hearing Master recommended denial due to compatibility concerns with adjacent residential, inadequate setbacks, and noise. The applicant (Tyler Hudson and Mark Reeker of Trammell Crow Company) presented mitigation measures: enhanced screening (14-foot live oaks, CMU wall), prohibition of heavy industrial, noise limited to 55 decibels from 11pm-5am (residential standard), and no loading on the north side. Commissioner Wostal expressed concern about 5am-11pm hours. The applicant agreed to revise hours to 10pm-6pm and to prohibit manufacturing. A motion was made by Commissioner Cohen, seconded by Commissioner Wostal, to approve with those revised conditions. The motion carried 7-0.

  • Item F.3 (RZ-STD 26-0811, Robert & Tamara Cribben) : Application to rezone 6.489 acres at 19135 N Dale Mabry Hwy from Asc-1 to CN(R), with restrictions against car washes, automotive repair, and freestanding emergency rooms. Staff, Planning Commission, and the Zoning Hearing Master recommended denial due to inconsistency with the Dale Mabry overlay (which directs commercial to activity centers) and the Lutz community plan. The applicant (Tamara Cribben, an abutting property owner) argued that the area is surrounded by commercial uses and that no opposition was received. She requested to add a restriction against strip mall development. Commissioner Wostal noted the overlay district was outdated. Commissioner Miller moved for approval, seconded by Commissioner Wostal. The motion carried 7-0 with the added restriction prohibiting a strip mall.

Key Outcomes

  • Item F.1 (MM 23-0132, GL Acquisitions Corporation) : The board voted 5-2 to approve the major modification of the planned development, with Commissioners Hagan and Miller opposing. The project had been through litigation, including a circuit court order overturning a prior denial and a limited remand for ex parte communications. The board's decision followed the recommendation of the county attorney to ensure compliance with the court's order.
  • Items E.1, C.1, C.2, C.3 : All approved unanimously 7-0.
  • Staff Reports : Status reports on Live Local Act development projects and Agricultural Enclave projects were accepted by the board, with the next updates due at the October 13, 2026, BOCC Land Use meeting. Commissioner Wostal noted that a potential Yigby application (Live Local Act workaround) was anticipated in October.
  • Commissioner Hagan requested a brief public update on the status of the county's lawsuit regarding the Live Local Act at the next board meeting.
