The Planning and Development Board of Hollywood, Florida, met on Tuesday, October 14, 2025, at 6:00 PM in Room 219 of City Hall. The board considered one quasi-judicial item: a request to amend a condition of a previously approved site plan for a Taco Bell drive-through at 2640 North State Road 7. The board also received updates on recent City Commission actions and reviewed the 2026-2027 board calendar.

- Old Business – File No. 23-DP-06b (Taco Bell Condition Amendment): The applicant, Taco Bell of America/Gator 441, Inc., requested an amendment to Condition 3 of the previously approved variance and site plan. The original condition required a covenant running with the land to hold the city harmless from claims related to parking, traffic, or disputes with neighbors. Through discussions with staff, it was determined that this perpetual obligation was inappropriate beyond Taco Bell's tenancy. The amendment narrows the hold-harmless requirement to apply only while Taco Bell owns or leases the property; if Taco Bell leaves, the variance automatically terminates, and any future tenant must seek new approvals. Staff recommended approval. Applicant representative Dwayne Dickerson (of 14 Southeast 4th Street, Boca Raton) confirmed the lease is typically 10 years with two 5-year options and that the store will be corporate-owned. Board members questioned the scope of changes and the relationship between the hold-harmless and the variance. The board voted unanimously to approve the amendment as recommended.
- New Business – City Commission Actions: Staff reported that two projects previously reviewed by this board were approved by the City Commission: the Hillcrest project (planned development ordinance change and site plan) and the Bryan House project (rezoning to PD, master plan, and historic elements). For Hillcrest, the City Commission chose the original design over the alternative recommended by this board.
- New Business – 2026-2027 Board Calendar: Staff presented the draft calendar, noting that the November 10 meeting will remain as scheduled despite the Veterans Day holiday the next day. Board members confirmed they expected a quorum. The calendar will be emailed to members for review.

Florida courts have determined that there are certain types of matters, including the one item on our agenda this evening, which are to be treated differently than other issues considered by the board. Many decisions of the board are legislative in nature, which means that the board is acting as a policy making body. In addition, the decision of the board must be supported by competent and substantial evidence presented at the hearing. However, here in Hollywood, we have adopted a rule allowing for a waiver of the quasi-judicial formalities. This waiver can only occur if agreed to by staff, the applicant, and any member of the public who is present. So, Mr. Chair, if you would inquire when per time's right. Thank you. Thank you much.
