Um and Chair, before the board takes any action on the item on the agenda today, staff would like to make a request and that the item it to provide a little background.

This item was properly noticed under state law, and the notice was posted in the newspaper as required.

In reviewing the file, however, staff identified that the item was not physically posted on the city's sunshine board.

While posted on the virtual board, it was not posted on the physical board outside the city clerk's office in compliance with our code of ordinances.

Staff therefore request that the board open the item to allow staff open the item and allow for a continuation of the item at staff's request time and date certain to a date that we will share that we will post on the screen and you all can deliberate on availability.

So this item wasn't posted on the city's sunshine board as our local code requires.

And as Cameron noticed, that is a curable notice issue, and staff does intend to cure it before the continued hearing.

Um but we've decided after some deliberation, um, because the notice for tonight is incomplete, the cleaner course is to continue on that basis and present the item in full at the continued hearing when the notice is complete and the whole record, which includes the presentation, public comment, and the board's deliberation, is built at one time rather than piecemeal.

Um it is our opinion that taking a substantive presentation tonight at a hearing that we already know we're going to continue for a notice cure, does not advance the item and couldn't write a question later about why the merits were aired at a hearing that wasn't fully noticed.
