Speaker 1

10:36

Thank you all.

10:37

We are

Speaker 2

10:38

uh resuming our city commission meeting today, October 7, and it is a little bit past uh 923 p.m.

10:43

Uh we have two items left on our uh agenda besides any comments by the city commission city attorney and city manager afterwards.

10:51

Uh but for now we have items 29 and 30.

10:55

Uh item thirty is a quasi-judicial item, but item twenty-nine is not.

11:00

Item twenty-nine is a resolution of the city commission city of Hollywood approving and authorizing the appropriate city officials to execute the amended and restated comprehensive agreement, an amended and restated ground lease agreement for the development of public and private facilities at 1301 South Ocean Drive between the City of Hollywood and PRH 1301 South Ocean Drive LLC, authorizing the city manager and city attorney to take all actions necessary and proper to effectuate this resolution providing for conflict severality and an effective date.

11:29

This of course came through our effort through the Office of Communications Marketing and Economic Development some many years ago.

11:38

Um as to this particular item, uh commission will note that there is uh an updated um corrected um package on our uh dais here for item 29 that uh inserts some additional uh language and I'm sure staff will go through that a little bit uh as they update things.

11:58

And Pat is distributing an additional document.

12:01

Let's go ahead and wait for

Unassigned speaker

12:02

that.

Speaker 3

12:07

Mayor, the item uh that was distributed is the amended and restated ground lease agreement uh with some adjustments since the uh agenda was published.

12:19

Uh Lisa Leota is going to take you all through those.

12:23

Uh our our development officer in CMED.

12:27

Um and uh what is being handed out is uh a few uh additional uh adjustments to the comprehensive agreement.

Speaker 2

12:38

Okay.

Unassigned speaker

12:38

All right,

Speaker 3

12:38

well you'll go also take you through those.

Speaker 2

12:41

So please, City Manager, go ahead and continue um and uh and into uh the staff presentation on the resolution.

Speaker 3

12:47

Absolutely.

12:48

So as uh the commission uh will recall uh in March of 2022, you all approved a comprehensive agreement um with PRH 1301.

13:01

Um an affiliate of the related group.

13:05

Um and you also as part of that approved an exhibit that was a ground lease, um, and this was for the development uh related to a public-private partnership at 1301 South Ocean Drive, inclusive of a uh private uh condominium development, a uh a a new park area, a additional public parking, and a new community center uh to replace the existing community center.

13:37

Uh in May uh of this year, you um adopted a amendment, the first amendment to the comprehensive agreement that added in additional uh workforce units utilizing the Live Local Act, and uh tonight you are uh and at that time we let you know uh that we would be bringing back a comprehensive agreement update, a ground lease update uh to uh coordinate all of the First Amendment changes and the new uh uh baseline design uh into the final agreements.

14:16

And so that is what is before you tonight with item 29.

14:20

And with that, I'm going to turn it over to Lisa Leota, who has a presentation for you detailing the adjustments.

14:27

We also have Steve Zelkowitz, he is our outside counsel that has been advising staff on this.

Lisa Leota · Speaker 4Inferred

14:46

Thank you.

Speaker 5

14:49

Okay.

Lisa Leota · Speaker 4Inferred

14:51

For the record, my name is Lisa Leota, I'm the development officer for the City of Hollywood.

Unassigned speaker

15:00

I'm here before you today to present the amended and restated comprehensive agreement and amended and restated grounds lease agreement between the City of Hollywood and PRH 1301 South Ocean Drive LLC.

Lisa Leota · Speaker 4Inferred

15:12

As our city manager mentioned, there was an edited version of the document submitted to you today.

15:23

And before going into the presentation, I'm going to briefly outline what was included in that edited document.

15:31

That's the grounds lease.

15:33

So the new grounds lease that you received today adds the sculpture park access easement, changes ownership

15:42

the sculpture park from landlord to tenant, adds detailed requirements for the sculpture park access easement, including recording public access priority over leasehold mortgages and the inclusion in the condominium declaration.

16:01

It adds the landlord is not required to pay the tenant, the landlord being the city, the tenant being the developer, or the condominium association a share of costs associated with operating and the maintenance of the additional 79 parking spaces in the garage.

16:18

It excludes the city spaces, which are the 79 spaces, sculpture park, and public facilities from the category of project areas for which users must pay the condominium association a share of maintenance expenses.

16:32

I'm sorry for being redundant, and it replaces the three-year professional liability insurance extension with an obligation to continue that insurance extension for seven years.

16:54

And it replaces the generic bid proposal insurance language with lease specific requirements.

17:02

So and that is the language at the very end of the insurance requirements.

17:07

We made them more specific to the lease.

17:24

Just now.065.

17:44

Following the receipt of that proposal on June 23rd, 2020, the city published a public notice of its intent to receive, review, and evaluate competing proposals for the same project purpose.

17:57

On September 28, 2020, the developer enhanced its proposal and submitted a timely response to the solicitation.

18:06

Then on February 18th, 2021, the city selection committee completed its evaluation and determined that the developer's proposal best met the objective outlined in the notice.

18:16

The committee therefore recommended that the developer be designated as the winning proposer.

18:26

Continuing the project history on March 17th, the City Commission, March 17th, 2021.

18:31

The City Commission accepted the recommendation and directed the city staff to negotiate a comprehensive agreement, including a grounds lease.

18:40

On May 5th, 2022, the City

Lisa Leota · Speaker 4Inferred

18:43

Hollywood and PRH 1301 South Ocean Drive LLC entered into a comprehensive development agreement.

18:50

Just recently, on May 20th, 2026, the City Commission approved and adopted the first amendment to the agreement.

18:58

Among the changes included in that amendment was an increase in the number of residential units permitted from 190 units to 210 units, inclusive of 84 live local affordable rental apartments.

amended and restated comprehensive agreement.

19:32

This terminology more accurately accurately reflects the agreement and its purpose.

The initial term sheet has been removed because it is no longer accurate or relevant to the current agreement.

Summary of Proceedings

Hollywood City Commission Meeting - October 7, 2026: 1301 Ocean Drive Approvals and Consent Agenda

The Hollywood City Commission met at City Hall on Wednesday, October 7, 2026, beginning at 1:00 PM. The available transcript resumes at 9:23 PM and runs past 4:00 AM on October 8, so the recorded portion focuses on the last two agenda items. The Commission approved the amended and restated 1301 South Ocean Drive comprehensive/ground lease agreements by a 5-2 vote and approved the related Live Local Act GU zoning parameters by a 6-1 vote.

Consent Calendar

  • Agenda items 5-16 were listed as routine consent resolutions; the available transcript does not include the consent vote. Listed items included: R-2026-314 (HUD HOME Tenant-Based Rental Assistance subrecipients, up to $424,003.13), R-2026-315/316/317 (Cigna medical/pharmacy, stop-loss, and VSP vision contracts), R-2026-318 (Broward County Transportation Surtax application), R-2026-319 (Stryker ambulance stretchers, $257,784.40), R-2026-320 (R2 Unified Technologies IT consulting, $257,194.20), R-2026-321 (Playworx playground equipment, $314,844.32), R-2026-322 (Stantec third renewal, $400,000), R-2026-323 (Brown and Caldwell deep injection wells construction administration, $382,040), R-2026-324 (Cardinal Contractors 120-day time extension), and R-2026-325 (Hazen and Sawyer in-house support, up to $500,000).

Public Comments & Testimony

  • All public speakers in the recorded portion opposed or raised concerns about the 1301 project. Summit residents William Knickerbocker and Carlos Barkin warned of construction damage, flood risk, and the Summit being left in a 'valley' between raised podiums; Knickerbocker requested a $10 million construction bond, and Barkin asked for flood barriers.
  • Residents and community speakers including Adam Roberti, Rachel Schoenfeld, Kat Uden, Sylvia Meyer, Justin Del Sesto, Paul Farron, Carol Torres, and others said city-owned beachfront land should not be leased for a 99-year private condominium tower. Concerns included sea-level rise, loss of open space, a smaller community center, income segregation, emergency access, and the Planning and Development Board's one-story recommendation.
  • Ryan Abrams, attorney for Keep Public Lands Public, Inc. and Kathleen DeBona, argued the property is listed as a community park in the city comprehensive plan, that city code prohibits exclusive use of parks, that the project violates the Live Local Act open-space exemption, and that the prior 2022 agreement was so changed it required a referendum. The City Attorney allowed the group to present evidence and cross-examine for this hearing only, without making them party intervenors.

Discussion Items

Item 29 - Amended 1301 South Ocean Drive Agreements

  • Staff and outside counsel presented an amended and restated comprehensive agreement and ground lease with PRH 1301 South Ocean Drive LLC. Key changes included: an increase from 190 to 210 residential units including 84 Live Local Act rental apartments; a $22 million cap for public facilities; a $300,000 per year pre-possession rent starting 12 months after the effective date; an extended 36-month long-stop commencement date; 79 city-controlled parking spaces in the private garage in addition to replacement public surface parking; separate processing for Harry Berry Park renovation under the Land and Water Conservation Fund; and a minimum guaranteed payment increase from $35 million to $45 million.
  • Financial staff projected the city would receive $9.03 million net initial rent, $297,500/year base rent, 14% of condo sale proceeds as closing rent, 1% of resale value fees, property taxes after certificates of occupancy, and impact fees. At a $1,500 per square foot sellout, staff projected $45.8 million in cash to the city after the $22 million public-facility investment and $2.3 billion in total 99-year city revenue; a proposed Amendment 3 would reduce that total by about $5.5 million over 99 years.
  • Commissioner Shoeham said she was given insufficient time to review the documents, argued the changes were a 'cardinal change' requiring a referendum, and objected to income segregation and 'poor doors.' Commissioner Quintana also said she could not support the deal because of separate pools/elevators by income and the rushed schedule. Vice Mayor Callari and Commissioners Hernandez, Gruber, and Biederman spoke in support, citing public benefits, revenue, community center, and the project's long approval history.
  • The resolution passed 5-2, with Commissioners Shoeham and Quintana opposed, subject to final city attorney review of the terms.

Item 30 - Live Local GU Height, Setbacks, and Site Coverage

  • This quasi-judicial item asked the Commission to set GU-district parameters for the proposed Live Local development at 1301 South Ocean Drive. Staff recommended approval of 375.4 feet in height, zero setbacks (with 15-foot and 9-foot encroachments along Azalea and Bougainville), and 96% site coverage. The Planning and Development Board had instead recommended 15 feet/one story, 230-foot setback from Surf Road, 100-foot setback from the Atlantic Ocean, and 15-foot cross-street setbacks.
  • City planner Cameron Palmer testified the proposal met the GU criteria for surrounding character, proposed development character, and adopted planning goals. Applicant experts described a resilient, elevated design with the community center and workforce-housing amenities facing east, stormwater management, beach access preservation, and traffic impacts of about 50 AM and 80 PM peak trips; the developer said the project replaces approximately 125 public surface spaces with 128 surface spaces plus 79 valet-served city garage spaces.
  • Keep Public Lands Public's planner, Wes Blackman, testified the tower was incompatible with the surrounding 65-foot zoning, that the 94-foot podium wall would be imposing on A1A, and that the property is a community park in the comprehensive plan. The applicant disputed the park designation and argued affordable housing is a public purpose under Florida law.
  • After final arguments and city attorney guidance on the discretionary GU standards, Commissioner Hernandez moved to approve; Commissioner Gruber seconded. The resolution carried 6-1, with Commissioner Shoeham opposed.

Other Agenda Items Referenced

  • The agenda included proclamations for National Breast Cancer Awareness Month, Fire Prevention Week (October 4-10, 2026), and Cybersecurity Awareness Month. Later discussion confirmed the Hollywood Beach Overlay District ordinance (PO-2026-026a) was adopted earlier in the meeting. The transcript does not detail the individual votes on Chapter 38 budget/procurement changes, Emerald Hills PD rezoning/site plan, flexibility-unit and TIDE hotel-room resolutions, or regular resolutions 26-28.

Key Outcomes

  • Item 29 approved 5-2.
  • Item 30 approved 6-1.
  • Vice Mayor Callari requested future information comparing Hollywood's 12 community centers with other Broward County cities; the Commission generally supported reviewing it.
  • The meeting adjourned after 4:00 AM on October 8, 2026.
