There's a recommendation of deferral from staff, yes.

And so at this point we don't know when in two weeks it will come back before commission.

I can clarify a little bit.
It's not so much the deed restrictions.
I think the opinion that came back from neighborhood services was that it did not violate deed restrictions.
The thing we want to look into more directly is the road that goes on the kind of the west area and heading up to the north.
There is an existing 60-foot wide easement that goes back to serve that back lot.

I was guessing it was Ms.
Yeager.
And we want to make sure what that does to that or whether or not that easement has been eradicated.
It is a public street, so you would still have access via that same path.
It's just because it is a little narrower.
So we're just trying to run that part of it down.
What about the deed restrictions about setback lines and number of houses and maybe y'all are checking in all of that too?
That's a planning question.

It's a subdivision of four properties.

So um I can so the applicant is proposing a private street system with 27 lot.
All the 27 lots are going to be larger than 5,000 square footage with a 20-feet builder line along the side two when the minimum is five feet per the ordinance.
So right now the plat do meet or chapter 42.
It's just a pending legal review about the overlap of the acted eatment on the proposed public street.
And we'll I'll re-verify the deed restriction response as well.

Okay, because we just changed them yesterday.
In this two weeks.
And I don't think they have even been filed yet.
If they changed them yesterday, Ms.
Mickelson, that wouldn't apply to this.

So it's setback building lines that got changed.
Um I just want to make sure that you know the right ones were recorded because there was a lot of discussion on the number of feet.
So I would like to make a um note that on the face of the plat, the advocate is showing the 55 feet builder line, but along the northern south boundary, but legal can help us do more review restriction.

Staff did receive multiple received multiple public comments in the van who are who voice a concern on multiple issues, just as proposed use, quality of life, pollution, and even the opening of media thoroughfare ranking road.

Good afternoon.
My name is Felicia Galloway Kizy, and I apologize that I did not know that I could use this to project for you guys, so I made some posters.

And I'll just hold it up.

But um I'm a resident of Heather Ridge Village, which is near where Flight Line North is wanting this 42 or whatever it is that they're trying to do.
Um I just want to make it clear that I spoke with the project manager.
His name was David Neely at MPH Rankin LLC.
And he stated to me that their intentions is a detention pond.
However, they ultimately are going to build warehouses with the opening of ranking road.
And I just kind of want to show you.
Holding them up for you.
Yes.
Yes, ma'am.
So this is ranking road, and this is our community over here.
Right here is the proposed area that they're talking about.
And this is in.
And with that, we don't we would not want ranking to go through because we already have to contend with this business and then the church right here, which is a very uh renowned pastor.
But this is the end of Rankin.
This is trucks going into our community to turn around, blocking us from giving into our community.
This is the church where we have to wait in line to exit out our community because it's a renowned church.
A lot of celebrities go there.
And this is more traffic.
These are just pictures just showing the committee that we don't want ranking to go through.
We don't need any more businesses coming that way.
We like our quality of life there, the woods.
I don't know where the animals that are there are gonna go, and it's just really nice and serene.
I just put up here residents of Heather Ridge Village deserve a quality of life too.

We're just gonna make some notes that we hope that whenever this comes, we don't know why it was deferred, but that you would be in favor of the residents because we've been here over 30 years.
We raised our children, our grandchildren, and it's really serene.
And the business that is right here, it's a recycling place.
We've had issues with them, but they've been good neighbors.
We communicate with them whenever there's a problem.
If I call them right now because this truck is blocking our entrance to get in, they go get it resolved immediately.
We just don't want any more traffic coming through there.
We just love our community, and thank you for the additional time.

When I spoke with Mr.
David Neely, I asked him if you must build, because this is what they said they're eventually gonna do.
Do you have to come through ranking?
Why can't you go through Lee Road?
And he said, Well, it's not a uh street there, maybe the city will allow us.
So if they just have to do something, that would be our preference for them to enter another way.
And plus, there's another community on the other side of Lee Road where they have been bought out, there's no homes there.
They could go there.

Of course, my name is Barbara Eaglen.
I'm also a resident of Heatherbridge Village, been there for over 25 years.
We are established uh residential area.
We have families there.
Um she says we have been serene, we have not been bothered by anything.
We do not need any more traffic of buildings that's going down ranking road.
We have been informed that we are already at flood capacity.
Any more buildings with that we're concerned with, even though we can we're hearing it's gonna be a reservoir built back there.
Uh we're concerned with what other buildings that you're gonna that the building of applicant is gonna place back there in our community.
Uh we have a lot of traffic already.
Uh we have not had any problems.
Uh we have a low crime rate back there.
Uh this is what we also concern with the the number of uh cars, uh businesses, uh traffic that's gonna be initiated.
Uh we don't need any more.
Well, we are content the way we are now.
Uh we don't need any more um businesses.
We haven't problems now.
We got warehouses back there.
She said the church traffic is getting out of control.
They also have to have police officers direct traffic now because we can't get in and out of the neighborhood as it is.
We uh we are residents of probably 250 homes.
Um we just been quiet and no problems, and we like to keep it that way.

Good afternoon.
Like to say good evening.
My name is Abel Mosley, and I'm a 40-year residence of Heather Ridge visit.
Um the business that's back there has been back there for years, color tile.
And it floods when the moment they built back there, uh they have problems uh getting in and out of that gate.
That it floods already at that particular area.
I'm opposed to opening ranking road to opposed to flight line to build back there, whatever whatever's going on.
Um even the electricity in that area.
We get one lightning flash.
The lights go out.
Our lights go out.
So uh adding other stuff back there is not gonna help our situation at all.
Uh we have a a bayou at the back of the neighborhood that's uh is a little relief, but not much.
Nothing has been done to it in years, and it's uh it won't take it, it won't take any more buildings.
And the other thing, uh sewage, when that neighborhood was built, it was built like nothing else is supposed to be built back there.
So you're gonna have to have a problem with the sewage problems, just like I I've heard that that building that colored towel started out with years ago, it has changed hands several times because they have issues over there and at that building.
So we we want to avoid having more floods than we than we need to.
We have already gone through a few, and I I oppose anything like that.
It just it's just something that that should not happen.
And uh I'm I'm asking that I I go on record that I'd be opposed to all of this.
And also the wildlife.
There's a lot of wildlife back there.
So what are we gonna do about that?
I guess we have to catch those animals and put them in our backyards.
So, but uh please take all of this in consideration when uh cities making this decision.

How are you?
I'm good.
I'm also opposed to this.
We we we really have I've been there almost 30 years.
We had two floods.
And uh like I say, I I I have grandkids now that's coming up.
Our community is quiet, no violence, no breaking cars, no anything.
Um this company here, you see how this look?
This every day.
We got to fight this every day.
They just block the street.
This truck here go all the way in our neighborhood and turn around.
The to our monument down.
And once we find out they gone, we got to pay for it.
Uh we it's so many issues.
It's it's definitely gonna cause flooding.
They out there right now digging the trench behind the house on the on the side where they're building that, where they're trying to build.
They're digging the trench right now, I guess to make room for the retention point that they that they that they're gonna have.
So all that water is gonna come right through our neighborhood.
Our taxes then went up, our flood insurance went up.
Our property taxes then went up.
When I was there, I was I was paying like two thousand.
I'm at six thousand right now, because they studied billing, and we got to pay for, you know, to keep our community safe.
We got to hire police.
And with this, when they open ranking up, then people don't even know we're back there.
The city of Houston don't even know we're back there.
They forget about us.
So like when we call when these services, they join in on the spot.
Man, we ain't y'all in y'all in uh y'all not in Harris County, y'all not in the city limit.
Yeah, we're in the city limits.
You know, we got a nice quiet community, nice quiet.
I'm trying, you wouldn't even know it's back there.
Everything else they done bought out, and they they encroaching on us more and more every day.
Our property value is gonna probably go down, you know.
Who knows?
So I think they they got plenty of room.
You got you got Lee Road.
It's they got where they dump trash and all it's plenty of room where they can go back through there or make a road or whatever.
You know, we just don't need it.
Please, we don't need it.

Good afternoon, and thank you for your time today.
My name is Marjorie Thomas.
I reside also in the Heather Ridge uh village subdivision.
Uh I'm in I've been um a resident for 20 over 25 years.
I think about my community as a oasis away from the mass of the city.
But I also look at what development did to the community of Pleasantville when it put in all those warehouses and brought the property down and brought the roads to to to ruin.
I look at Green's Road that's so horrible that you can't drive down it.
And I hate to see that happen to my neighborhood.
And all as they say, all the wildlife, there was a family of deer that used to that used to roam when we first came in there.
There are no more deers.
But they're gonna come in my house after a while when they build everything down.
And I understand that.
I have a bad habit of leaving my garage door up and my doors unlocked and my house is safe.
It's not too many people in Houston that can say that.
This is how safe my neighborhood is.
But if y'all approve these people coming in, tearing up ranking road, additional uh uh traffic coming through, additional people.
Oh, there's a new neighborhood.
Let's see if we can steal something out of it.
We don't want it.
We don't have to have it.
We're asking you all to side with us as residents that we can still maintain our community.
I understand that the city has to develop and have taxes.
But we pay taxes too.

Hello, hello everyone.
How are you doing?
Uh my name is Salisa Bowie.
I also live in the subdivision.
I'm a retired veteran, so is my husband.
We did over 20 years in the military.
We picked this area and we picked a house that we can afford.
I don't want to be a homeless vet or trying to relocate.
I want to reiterate everything that they said uh about the roads, the media.
If you walk come, you know, it gets tall if you put more traffic in there.
The types of building that go back there, I came today to see what they was putting back there, but of course we don't have any answers because of the uh deferment.
Safety and security, I feel very safe in that neighborhood.
I don't know where else I can move to in this city or surrounding area to feel as safe.
I have people that come by if a stranger looking in the neighborhood, my neighbor Joe, he probably like, hey, what are you doing in front of this house?
I mean, we have an awesome neighbor, it's like family back there.
Everyone feels safe and secure.
As for flooding, I live on that last road ranking.
Um we're flooded twice.
Thank God I had a little water come in my garage, but I wouldn't want to move at all.
And if you pull up trees and put buildings back there, when you pull up trees, everybody know where is that water gonna get absorbed to.
If you don't have tree roofs pulling up some of that water when it rain, more construction, more buildings, it's gonna flood more easily into our areas, and we're gonna be more amped to flood.
So I may be like less than a centimeter from getting flooded when you start building buildings and don't have the trees to soak up the water when there's a lot of flooding going on back there.
Um also my brother veteran, he has cancer.
He's less than five minutes away.
He has no other family but me.
So I move in that area to be close to my elderly brother to take care of him, and I have an elderly aunt.
So the location is good for family, friends, and taking care of family.
Um the flooding, I can't say enough about that.
Like I said, um, these people are beautiful, and I feel safe.
And I hope y'all take that in consideration.
And um, I'm opposed to them, you know, building villains back there at all because I don't want the flooding.

Hello, good afternoon.
My name is Donna Joubert.
I've lived in Heather Ridge Village for over 25 years.
And um, to reiterate everything they've said, I do understand when we moved when we lived there, there were no other buildings except the Color Tile Building that's directly across from where we entered, where we come and go.
Once other buildings started being built, our neighborhood started to flood.
I live on the first street, so I really get flooded.
Not my entire street, but those of us halfway in the street, we already get flooded.
So when you put up another building there that's not going to be responsible for the drainage, we're hoping that they do, but if they're not responsible for the for the drainage, then we're gonna flood even even more.
That's a big concern to me.
And it also causes the value of our property to depreciate.
So I do have a question.
Um does replatting change the restrictions of the neighborhood?
And does it include any part of our neighborhood?
And then my my other question is will that street still be used for residential use So Ms.
Rodriguez may have to help me, but the first question they're not affecting your property by their replat.
They can't replat your property.
Only you can reply.
So we will sh we will share Rankin Road?
Yes.

And um So the will any part of the residents will any part of our neighborhood be utilized for for this new business?
It shouldn't be.

And what will the infrastructure be for the grid?
Because our lights go out when the whenever the the wind blows.
Right.
Unfortunately, went out this week.
That's a center point uh question.
Yeah, I I was gonna say it's uh it is a center point question versus the city question.
Um if you Google Center Point Energy service area map, it will and you can put your address when that site comes up, you can put your address in, and it'll tell you the center point contacts for your area.

Um I first moved in, it was an older, you know, older families living there, and now I've seen new families move in with kids, you know, and they want to run around in the street and bikes and stuff like that.
And it it is a really good community to to raise families, and I just would really, really be opposed to ranking being opened up because I wouldn't feel safe anymore.
It's it's good to know that I'm driving into a safe zone, and if that street is to open up, I wouldn't feel as safe.
And I just would not want that for my community.
Um just to say that uh I just really hope that this doesn't come to a version because I mean as it is when the gas station moved in with the truck stop, that wasn't a concern, and now this, and it's just not something that I want to see happen in the place where I've called home for the past 20 years.

We have taken great care of designing this for a client who has built four once before.
