Okay, good evening, everyone, and welcome to the zoning board of appeals of the town of Huntington for the meeting of January 15th, 2026.

0:08

Please rise for the Pledge of Allegiance to our flag.

0:14

The United States of America.

0:18

One nation under God.

0:23

Please be seated.

0:44

Okay, the first order of business tonight is to welcome back Al White.

0:51

Our member for several years now, and he has been uh out because of a health reason and had heart surgery, and he's doing great now.

1:06

And uh we're really really pleased to have Al back with us, and he promised me that he's gonna be able to make all the rest of the meetings.

1:14

So we're really happy about that.

1:16

So welcome back, Al.

1:19

Um, are all the appropriate postings and publications done to give us jurisdiction for the hearings tonight?

1:26

All right, so the order for the hearings tonight will be as follows.

1:32

23596, which is 41 Landing Road, has been withdrawn.

1:37

If anyone is here for that particular application, uh it's been withdrawn from our calendar.

1:43

Uh 23597 is 5 Shaker Ridge Lane in East Northport, and that's being adjourned to March the 5th, 2026.

1:54

The rest of the uh calendar tonight will be in the following order 23598, which is 20 Grace Park Drive in Comac 23602, 12 Seaside Court in Northport, 23595, 89 Lone Oak Drive in Center Port, 2347, which is I think that's 149 Depot Road.

2:23

That's on the corner on 9th Street and Huntington Station.

2:26

Uh 23607 and 23634 will be heard in that order, but they're they're both in the same shopping center in the Elwood Shopping Center on Jericho Turnpike.

2:49

So, would the applicant or the representative of the applicant for 23598 20 Grace Park Drive, please address the board?

3:01

Good evening, town board.

3:02

How are you?

3:03

Good, awesome.

3:05

My name is James Cresse.

3:06

I reside at 20 Grace Park Drive in Colmack.

3:09

We're seeking relief on two issues on our property.

3:12

Um in 2022, Dunwright pools installed an in-ground pool in our uh backyard following installation and the final survey.

3:22

It was determined that the pool company based their installation and measurements on the location of the fence, not a survey.

3:31

And there were several deficiencies because of this, which were subsequently uh identified.

3:36

These include the pool equipment being too close to the property line, code requires five feet, the equipment is four feet, roughly.

3:44

Uh the closest corner of the pool should be greater than five feet, it's three and a half.

3:49

And uh our neighbor's PVC fence was not on the property line.

3:54

Uh it was installed um less than a foot into their own property when they did it years ago.

3:59

Um so I installed I had uh fence installed uh right on the property line.

4:04

Um in addition, uh we're seeking relief from our existing sunroom, which was installed prior to us purchasing the house in 2005, and um the existing sunroom is 5.2 feet from the property line uh where code requires seven feet.

4:22

Right.

4:22

So they so the basically your application is for uh a variance where the requirement is seven feet and you have five point two feet, and the other variance on the requirement is five feet and you have four point two feet.

4:37

Is there anyone in the audience that wishes to be heard regarding this application?

4:42

Observing that no one wishes to be heard.

4:44

I'll entertain a motion to grant the application.

4:46

I'll make that motion.

4:47

Ms.

4:47

Whalen on the motion, second Mr.

4:49

Castaño on the second.

4:50

All in favor, any opposed?

4:53

Your application is granted.

4:54

Good luck.

Huntington Zoning Board of Appeals Meeting - January 15, 2026

The Huntington Zoning Board of Appeals met on January 15, 2026, to consider several variance applications, including residential additions, a mixed-use redevelopment, and new commercial tenants in the Elwood Shopping Center. The meeting began with a welcome back to board member Al White after heart surgery. Two items were withdrawn or adjourned, and three accessory dwelling unit approvals were handled under other business. All applications on the agenda were granted, with public comment heard from one resident.

Public Comments & Testimony

  • Robert Lamonte, a frequent visitor to the Elwood Shopping Center, expressed concerns about traffic safety at the intersection of Jericho Turnpike and Elwood Road. He noted that the exit from the shopping center onto Jericho Turnpike involves crossing multiple lanes and a median, and that drivers often speed. He questioned whether signage was adequate to prevent left turns and whether the additional traffic from the proposed uses would exacerbate the situation.

Discussion Items

  • Application 23598 – 20 Grace Park Drive, Commack (James Cressy): Applicant requested side yard relief (required 7 ft, existing 5.2 ft for a sunroom) and yard modification for pool equipment (required 5 ft, existing 4 ft). The pool was installed incorrectly based on a fence line. No public opposition. The board noted the minimal encroachments and granted the application.
  • Application 23602 – 12 Seaside Court, Northport (Osmar Martinez Suarez, architect for owners): Requested front yard relief on a corner lot for a 303 sq ft addition (required 30 ft front yard, proposed 24.84 ft). The property overlooks Crab Meadow Golf Course. No public opposition. Board granted the application.
  • Application 23595 – 89 Lone Oak Drive, Centerport (Michael Arato, Captain Permit): Requested side yard and modification relief to legalize an existing deck (setbacks of 1.4 ft and 1 ft vs. required 5 ft). The deck existed since 2002; the neighbor at 93 Lone Oak Drive submitted a letter of no objection. The board noted heavy foliage between properties and granted the application.
  • Application 23477 – 149 Depot Road, Huntington Station (Attorney Thomas Abbate for Michael Grigoraki): Requested depth extension, multiple buildings, buffer, and parking relief to renovate two existing structures into mixed-use buildings with two apartments and commercial space. The same variances were granted in 2015 but never perfected. The applicant sought removal of a prior condition limiting commercial uses to "dry uses" to allow food shops (e.g., bagel store, coffee shop). Traffic consultant Wayne Muller and a real estate expert were available but not called. Planning board concerns about a parking stall conflict were deferred to site plan approval. The board granted the application with a negative declaration under SEQRA.
  • Application 23607 – Elwood Shopping Center (Pilar coffee bar, Attorney Michael McCarthy): Requested a variance to allow a restaurant use (luxury coffee bar/gelato) that would increase the percentage of restaurant space in the shopping center from 10% to 14.88%. Traffic consultant Wayne Muller testified that a comprehensive traffic impact analysis showed ample parking and no negative effect. The board noted similar variances granted at other centers. Granted.
  • Application 23634 – Elwood Shopping Center (Little Lux Playhouse, Attorney Tara Visconti): Requested a special use permit for a children's recreation center, a parking variance (412 spaces exist vs. 444 required), and continuation of outdoor storage containers (belonging to other tenants). The playhouse is reservation-only, with fixed sessions and adult supervision. Traffic analysis showed de minimis impact. The board granted the application.

Key Outcomes

  • Application 23598 granted unanimously on motion by Ms. Whalen, seconded by Mr. Castagna.
  • Application 23602 granted unanimously on motion by Mr. Basso, seconded by Mr. White.
  • Application 23595 granted unanimously on motion by Mr. Castagna, seconded by Mr. McGrath.
  • Application 23477 granted unanimously on omnibus motion (negative declaration and variance) by Mr. McGrath, seconded by Ms. Whalen. The condition limiting commercial uses to dry uses was removed.
  • Application 23607 granted unanimously on motion by Mr. Castagna, seconded by Mr. Basso.
  • Application 23634 granted unanimously on motion by Mr. Cappadano, seconded by Ms. Whalen.
  • Other Business: Three accessory dwelling unit applications (ADU 1419 at 31 Oakledge Dr., ADU 1725 at 10 Colony Ct., ADU 1810 at 28 Cherry St.) were approved as no variances were required, subject to Suffolk County Department of Health Services review.
  • The meeting was adjourned to January 22, 2026.
