Other Business Before the Board
Amendment of Prior Decision – ZBA 23445 (Abraham property)
- Background: The Board had previously granted relief for accessory structures (shed, chicken coop, carport, cabana, and pergola) but the written decision inadvertently omitted the pergola. The applicant sought an amendment to include the pergola.
- Board Discussion: The parcel is 2.47 acres (R-40 zone, one-acre minimum). The Board agreed the omission was inadvertent and saw no issue.
- Outcome: The Board voted to amend the decision to include the pergola.
Accessory Apartment Recommendations
- Three ADU applications were reviewed by the Accessory Apartment Officer:
- ADU 1931 – 9 Alma Lane, East Northport
- ADU 1809 – 509 Eighth Avenue, East Northport
- ADU 1959 – 883 Park Avenue, Huntington
- Board Action: The Board determined that no variance relief is needed (no square footage or dimensional issues, not in saturated areas). They authorized sending the standard letter to the Building Department for normal processing, including referral to Suffolk County Department of Health Services.

Good evening, everyone, and welcome to the zoning board of appeals of the town of Huntington for the meeting of February the 12th, Lincoln's birthday, 2026. Please rise for the pledge to the flag. I pledge allegiance to the flag, United States of America. And to the Republic for which it stands. One nation. Please be seated. First order of business tonight is to welcome our new member, Clem Cote, who's at the end of the bench here on my left, your right. And uh we're very happy to welcome Clem to the zoning board of appeals. Uh he is a real real estate professional. He has a lot of experience and background in in real estate and in planning and in all kinds of good real estate search circum circumstances, and he has and he's a very experienced professional. So we're really and he's and he was an alternate on the planning board, so he's been serving as a uh person in the town of Huntington and the uh uh as an alternate for the planning board for a couple of years now, and uh we're very pleased to have him as a new member of the zoning board of appeals. So welcome Clem Cotte. Yeah. The second order of business will be that we have minutes for February the 5th, 2026. I've taken a look at them, made a small correction, and uh they have been presented to everybody, and if no one has any corrections, deletions or additions to make, I'll uh entertain a motion to accept the minutes. So the first hearing for tonight will be 23631, that is one Earl Road. The second one will be 23620, 6 Argyle Drive out in Northport, actually on Eaton's Neck. Then 23621 is 31 Salem Ridge Drive, Huntington Interest, but some people think it's in Greenlawn, and uh 23616, which is 51 Lawrence Hill Road. So will the applicant or the representative of the applicant for 23631, 1 Earl Road, please address the board. President Brown PC 44 Elm Street, suite 5 Huntington, New York, 11743. Here tonight seeking to legalize an existing deck. As you can see on the survey that Matt took it away from me. As you can see from the uh survey the Matt has, that's the deck that we're speaking about. Um it requires relief under section 198-59 D3 for a side yard setback of zero feet where two feet are required. Uh this is a point two-acre lot located in an R5 zone. It's just uh 40 feet north of the corner of Earl Road and Old Country Road, as you can see on the survey there. Um the deck was constructed over 15 years ago. It's built around uh partially around and in ground and above ground pool that was dug into the ground. Um so it's only at a maximum height of two feet ten inches at its highest point. Uh it's one of those tricks that parents like to pull on children to get an above-ground pool, dig a hole in the middle. Mr. Brown, just a second. So the height of the deck is two feet ten inches.
