- Public Hearing #23644 – 185 New York Ave, Huntington (Marc Cipriano/Marciano’s Taste of Italy): Request for a Special Use Permit for outdoor dining and parking relief (5 spaces) to convert a 450 sq ft concrete block building into a food shop with a detached walk-in cooler and restroom building. A traffic and parking analysis by RM Engineering (Wayne Muller) showed ample on-street parking based on observations in October 2025. The applicant plans to use an easement for employee parking. - Public Hearing #23626 – 124 Pembroke Ave, Melville (Diana LaSpisa Morano for Collin and Rachel Clifford): Request for rear yard setback relief (23 ft vs. 25 ft) for a screened porch, and front yard setback relief (maintain existing 21 ft vs. 30 ft) for reconstruction of a front porch. The property is in an R-10 zone with many substandard lots. The rear porch is two feet into the setback. Neighbors expressed no objections. The board granted the variances.

- Public Hearing #23617 – 139 11th Ave, Huntington Station (Elias Haniotis): Request for variances to construct a detached garage: (a) five-car capacity vs. allowed two, (b) height of 20 ft 3 in vs. 15 ft, (c) cumulative accessory floor area of 1,620 sq ft vs. 750 sq ft. The applicant’s attorney (Robert Litt) and appraiser (Barry Nelson) argued that the garage would store classic cars and a boat, and that similar variances were granted at 69 7th Ave. The board expressed concerns about the substantial size and height, and noted that the 7th Ave property was significantly larger. The applicant indicated willingness to reduce height. The board decided to leave the hearing open and continue to April 23, 2026, for further discussion and possible plan modifications.
Other Business
- North Shore Holiday House (ZBA 17101): The board considered an inquiry regarding staff housing relocation within the existing camp. They determined that the proposal does not require a new appearance before the board, as camper capacity is not increased, and the operation remains under the board’s jurisdiction.
- Mr. Brown (ZBA 23503): The board clarified that a previously granted variance for retaining walls can proceed, as a boundary line agreement has been submitted. The board will issue a letter to the building department authorizing permit issuance.
- ZBA 23545 & 23546 – 251 Main St, Cold Spring Harbor: The board approved variances for a two-lot subdivision. On Lot 1 (existing nonconforming house), relief was granted for front yard setback (19.7 ft vs. 30 ft), side yard setback (6.5 ft vs. 12 ft), and shed setback (0.3 ft vs. 2 ft). On Lot 2, variances were granted for lot width (94.96 ft vs. 100 ft) and maximum floor area (1,953 sq ft vs. 1,896 sq ft, including a wraparound porch). The board noted that the home is set back on the R-10 portion of the split-zoned lot, with the R-80 portion to be placed in conservation easement. The motion passed 6-0 (Mr. Cote abstained), with a negative declaration under SEQRA. Board member McGrath expressed concern about the historic district character but noted that the Planning Board and Preservation Committee will review the design.

One nation. Indivisible liberty and justice for all. Please be seated, everyone. Okay, first order of business is minutes for March the 12th, 2026. I read them and made one small addition. And uh well, might have been a big addition, but in any event, uh I don't have any further corrections, additions or deletions, and if no one has any, I'll entertain a motion to accept the minutes. I'll make that motion. Mr. McGrath on the motion, Mr. Castagna on the second. All in favor, any opposed. The minutes are accepted. Lisa, I did get an email from Dawn saying that all the publications and the uh signage was given was done appropriately by Fattavis to give us jurisdiction for the hearings tonight. Will you please confirm that for me? Thank you very much. Okay. Um the order of the hearings tonight will be as follows. 23615. 23665. That's 18 Cherry Lane, 23649, 15 Stratford Avenue and Greenlawn, 23648, 23 Hunting Hill Drive and Dix Hills, 23644, 185 New York Avenue, uh 23626, uh Pembroke Avenue in Melville. Uh 23651, 7 Perry Place in Dix Hills, and 23617, which is 139 11th Avenue in Huntington Station. Well, the applicant or the representative of the applicant for 23615, 217 Belrose Avenue, please address the board. Good evening, Mr. Chairman and honorable members of the board. My name is Subtain Sajid. Um Principal Engineer of SS structural engineering. I am appearing this evening on behalf of my client, Miss Lee Juan Cao, seated behind me, the owner of the property located at 217 Belrose Avenue in East Northport. Ms. Cow is seeking relief pursuant to town code section 198-64 for an existing tiered retaining wall located along the rear property line. The wall was present at the time she purchased the property, and no alterations or modifications have been made since she assumed ownership. The existing conditions including includes retaining walls that exceed five feet in height and are located within 10 feet of the rear property line. Whereas the code requires a minimum setback of 10 feet. In addition to the setback and height concerns, the total wall face area currently exceeds the maximum permitted under the under the code. The allowable wall face area for this property is 473 square feet, while the existing condition is approximately 521 square feet. As such, relief is also being requested for this condition. From an engineering standpoint, it is important to note that the existing retaining wall system is in excellent structural condition. A site inspection confirms that there are no visible signs of distress, including deflections, cracking, or separation within the wall system. The walls are stable, properly performing, and continue to adequately retain the adjacent soil, including surcharge from the neighboring property. We requestfully we respectfully request that the board consider granting a variance to maintain the wall in its current location and configuration as it represents a pre-existing condition. The wall exceeds the permitted height by only nine inches and functions to retain soil from the adjacent property located at the rear. Relocating the wall to comply with the required setback would significantly encroach upon the usable rear yard area and is not a practical or reasonable alternative. Furthermore, the retaining wall is not visible from the street or surrounding public vantage points, minimizing any potential visual impacts. In an effort to move forward towards compliance, the owner has proposed reducing the wall height to four feet, as reflected in design drawing AB-001. In accordance with section 198-64. This modification will also reduce the total wall face area to approximately 437 square feet, thereby bringing it into compliance with the maximum allowable face area. However, achieving this reduced height introduces a separate compliance issue related to grading. In order to maintain stability of the retained soil at the reduced wall height, the grade behind the wall would need to be reconfigured to less than a one to three slope. The town code limits grading to a maximum slope of one to three.
