The item before you is a request to me get this on this page.

Is a request to demolish an existing two-story single-family residence and construct a 7,930 square foot three-story single-family residence with a 725 square foot three-car garage, 439 square foot of uh second story balconies, and 652 square feet of third story balconies at an overall height of 30 feet on an existing 8,943 square foot lot.

The project site is located at 3798 Mistral Drive at the northeast corner of Mistral and Wanderer.

As previously stated, the existing house is two stories, approximately 27 feet in height, and the lot is 8,943 square feet.

The neighborhood consists of single family residents ranging in different height from one to three stories.

The general plan land use designation is RL or residential low density, and the zoning designation is residential low density with the coastal zone overlay.

Prior to the meeting, staff received approximately 20 written comments either inquiring about or opposing this project.

During the meeting, 21 speakers spoke out against the project, citing concerns with the overall size or massing of the project, incompatibility with the neighborhood.

Many felt that this type of development was more appropriate for a waterfront uh lot versus a non-waterfront lot, such as the subject site.

The applicant, Barray Kareem, who was here tonight, as well as the property owner's husband, Bradley Phan, were there to help answer questions.

Staff further explain that the project as proposed consist was consistent with the base zoning district of RL and general plan land use designation.

It was also compatible with surrounding development and further explained that no facility was being proposed, nor was there anything that we could find in the pipeline with the state.

Therefore, the zoning administrator approved the project but modified the conditions of approval to address concern from residents.

These modifications included addressing the measurement of height, just ensuring that it complied with our standard code requirement, and also limiting the uses, the use for that site, requiring a covenant to prohibit any non-single family residential use for the site.

On June 5th, the project was appealed by Mayor Pro Temburns, stating that the project was too large for the site and the neighborhood, and therefore the approved findings and conditions of approval should be reconsidered.

After extensive discussion, Commissioner Wood moved to continue the item to a date uncertain, requiring the applicant to provide a noise study and evidence of soil testing for dirt brought onto the site. The motion passed unanimously.
