Christine and I are going to be echoing each other quite a bit tonight.
We are going to go into public comments.
Each one of the items tonight, um item 6B and 6C, which are the items that most people are concerned about, are public hearings.
So I will open up the public hearings and we can have each one of us.
Christine will open up her public hearing, uh, finalize their process, then I'll open up public hearing for city council, finalize our process.
Um so if you want to speak on either 6A or 6B or 6C tonight, you'll have an opportunity, two opportunities under each uh item.
But we do have a public comments uh component tonight.
So if you have one address council on something else, or you just want to get your comments in quickly, uh the time is available for you in that.
Uh so item four, the city the council chambers is open to the public.
This portion of the agenda is the public's opportunity to address the council about any general comment.
Uh comments related.
The public hearing will be heard when uh when the specific hearing begins.
Public comments are limited to five minutes per speaker unless otherwise required by law.
I am suggested for action may be placed on a future agenda at council's jurisdiction.
And I've got some some statements I'd like to read tonight.
As elected officials, we are here to listen to you.
We recognize you uh you, the people have a first amendment and Texas statutory right to speak at public meetings.
The city is consistently placed on agenda item and on the city council and planning and zoning commission's meeting agendas for public comments.
The city, its officials, and its employees will act upon and consider only objective, non-discriminatory reasons and factors and compelling government purposes in all city business, including land use issues.
The city, its officials, and its employees will not consider any discrimination in any way, including religious discrimination.
The city, its officials, and its employees will treat all persons and properly owned property owners equally.
Very important for council and uh planning and zoning.

So we'll be limiting uh the public comments to three minutes uh to five minutes uh for the uh uh for the agenda.
So with that, I'm going to um turn item six over to Chair Johnson to open it up for uh planning and zoning.
Okay, item six A, individual consideration, hold a public hearing and consider and or act on a resolution adopting the 2026 Murphy Master Plan.

Uh thank you, uh City Council and Planning Zenic Commission for being here tonight.
Uh tonight's an exciting.
This is an exciting agenda item for us.
This is the culmination of what 15, 16 months of work.
Um our consultant AJA is here tonight.
You've you heard from her a couple weeks ago when we had our previous um joint work session on this topic.
Uh so she'll go over uh a change that's been made based on some uh some comments from the from that work session.
Uh but this is this is the culmination of that.
But tonight, our expectation or hope is that you it that each of the boards will uh adopt this tonight after we have uh public carrying and public comments on it.
Uh but this is the hopefully the end of the road on this long process, and we are excited to get it going.
So with that, I'm gonna turn it over to Miss Abra and let her walk you through the plan.

Uh good evening, Mayor and Council and Chair and Commission members.
Happy to be here tonight, Abra Nesser with LJA.
Um, since we did go over the draft plan at the last joint meeting, we're not gonna do that again this evening, but happy to answer any questions you might have.
We have a couple of quick slides that just outline the timeline that we've been through and the the updates that we made since the last meeting.
So uh we did start in in May of 2025, and uh we are here in in March, but uh we had a community forum one that was in person in July over the summer, and then we also had uh community forum two in November, uh which was online and on Zoom.
Um the plan has been posted online at PlanMurphy.com, uh, which has been available for review.
This is our draft future land use plan.
It has been updated since our last meeting uh just to change um one of the the corners there for mod 11, which is a Murphy Opportunity District.
So that's the southeast corner of Murphy Road and Betsy Lane, and I'll show you what that looks like.
But the light yellow is existing neighborhood, and that is basically all of the existing neighborhoods in Murphy.
It's a preservation category, nothing's planned to change uh in the neighborhoods in Murphy, and then the the orange there is planned residential.
There's not very much of that, but there are a couple of little pieces.
Civic hub is where we are right now.
It's anticipated to be not just uh government and institutional uses, but possibly um some mixed use development, retail, restaurant, office, and that type of thing.
So those are those colors, and then we've got parks and nature.
You'll see on there that it follows uh Maxwell Creek, right?
Uh through the center of the town.
You've got community commercial along 544 and some other little pockets, and then Murphy Opportunity Districts.
Uh so these are little uh aerial views of of the 11 mods, the Murphy Opportunity Districts, and um I'll walk you through uh the process here.
So um they we did go over these at community forum one, and we also uh reviewed them with the master plan advisory committee and the staff committees, and uh we had a joint work session between city council and PNZ where we went through uh the additional feedback on the draft at that time, and we did add the one uh based on that feedback in the available um land for visioning.
So you can see kind of with the red where the different mods are.
Mod 11 there is the southeast corner.
Um you can see um it's it's largely undeveloped right now, but does have uh structure on it.
But the vision would be to have small-scale neighborhood serving mixed-use development.
Uh development should be oriented towards Murphy Road and Betsy Lane and emphasize pedestrian connections to the nearby Maxwell Creek Trail, reinforcing walkability and access to open space, opportunity for enhanced landscaping and potential gateway features that establish a sense of arrival into Murphy.
So very high level.
This is a comprehensive plan, a master plan.
This is not meant to be detailed zoning in any way.
Um this is just a high level vision.
So that was the one that was added.
Uh we do have an implementation component to the plan, and in the plan, you'll see um there's all the different actions that are prioritized short-term, mid-term, long-term with a conceptual level of cost.
So hopefully that can help the city put this plan into action.
Um, and this has been a very collaborative process, and we're really looking forward to all of the improvements that Murphy's gonna make through the upcoming years.
So, with that, I am happy to answer any questions or uh discuss any pieces of the plan that you might have questions on anybody on the commission have questions for Aubra or Jared people now.

Uh address 2245 Amy Lane Plano, but hopefully 104 sail drive soon.
Uh uh just one question uh when it was presented, it was mentioned that it had already been shared with the council and the uh planning and zoning commission, but we the audience did not get a chance to see what was covered in that.
Um I'm not saying that we are entitled to it in any way, but if it's possible, I would definitely like to see what was covered with uh the thing uh with with all you gentlemen and ladies so that we have better understanding of what's going on because what was shown here didn't give us any picture on okay.
So we have these zones, these are residential, these are commercial, these are to be developed, but uh it gave us nothing.
So uh my this is a request that more information be provided.

Uh we can surely make sure make sure that's available.

I have been asked to change the order and hit item C before we item B.
Uh so with item C, hold a public hearing.
Uh I I will put it over to item six C.
Hold a public hearing and consider and actually ordinance or approve a city initiated zone change for 3.221 acres of property located at the southeast corner of North Murphy Road and Betsy Lane, and legally described as lot one, two, and three block A, Oasis Plaza.

Good evening, everyone again.
Um, so um let me get over to item C.
Um.
Sorry.
There we go.
Um so for reference, uh, this is the southeast corner of North Murphy Road and Betsy Lane uh that currently has a zoning of uh plan development single family attached.
It's 3.2, a little over 3.2 acres.
And the city initiated zoning request tonight is to uh revert it back to uh plan development neighborhood services, which was the zoning that was on it uh prior to the change for for the attached townhomes.
Um this is a look at the uh concept plan that was uh previously approved, so you can kind of uh just jog your memory of what uh previously was approved.
This was for 32 townhomes.
Uh this is the concept plan that's in that existing zoning.
Uh and then this is a copy of the site plan.
It's a it's a little busy on there because they're they're showing you driveways and cars and everything, but this is the same 32 lots uh with the the house and houses and everything laid out on here.
This is the site plan that was previously submitted uh to PNZ and City Council.
Um so again, this is a city initiated zoning change.
Um the current zoning is not in compliance with the um the old conference plan from 2008.
Uh now with a newly adopted master plan, it's uh is not in compliance uh with the new master plan, so this zoning would bring it into compliance uh with the new master plan.
Um local Texas Local Government Code Chapter 211.04 requires that zoning must be in compliance with the conference of plan.
Uh we'll note uh for the record that uh this would be an up zoning from residential to uh neighborhood commercial, and typically uh an upzoning results in an increase in land values.
Uh we believe based on uh the types of uses that are allowed in neighborhood services and the required parking and whatnot that would be on uh a commercial development that we probably would see a potential decrease uh in traffic and and have have an overall lessened uh traffic impact uh than the 32 uh townhomes would be.
Um and this rezoning would also make all four corners of that major intersection, uh the hard corners of that intersection uh be commercial, which is the intent of all of our comprehensive plans dating back to at least 2008.
Um there are some plan a small amount of plan development standards that uh are provided with this ordinance.
Um neighborhood services is the zoning we're talking about going to.
The regulations uh and setbacks that are in that are fairly restrictive.
Uh the setback for a commercial building against a residential lot requires a 100 foot setback.
Uh so we're allowing for some uh reduced setbacks that are similar to what have been approved on the other uh corners of this intersection.
Uh so for single-story building, it would allow a 50-foot um setback, and for a two-story building, a 75 foot setback.
Uh, the zoning does allow for two-story buildings.
Um, and then it also accommodates a reduced front setback, so it would encourage the buildings to be closer to the street and be street-oriented and with parking in the rear.
So I believe that um kind of wraps up the pre my presentation on this particular PD, be happy to answer any questions that the commission or council may have.

We are gonna hold you five minutes of person.
I will if you're starting to get a little long-winded, I'll give you a notice of about four minutes and thirty seconds.
Good evening, PNZ commissioners and council.
I have little horse wise.
I mean, like I will try my best to uh convey tonight.
Um let me start my presentation with an overview of my project, and these are the facts.
So I will start with first important one.
My zoning was approved back in November 2021.
When I got approved, it was a master plan.
It was master plan 2008.
It's on record, you can note it down.
It was a master plan, and I I applied for three times with PNZ and City Council, and then I got approved.
And then I got approved.
Approved to 32 townhomes from commercial comprehensive to single family residential.
And when you do that, I followed the due process.
After careful thought and consideration from within 100 feet, 200 feet.
As per state law, you have to send the notices 200 feet.
And all the residents within 200 feet were against commercial, against neighborhood services.
I'm reiterating all the people, all the residents within 200 feet were against neighborhood services.
After following file after following the due process, then I got approved.
That's well and good.
We were happy.
As a matter of fact, you can see council applaud uh on that night happily approved it.
And it was approved unanimously.
That's one thing.
And I'm pretty much sure tonight, PNG Commissioner and City Council, they are going to take the opinion and feedback of within 200 feet.
I came to know that there are almost 75% of the people are against this.
That's one thing.
The second important point I want to focus is there are many people contacted to me.
Seniors and also millennials, they want to buy this product.
I have people like Dr.
Chockley, Mary Pat, and her friends.
They want to downsize the homes.
So the concept we are hearing, all four corner commercial, it's not going to work at that particular intersection.
The reason for that is I have a gentleman here, the owner, 1015, not Murphy Road.
He faced problem renting.
He has to wait five years to rent his uh vacant space.
Right now, on the south side, Dr.
Carbonal is on the new uh animal clinic.
He's facing almost from one year to rent two thousand square feet.
My northwest corner, I'm getting another two twenty thousand square feet.
If you add up all, then you can do the math.
It's very difficult to have commercial in that area.
Now people ask question, what if you know there is an expansion going on, there is a loop connecting from Macrary and Betsy all the way to country club.
I have a lot of developers who are my friends in that area.
That corner particular, not uh the corner we are talking about, Betsy and Murphy, is not suitable for neighborhood services.
There are many other intersections like country club and uh you have uh McMillan.
There is a 12 acres that's going to be commercial.
Murphy has Northwest Corner and Macrory and Murph uh Macary and uh uh what uh Betsy, there's another three-acre.
So what we are going to do with all this due to you uh the declining in US uh market and all these things happening, uh I think it's not a good uh good uh approach to have what you call neighborhood services in that particular intersection because of all these things.
Now there is a there is a um important point I want to focus here.
It was not to my knowledge all these days that you guys are planning, cities initiated the planning to convert into master plan.
It was a shock and surprise to me.
I'm 100% positive here, it was shock and surprise to me.
There was a discussion of my property on this south side.
I love to help the community.
I love to see uh the town center.
I'm very much friendly guy, friendly developer who is eager to work with council and planning and zoning commissioner, even though that property was zoned 53 patio homes.
I had an offer from toll brothers, I had an offer from some different builders.
I said, let's work.
Reagan started working with me last year, I can say April, and he discussed about the plans.
I said, okay, but there was no no discussion about my other plan.
And as a matter of fact, on record, I want to stress two important points.
On July 26, 2025, community forum was held at Murphy Activity Center.
There were 200 residents participated there.
I was one along with Mary Pat.
You have five minutes, so I have up your thoughts.
Okay, yeah.
So I'm saying the discussion was not to my knowledge until I got the notice.
That's unfair.
And I need justice here.
We want town homes.
And when you started the master plan, you held a community forum.
No discussion of my this project, not Southeast Corner.
When you did uh Zoom meeting, there was no discussion.
So what I'm see, uh ma'am, it's five minutes because I'm a property owner.
You need to give me more.
I have so many points.
Uh okay.
So, okay, ma'am, with due respect.
I remember your comment uh uh Christine Johnson.
When you approved Northwest Corner, you told me, Sayat, instead of commercial, you would have got all the homes in uh Dr.
Chocolate's property.
You know, Dr.
Chuck's property was in master plan.
You guys converted into residential.
It is unfair.
I want I humbly request everyone not to approve the neighborhood services at this corner.
I would like to keep as it is town home.

Name is Ryaz Odin, address 2245 Emin.
And I know I've been saying this for quite some time.
Hopefully 104 Sayyid drive soon, within a month.
Uh first and foremost, I would like to thank all the council members and the commissioners for their services.
I've never seen the two groups together, so it must be something really important.
So thank you for being here.
Uh my house lies within 200 plus feet of this particular property in discussion.
And when I started building my house in early 2005, the one of the reasons, driving factors, of course, was that there won't be any commercial re uh centers touching my property.
Yeah, we have across the street, and I have seen those vacant uh properties across the street, and of course, we have the new developments which came, but they were not touching my property.
And uh and that was definitely one of the driving factors.
And on top of that, I was always led to believe that Murphy is a family first city.
A family first city will concentrate on building something to invite families, not destroying homes, affordable homes to uh for to raise commercial areas.
This is not a family-friendly city, this is not something a family-friendly city would do.
I humbly request you to please deny this, especially for that corner.
I know we have another uh agenda on this for this particular lot, but yeah, this is a little further away from uh the main residential area, so I understand that, even though I am not fully uh satisfied with that change as well.
But this lot, definitely, I humbly request you to please deny it.
I mean, Murphy is clearly divided into a residential area and a commercial area.
Anyone can say that.
FM 544, it's all commercial.
Murphy, Betsy Road, Park Road, from there, it's all residential.
Yeah, you have bits and pieces of office uh I mean commercial areas here.
You have a 7-Eleven there, you have a neighborhood Walmart there, but that's about it.
Why do we want to change that?
Why do we want to change the the percept uh the perception of this city to be some some some something from which is family friendly to something which is all about money?
And even talking about money, it is a misconception that commercial would raise more money.
No, it would not.
It will definitely reduce the value of the properties on Oasis Farms.
I'm an HOA member, HOA board member of OASIS, those are almost million-dollar homes, right next to uh commercial uh area, those values will go down.
And believe me, commercial in this one, there are so many properties in this modern age where everything is being done online, the shops are shutting down.
We want to raise more commercial at the expense of homes.
Please.
And I want to end with one last thing.
When I came in, uh it is I would like to believe it's a coincidence that both the lot and the discussion belongs to one developer, and uh but I had my speculations, I'll be very honest about it.
But when I when uh Mr.
Mayor said that there won't be any discrimination, any prejudice, uh anything like that, my heart felt a little bit of contact.
I had my differences with uh Mr.
Mayor.
Uh there have been many decisions of his which I agreed with, few which I was not fully uh in agreement with, but I trust him.
And when he says that there won't be any discrimination or anything of that sort, I fully trust him.
And I believe that this these values will be upheld, and the decision will be made on the merit of the case and not anything else.

Uh my name's Amin Bata.
Uh I manage a partnership that owns 1015 North Murphy Road.
Uh the property address uh that my partnership manages, owns, and manages is 1015 North Murphy Road.
Uh my residence is just a little bit north of there.
I live in Lucas.
I've been in Lucas since uh 99 off of Parker Road.
And uh before I start on my comments, I would I want to thank uh all the uh commissioners and council members for your time and effort that you put into the city.
I know you don't do it for money, but uh just like you, uh the well-being of Murphy is very important to me.
We have a huge investment there.
Uh we have investments around there in Wiley and and uh and plain on Allen as well, but uh Murphy's been special to me.
My kids, my grown kids live in Murphy.
Uh so I'm here today mainly to share my experience.
I I own and manage neighborhood service centers, and we have properties in in uh Collin County, a little bit in Grayson, some in McClellan.
And uh we developed, we had the opportunity to develop the center, uh, the the small building that is occupied by Bloom Pediatric Dentistry, uh Murphy Dental and Implant Center, Dr.
Ling and Dr.
Tyre here this evening.
Uh they were our first tenants that uh convinced us that there was a need for for uh dental arts, especially for implants and periodontics, and then we uh uh had Paradise Nails come in and occupy our building.
What I want to share with you is that uh I've been building and managing strip centers, single-story office, single-story uh food and neighborhood medical services for 27 years.
Murphy was one of the hardest projects I've I've been involved in.
I would run into Jared, by the way.
Jared helped us during our development process, very very thankful for Jared.
But I would run into Jared at all the commercial real estate trade shows, and he would ask me, so how's it coming along?
And I would have the same answer.
I'd say we get at least two to three calls a week, and there's a common denominator.
They they are either CBD shops, vape shops, pawn shops, or or uh something undesirable like that, beer wine store.
And thank God uh my equity partners had patient money, and they allowed me to wait it out.
And uh it took us over five years to fill 3,000 square feet, something to keep in mind.
When I heard about this last week, I was I was stunned that Murphy would even consider more neighborhood services.
So I called my partner Preston.
I said, Preston, pull up the CoStar.
I I don't have a subscription to CoSTAR.
We have an AI CP here, I believe there's a planner that did the presentation.
I just have a simple question.
Did you guys even look at CoStar reports before you decided to add more?
I mean, the city wasted their money with with the with the planner, and I don't mean to attack the planner.
Uh I've served in appointed uh positions in Plano in the 90s and in Lucas in the early 2000s.
And you're supposed to get your metrics straight.
45,000 square feet currently sits vacant in the city of Murphy.
This is 45,000 square feet of non-big box single story neighborhood services commercial building space, improved property.
And and you're and you're and you've got potentially 20,000 square feet being developed by Syed on the Northwest Quadrant in the former Dr.
Chalkley's property.
Uh you've got uh Hector, who just opened his wife's uh uh veterinary clinic, and he's got three thousand square feet vacant.
Uh you've got a big quadrant at uh McCray and Betsy that nobody's put an offer in for years, and you're wanting to convert another three acres to more neighborhood services.
It doesn't make any sense to me.
Uh I am here because I love Murphy.
Like I said, I've lived in this area for 27 years.
I go up and down Murphy Road.
We patronize 544.
That's that's where our shopping is done.
I don't want to see another intersection with the mindset like Plano had back in the 90s, where every intersection was every all four quadrants of every intersection was outparceled pads with drive-throughs and inline retail that would stay vacant.
It was great for startup churches.
Well, several churches that I was a part of in the 90s started in strip centers with $4 a foot rents, and the developers were losing money.
There was vacancy, there was homelessness, and there were a lot, there was lots of demand for pawn shops, CBD shops, vape shops, beer and wine stores, and liquor stores.
And I just don't want to see that happen in Murphy.

I'm a resident of Murphy, and how do you follow that?
He had some good points, I think.
Um today we're here to discuss uh the zoning change for the property that we're talking about, and I'd like to give you my perspective of this land as I've lived in Murphy for 23 years now, just as the city of Murphy was booming with new developments and growing by leaps and bounds.
Most of this growth was between 2003 and 2018.
As a resident and a realtor, I have helped many families find their homes, welcoming them to our new parks and trails, and uh seeing our maze days develop into amazing event each year, and um just drawing people from all around the Metroplex for that and developing our recreation program to the amazing place for kids now to spend their summers.
We've just done a really great job.
And um I was here before Murphy Marketplace was built and watched as my husband Dwayne served on the city council while we were growing with our commercial stores and restaurants.
I made great friends during this time and helped establish the Murphy Exchange Club for citizens who wanted to support the city, flew through blood drives, coat drives in the winter, and generally loved to see Murphy grow and thrive.
One of my friends were Jack and Jimmy, Jack Jim and Jackie Permanter, who own the land at Murphy Road right now that we're talking about, uh, right across from the 7-Eleven.
They were wanting to downsize and decided to sell their house in about two acres of land.
I remember erecting a big sign there as we advertised it.
Originally this was zoned for commercial, as we've heard, but there was kind of a snag because they had an interior lot, Jackie and Jim did, but there was also a corner lot by another person that owned it, and that really and he had no interest in living in Murphy, so he had a ranch-style home, and he did not keep it up.
And for many years, that home sat there, and um didn't do anything in that area.
But um, as the permanenters were trying to sell, um Syed came along.
He wanted to see about uh buying that land from them, but on the corner was this house that was dilapidated.
Well, um it was a long time coming, and we traced down the owner of that house.
I remember one family member lived in Colorado, and uh we probably spent eight or nine months trying to make a deal with this um owner that had the land there, and it's my opinion that if we hadn't delved into this and done our due diligence with that corner lot, that corner lot would still be there.
The house is gone now because Syed removed it.
And but it's it is my feeling that there were several heirs to that.
It took a long time to combine both of those lots, and that's when Syed came along and bought it.
And so we were actually able to bundle that deal and make it happen.
I don't think it would have ever happened.
Around November 2021, Mr.
Hussein wanted to change the zoning to residential, and I will let you know why.
Our conversation was from the time for that I told Syed, what Murphy is missing is a place where people can come here to Murphy, buy beautiful new home, raise their families, but when the kids leave for college, and that house seems too big, there's no place for them to live here in Murphy to go to downsize.
As we discussed this, I was showing homes in Frisco and showed the most incredible patio town home concept, a plan that was very unique.
I immediately called Syed to come see it, and that is when the dream started to develop for this place on Murphy Road and Betsy Lane to serve the residents of Murphy by offering a place to downsize in a beautiful new home while still living in Murphy, the place where they had raised their children and made lasting friendships.
This was the dream, and Side was planning to begin breaking ground in 2026.
We are here to discuss this change back to commercial, and I really believe this is not the best way to serve the Murphy community.
That is my story of why I am opposed to going back to commercial land use.
It is really going to be is this really going to be a good plan for us?
And I would like to ask if the at the beginning of the meeting, you voted on accepting this plan.

So my name is Valita Logan.
I live at 208 High Point Drive in Murphy.
And I am definitely not an expert in building, but I'm definitely an expert on that intersection.
I live about four houses away from the intersection.
So I've seen a lot of changes in the past almost 12 years.
I do know that the development that is proposed, the townhome development would definitely change that intersection.
In the past five years, nothing has happened.
And I think the entire landscape of Murphy, the needs have changed.
I also think that a neighborhood services might be really well used because I'm thinking about all of the developments coming along down North Murphy Road or Hoggy Road or whatever.
There's a lot happening.
Those people are going to be drawn into Murphy.
So I think it's actually an excellent use of that land.
And I strongly am in favor of the zoning change.

I think that we have all seen, you know, there's a lot of houses being built right now, especially in that area.
Um someone spoke to, you know, the Murphy being a family-friendly town.
I think this is a family-friendly change.
I think it's good for the safety of the people of Murphy and everyone that flows through there as well.
Um like was just mentioned, it's a very busy intersection.
Uh, we're gonna get a lot of traffic with all the houses that are already currently being built, and I think with additional dense town home housing, there's just going to be, you know, a m uh a further increase in that traffic, and it's just gonna be a lot to handle.
I think it's a a good change for now to see, you know, to let the rest of everything else settle.
I think it could be good for the city, it can provide some good, you know, a good commercial center for the city.
Um, you know, it's very similar to many other intersections you see anywhere in the area where there's you know four commercial pieces on each of the corners and of an intersection.
So I don't think it's that unusual the way it is like that.
Um the one other thing, though, is the mention of the 200 foot around the area.
I mean, obviously that's not a big distance, right?
Like it's it's very important, people that are in close proximity to a property that you know their feelings on how that property is going to impact them is is felt, but this isn't just an impact to the people 200 feet around that area.
It's an impact to everyone in the city, it's an impact to everyone that has to drive through that intersection every day.
Um, and I think this is a positive impact for the city.

Good evening, Commissioners and Council members.
My name is Michael Padilla, 323 Apache Trail.
I am in favor of this zoning change, and it is going to be for a primary reason of tax base.
Murphy is a tax whose tax base is home heavy.
While we've developed uh that corridor with lots of businesses, which I think is great, we do need to diversify our tax base with more commercial businesses throughout the city, even considering the fact that there is a push every year in the state capital to reduce property or eliminate property taxes.
I do know that Governor Abbott has a plan in place.
I do know that our state Rev County Noble has a plan that she likes to propose to reduce or eliminate property taxes.
So we need to look at a diversified tax base.
And I think this zoning proposal is in line with that vein.
Not to mention that we had a member mention uh families have children grow up and they move out of the house.
We should build Murphy as a place for new families, individuals who are going to start new families who look at Murphy as a place to start their family, their first home.
You know, with the affordability that President Trump is bringing and the golden age of America.
This is how we should look at Murphy as a beacon of light to draw in families.
And this resident the zoning change may be a factor that pulls in a new family.
It's like, oh, we can walk down to the local store and buy um our donuts, our breakfast, or whatever the case may be.
So I'm in favor of this, and I encourage the the commissioners and the council members to vote in favor.

And uh I would like to say that residents make long-term decisions about where to live based on the part of the city's zoning plans.
The original zoning for this site envisioned residential development that would be compatible with the surrounding neighborhoods.
Converting it now to commercial style designation significantly changes that expectation.
This proposal raises three important concerns.
The first is it increases the likelihood of higher traffic, congestion, and commercial activity directly adjacent to the residential areas.
North Murphy Road is already a heavy traffic area, and additional commercial developments will inevitably intensify those impacts.
Second, this change creates uncertainty for residents.
When previously approved residential zoning is later converted to a commercial use through a city initiated change.
It undermines the confidence in the long-term planning decisions that reg residents like me we rely on.
And now we this is a surprise to us that right across our home, there will be a commercial area which will be coming in.
And the third will be it weakens the careful balance between the residential neighborhood and commercial corridors that has helped make Murphy a desirable community.
So residents rely on zoning decisions as a commitment about how our community will grow.
Changing this site from residential to commercial after the fact undermines that commitment.

Currently I live in Plano, West Plano.
And I have a beautiful house there, very good neighborhood, very good neighbors.
Raised my family there.
But where my neighborhood is, right across there is a commercial.
And there are now there is Walmart there.
And Mr.
Jarrett was talking about that, you know, the traffic will be less when we have a commercial.
That means we are already looking for failing the commercial.
If you want to have a commercial, you want to have more traffic there.
So people will come and buy and have more uh availability there.
So the the shops may close at nine, eight, ten maybe, but then all night there are services being provided there.
People are coming, subcontractors are coming, cleaning services are coming.
All night, there is activity in those commercial areas.
So I was talking to Sayyid about that that you know I live in that neighborhood, very beautiful, but this is the problem.
All night there is cars coming, there is noise all the time, and I was looking to some peaceful neighborhood.
So he suggested he's building his developing neighborhood across this lot.
So I bought a residential plot there and I started my uh how home there, and my family are wanted to move there.
But now when this I'm hearing that the commercial is coming there, now I'm thinking, did I do a mistake?
And what I heard from what's going on with the commercial uh places, shops that are being, you know, waping shops and CBD and all those things.
I don't want my kids to be in that neighborhood.
Plus, we were talking about that when we have I have three boys, all grown professionals.
They are starting their professional lives, and I was thinking where they can be close to me so we can all be together.
And this is the lot that he was developing.
I was hoping that I would get lots there for them so they can start their families in a neighborhood that's safe and not have any you know family values.
He developed the new new uh uh development right across.
Look at that neighborhood.
It's almost the same as South Lake.
Professional people are coming and staying there, families they're raising their families.
It has increased the value of the land.
The same land that I bought within a year, it's almost double.
So it's giving the value to the Murphy, it's not giving in his pocket, it's increasing the value of the Murphy city.
We are bringing our kids here.
I was thinking they will start their family here and will buy those lots.
Now, those lots already we saw there were 32 townhouses.
They don't just come like that.
There's investments, there are investors that are investing with Sayed.
And what message we are giving to those investors?
I'm a physician and I invested in that lot too.
So what message you are giving it to me, I should not invest in a council in a city where they can change their mind for good reason.
Your past five minutes, or I have a few thoughts, please.
So I'm against it.
I am strongly against it.
So please don't make this decision to send a wrong message to owners like me, investors that are out there in the community, they are looking to invest in Murphy.
So please do that.

The gentleman over here who mentioned that he did his research.
I did my research as well.
I looked around, I checked before purchasing this property that everything around me is residential.

And after doing my due diligence, I found out that this entire area is going to remain residential, and then I made my investment and then I purchased my property.
Now all of a sudden, I'm hearing about this, there is a proposed zoning change, which is definitely shocking.
So since I'm directly impacted by this, I really wanted to, I'm interested to find out if there is an example previously within this Murphy City, when something was already approved as a residential, later on it was it has been changed, something like this.
And what about the properties that we are either investing or purchasing?
What's gonna happen to those?
I'm definitely opposed to this change, and uh I'm not an expert in all these things, but what Jared mentioned like having a commercial property is going to reduce the traffic.
This is just mind-boggling.
How?
And the gentleman said over here that this is going to set for failure for those businesses which we are inviting and asking them to invest.
Definitely that's going to happen if that's our mentality.
So I'm 100% opposed to this change, and I appreciate city to reconsider and let the residential property be residential, please.

I'm resident of 2 to 1 Osman Drive Murphy.
So I moved recently here last year.
When I actually purchased the plot and when I built that house there, I was told by that this is the whole area is actually residential.
I moved from California actually here.
And now she told me last week that it's going to be there, and especially that property has a straight view from my house.
So it is what work is going to be built there, I can they can see in my house and and like that.
So that build a big concern for me.
And then the other thing that I'm hearing that if there's already 40,000 square feet of commercial space still available in Murphy, which is not being utilized.
I don't know what sense it makes uh economically also.
And then on the traffic in the city meeting last time when I ever joined, when there was that bonus zoning uh discussion was happening, and I was somebody here told that time that if we bring commercial, it increases the traffic.
And there was some concept that we should not build the full commercial uh setup there because it's going to increase the traffic, and then a lot of numbers were shown here.
And today I'm surprised when we are saying that no no commercial brings less traffic, the other things.
So I am I don't know what is the motive behind this uh uh this change.
Uh people I have not seen this happening anywhere, like randomly you pick up one area and then see now you change it from uh from residential to commercial, and especially when you know there's no economic, I will say, uh benefit out of it.
Uh so I hope that we are being very fair and unbiased in our uh responsibilities.

My name is Tasneem Zeman, and I moved from Richardson uh uh Virginia, and I moved in 2020.
And uh I came here uh so I found uh many homes currently available in the market and very expensive for families like mine.
Some homes are older and require a lot of uh renovation, which makes it even harder for us to afford them.
And when I learned about Mr.
Hussein's project, I felt hopeful because I it is within the budget, and while it's still offering modern, smart and high quality homes for my family, and owning a home in a wonderful uh location and fulfill our dream of home home ownership.
This is my first home, so I'm trying to buy this uh town homes, and I I'm there at uh when it's approved in 2021, and they told me that oh, it is approved, so I'm very lucky for that.
Now I'm gonna learn that this uh approved townhomes is going to be uh as a commercial, so I'm opposing this.
Uh that uh why uh we are we are we need that town homes to buy, and we this is my first home in this Murphy location.

I've lived here uh probably 27 more years.
Um I've seen the city grow, I've seen more houses, neighbors and everything, and I could tell you from just me and from many people that I talked to that they are for this neighborhood services.
Um I've actually rented from a neighborhood services strip mall for many years, and um when we are get out of our jobs or something, we go next door to see if there's a restaurant or something there available for us, or um, it would actually bring more people from that neighborhood to go to like just down the street to get something, and that's very good.
Also, we need to bring more restaurants here.
We've been here for a long time, we've seen restaurants close so much.
We want to bring good restaurants here.
We want to have a good place that families can gather some good shops that they can uh shop at that we can bring more business to Murphy.
I would like to see more stuff come to Murphy.
And as far as um Murphy being a family home, I will say Murphy is one of the best cities to live in.
And that is my opinion.
But Murphy, I came here when there were only the first neighborhood, and Murphy has been so sweet to us, so kind.
All of our neighbors got along good.
We had block parties and everything.
And so as far as the city growing and putting neighborhood services, I think that's a good idea, especially sidewalks, more places for people to walk, so they don't get in their cars and have to drive.

I'm within walkable distance of the area that's in discussion.
I am in support of the zoning change to uh uh change the zoning to neighborhood services.
I have three children under the age of 10.
I think it would be nice if I had a walkable area where there are shops, restaurants, other things that could bring money into the community, uh help our economy, um, strengthen us for the long term.
Um I was uh glad to hear of the uh master plan um and I think this will just be a continuation and a uh uh a added benefit to the entirety of uh the city of Murphy and surrounding cities, bringing it as a uh a destination for people to shop and to uh uh conduct their business.
So I uh highly support it.
Um young families are still moving to Murphy.
Um I don't think that's gonna change just because we change uh zoning in one specific area.
I think we need to have that uh understanding.
Additionally, even though those that have uh bought or purchased uh properties in that specific area, they're also gonna benefit.
We're all gonna benefit.
I think that's the one thing that's gonna happen by changing the zoning is that everybody in Murphy, everybody in surrounding communities are gonna be benefit from some uh added uh commercial areas.

I'm not saying like we should not develop, we should not uh try to have aspire to have uh all of the good stuff which uh we discussed in the beginning uh part of the session, right?
But having said that, like I mean, like uh you don't want to spoil what you have, right?
You don't want to retrofit and also like I mean it's deceiving people who have put in their hard-earned money based on the fact that like you guys approved it.
And uh it's their money, it's their investment.
Okay, I mean uh you can say like, oh yeah, it's gonna help somebody, let's not worry about the people who are there within the 200 thing.
I mean, they are also people similar to the other people who might have some kind of advantage.
But having said that, like I mean uh you cannot just retrofit and say, like, okay, uh somebody has put in like half a million dollars, and now you are saying like, well no, what we are gonna change it now, like because we think otherwise at that time we thought otherwise.
So it's something which we have to think seriously.
Like, I mean, it's not like okay, because we think this is how it's gonna be.

dollar and now you are saying like no what we are going to change it now like because we think otherwise like at that time we thought otherwise like so it's something which we have to think seriously like I mean it's not like okay because we think this is how it's gonna be I I hope that makes sense okay yeah thank you good evening uh my name is Kudberto Salas I'm a resident of Murphy and one to three Windsor Drive uh been resident of Murphy for the last 13 years I'm also our real estate agent uh been a real estate agent for 20 plus years and I'm a favor to keep the lot commercial um even if I sell residential properties um one thing that I noticed the based on the information that are here tonight is that those town homes are already promoting to a specific people and like I'm a I'm a real station I have access to all this information and I never heard or know anything about town hall so I can promote it to my customers that I have because I have family that want to live here in Murphy.
So I think we are thinking well they're taking disadvantage are people in our community too.
So I'm in favor of the commercial property because the people in this cities around Murphy they also need businesses.

Anyone else for those item seeing no one I will close the planning and zoning public comment uh 728 questions for Jordan or anyone can I ask a question here just because it came up you mentioned and it came up in a few of the comments can you just address the traffic projections again or you know what we're thinking what's the background on that right so my comment about traffic was depends on how the so it depends on how this property is developed.
I would not necessarily say that commercial in general generates less traffic than residential that's that's not what I was trying to to get at if we look at some of the if you look at the veterinary clinic across the street which is oops which is where the cursor is or whatever that definitely would generate significantly less than 32 homes that matter if they're town homes or or a single family detached home um we look at the traffic counts of what a what a house generates it's eight to ten car vehicle trips per day so but that's that's everything that's that's mom or dad going to school going to work taking kids to school the Amazon delivery the all that is kind of accommodated in there.
So some some commercial uses would definitely generate less traffic than that.
So that that's what that comment was obviously an H E B store or grocery store generates significantly more traffic than a vet clinic.
So it it's a little bit subjective I guess in in terms of what would go there but um light retail additional offices that that are similar to to what's in that area would could potentially generate less traffic.
And obviously with this zoning if the new zoning were to get approved whatever would be considered there would also go in front of these bodies and so that would be a consideration for what we said that was not plan development this is this is a plan development so if if it's basically what the next step would be if if this was approved and then the property owner or feature developer could submit a they would submit submit a site plan much to the same as is what happens on the north uh east corner they would submit a site plan that would be the next step that would come before PNZ and council um unless there was some reason to amend the the plan development that wouldn't they would not necessarily generate a a zoning change unless they were trying to change some some land use or some um setback requirement or something.
Can I ask one more question absolutely there were also comments about the vacant commercial space in Murphy and on the surrounding corners to that discussion.
Sure so uh we do a fairly robust job of trying to uh track what is happening within our commercial space globally in terms of what's just in Murphy um I don't know that it's 45 it may be 45000 square feet overall but our overall occupancy rate we're not we're over 96% occupied there may be there have historically been some stubborn spots that have taken a while uh to see leased up where the Bloom pediatric that the property owner mentioned that was a uh a hall waiting for that to be uh backfilled but overall our occupancy rate is extremely high um and I think that 4500 square feet probably actually includes 18,000 square feet of uh box space over here in Murphy marketplace that's already in the system uh the commercial lease the loop nets and whatnot the commercial lease sites that's in the system already um but there there are a number of vacancies that happens it's it's normal but we've been hovering since I've been here anywhere from ninety five to ninety eight
But overall, our occupancy rate is extremely high.
Um, and I think that 45,000 square feet probably actually includes 18,000 square feet of uh box space over here in Murphy Marketplace that's already in the system.
Uh the commercial lease, the loop nets and whatnot, the commercial lease sites that's in the system already.
Um there are a number of vacancies that happens.
It's it's normal, but we've been hovering since I've been here anywhere from 95 to 98 percent occupancy rate.
Um so I I feel like we have a fairly healthy, and then this change is not just about today.
This is this is setting the stage for long term.
Uh I think I believe one of our speakers mentioned uh the construction that's about to take place in Parker.
The the South Fort Ranch area is is actively the stormwater prevention stuff has gone up and they're actively beginning to uh clear that property for infrastructure development.
So we're gonna see some additional homes in Parker, as y'all all know.
Parker doesn't allow commercial so there would be some additional residents in the area that could I believe could support um our retail not only at this location but down on 544 as well.

Um I guess I'll start.
So I I just wanted to make sure we had all the background and kind of context to consider um what kept coming up and some of the comments.
Um I do think it's rare that we are you know kind of reconsidering or re-looking at a property like this.
Um, but it does tie into a lot of the discussions we've been having around the master plan, trying to have a very forward-looking vision for Murphy.
I think anything that would be considered for this corner, we would look at all of these things with traffic and what the uses are, and you know, making sure that it's something that would benefit the surrounding area that fits with the surrounding area, and hopefully looking at it this way would be a boon to the other businesses on that corner, a benefit to residents in that area and across the city.
Um it has been, I think many people mentioned like it was like 2021 when this original plan was approved, and a lot has changed, and so this is an opportunity to reconsider what's gonna fit best in the area and with the needs of the community.
So I'm um I'm sympathetic to the fact that this is a change, but I think ultimately it's a beneficial change.
So I have a question for staff on the barn door after the horse got out.
Did we ever end up with a final t of favor and opposed on this item since it was pretty chaotic from last Friday until about two seconds before six o'clock?
So the issue was is I couldn't get a total count between what I was receiving and what the city secretary was receiving because they were comments were being submitted at submitted two separate ways.
I was getting comments to my email box through the letters that I was receiving that were required to go out by state law.
And then the city secretary's office was getting a separate set of notices that were people going online to the online form.
I know the comments that I received.
I ultimately ended up with a I believe it was 36 opposed with two in favor.
But again, that number is just what I personally received through the what is typically the planning and zoning commission way of submitting comments.
And the we don't have a uh accurate count of the ones that have come in through the online form.
Uh more since we have and they're there's they're still coming in as we speak.
Um the lion's share of those have been in favor of the zoning change.
That is as Morgan said, the ones that came in through the PNZ, the QR code that goes out the legal notices, they've been the other way.
Other discussion if you don't mind so there I don't know, it doesn't impact the planning and zoning commission tonight.
Um, but we have received enough uh comments uh uh and opposed to the rezoning on this particular track that it will take a supermajority city council to approve it.
It's it's met that 20% threshold uh that's in the state law.
It's it's met that 20% threshold uh that's in the state law uh that does not impact the city the planning and zoning commission that applies to city council decision.

But anyways, firstly, uh I would definitely like to get the numbers from the secrets from the city on what those approval was equal, less, these are all relative numbers.
We need to have the exact numbers.
This is not how we expect a city council to function.
We cannot just wave hands.
Uh secondly, a lot of people talked about taking their families to that neighborhood services.
Was I the only one listening when the gentleman who held who holds property in that neighborhood said all he could get in that business for almost a very long period of time was wapes, alcohol chops?
Are these kind of places we want to take our families to?
I hope not.
And not to mention McMillan High School is just one block away from that place.
I have already seen a lot of high school kids doing what they do in the 7-Eleven store.
We build another commercial place for them, God knows what what comes in there.
Plano East High School is really close to where I'll live.
And in right next um next to my neighborhood on the intersection of park and uh uh Los Rios, there's a vape store.
Guess who frequents that shop all the time?
These are high school kids.
I know they are not allowed to buy, but they have their ways.
You and I we both know that.
Do we want that near our schools, near our residential neighborhoods?
And this is not just a theory or a hypothesis that I'm throwing out there.
The gentleman who owned the business for for in that in that very neighborhood said these were the kind of calls he was getting.
And uh uh Gerard himself mentioned the one neighborhood where we had difficulty finding a good tenant was is in that exact intersection.
Why are we discounting that that fact?
All the uh businesses that we have on 544 are fine, but that neighborhood that this is residential area, hardcore residential area for the city of Murphy.
Why are we just saying that it's the same as anything else and there won't be a problem?
And like uh another gentleman mentioned, we are either uh setting up for failure where the traffic would be less, we have no businesses or crappy businesses, or we have businesses which invite so much traffic that it overshoots the residential traffic by I don't know ten times.
Am I the only one listening to these comments?
Am I the only one or the the few of the one who who are thinking family first?
Murphy is family first, and this is a residential neighborhood, residential area.
You want to set up shops?
FM 4554 is all there for you.
Even the lot across the city hall, we can do a mixed development all this.
Why are you encroaching in the residential area?
The area that I live in that that I'm I will be moving in in a month.
Where are the where there are several other neighborhoods?

And the fact that people who are close to 200 feet, I think their consideration should be given an upper thought.
And as far as the traffic study is concerned, when this was approved as a residential neighborhood or a townhome neighborhood, the traffic study analysis was done.

And if you're talking about the houses which will be built in the park or up the street, really they we want to invite those people to this little strip, and then we claim that the traffic will be less.

So the first uh thing, this change, master plan was started during the year.
On July 26, 2025, a community forum was held at the Murphy Activity Center.
Approximately 200 residents attended to provide feedback on the master plan as to the desire for the community.
I have also attended with Mary Pat.
There was no mention of the master plan for Pican Murders townhome, and this is the fact.
Because we converted, we the zoning changed in the year 2021 from master plan to this uh townhome.
Then on November 20, 2025, the reason Murphy monitor, you need to cut down this place.
On November 2025, a virtual community forum for the city's master plan was held online to provide the community with an update on the progress.
Key moments of the process were promoted on multiple social media platforms, the city's website and Planomurphy.com.
Flyers were also placed at all Murphy facility entrances throughout the process.
The Murphy Monitor also provided stories throughout the process to raise awareness.
Again, there was no mention of Pican Meadows Stone in all the above discussion.
This is unfair injustice.
We are living in America.
We are not supposed to do injustice to individual from based on the background.

What happened to the city staff, Jared, when Reagan was there on April 2025, I talked to uh uh Reagan.
He told me to start the engineering plans.
I involved architect, floor plans of all the elevations, all the engineering plans.
Is reviewed by city engineer, I have his stamp.
And then you took forward to the planning and zoning.
The same planning and zoning commission approved unanimously on December 14, 2025.
Now you are rejecting.
On the same council, they approved on record December 14, 2025.
When I went to uh City Council on January 6th, Mayor suggested to lower the density and just do exactly like Murphy meadows.
Murphy Vedos was approved for 29 townhomes, even though 32 was not too far.
But I respect mayor's uh comment.
And I went back, and mayor told me to work with the city staff.
Jared Mayfield and Edita Adams, they told me, Sayat, it looks fine.
Now we'll go ahead and submit.
I was waiting for the approval to start the door, start the construction.
Suddenly it was not in my dream.
It I never thought somebody will come and tell.
In my dream, hey, master plan is going to offer your land.
I would have just go to mayor's house and tell why are you doing mayor?
So as a humble request, I want city council not to approve please.
I will do with your help to have a better product.
And my product, this particular product, is not a cook cookie cutter product.
This is going to be with a combination of stone, brick, tile roof, and the lot depth is now the most important thing that Jared, you forgot.
Uh Morgan, you forgot also.
Within 200 feet, there are 13 properties.
10 people opposed, 10 people opposed, three people they did not oppose is a uh storage and 7 leven, and there is a guy, he has some surgery.
He told me, Sayat, I wish when you gave the comment in writing, and that's why you need supermajority.
So when you approved my animal clinic doctor chocolate, you consider the comments from the immediate neighbors.
In this case, how come P and Z is going against the immediate number?
If you take the 500 vote, I got the count.
500 votes, there are 33 lots.
Out of that okay, here you go.
So I'm sorry.
Out of 33, 31 opposed in 500 feet.
There are people coming from all over the city of Murphy.
They have their personal agenda, personal interests.
My personal agenda is to serve the community regardless of faith, race, religion.
I want these town homes to be exactly approved from the master plan to God is hearing this.
Why not human beings?
We should have mercy.
We should be.
My message to everyone spread the word of not hate.
Tolerance, togetherness, mutual understanding, love and affection.
These are the key elements for a successful diversified community.

Um, I just want to comment on a couple of things that were mentioned.
Um, one, immediately we're jumping to uh the negatives and saying, you know, we don't want an alcohol store, we don't want a vape store in in that little area.
And I 100% agree with that.
I mean, I would hope anyone that is full of the zoning change would also be here if someone was trying to get it approved to have one of those stalls moved in.
Ultimately, I believe the plan is to have a uh uh establishments that are there that are in line with the comments that everyone is making that it's gonna be it's gonna be a reasonable amount of traffic, it's not gonna be something like a Walmart that pulls in a ridiculous amount of traffic, it's gonna be something that benefits the community and brings the community together.
So I don't want anyone to envision, sorry, I don't want anyone to envision that this is gonna be you know alcohol store, vape store, anything like that, because I don't think many residents in Murphy would would want that, and I don't believe that would be approved.
Um I also there was a comment made on these houses being available, I guess, to anyone, but then there was also the comment on this being a 550k uh 550,000 properties, and they were gonna be a premium product.
So that doesn't really go along with the narrative of this will be available to like you know, young families, new people trying to move in.
I mean, this is obviously going to be available to a certain income level, and it doesn't really fit the narrative of yes, it's gonna be available to any income level, it's gonna be available to any any group of people, young families and everything like that.
So I just wanted to put to point that out.
Um and the other thing I would say, you know, there's there's a lot of comments pointing back to what had been approved in the past, and things do change.
That was mentioned earlier.
You know, right now we're evaluating what is best for our city at this given moment right now.
Um, and it may have been perceived in you know, prior years that there was a that this was a benefit to the city at that point in time, and right now, you know, reverting back to the commercial space is considered to be appropriate for for what's best for the city right now.

Uh my comments will be opinionated commentary.
I've watched this individual uh buy land and come before the PC in the council many, many times.
And there's one recurring thing that I hear.
I want, I want.
We live in a capitalist society, and there is another option available to him.
He can sell the land to an LA developer and still make a profit.
It doesn't have to be what he wants specifically.
I encourage every council member to find the courage, to find the wisdom that benefits the city for the long term.
This will impact me, even though I'm not within 200 feet.
But I see the positives.
And I like to piggyback off my fellow citizens' comments.
Let's be positive.
Let's be entrepreneurial about what can go there on the on that lot in terms of commercial properties.
Let's not be so negative.
Where is the American spirit here?
Let's find that.
Let's reignite it and put the right business there for our business for our community, for our city.
Council members, find the courage.

So uh I really like to address a couple of things.
Uh first is traffic issue.
Uh I uh I don't like doing this because as a property manager, sometimes I have to meet my my parking lot stripers and my power washers that power wash the oil slicks from parking spaces at three in the morning, four in the morning.
And and I learned something over the years.
Donut shops start at three in the morning.
They bring their crew in, they make their dough, dry cleaners turn on their boilers at 4 30 to 5 in the morning.
And uh so the the idea that there'll be less traffic is totally false.
The traffic in neighborhood services start sometimes all hours in the day.
Uh I built an ANA and I had a Snap Fitness, which is a 24-hour service where people go in with with uh a combination and they open and they do their workout.
No one present, a big big concern for police, and that's a 24-hour business.
Anytime fitness is another neighborhood service business.
Uh and and they occupy three to four thousand square feet, 24 hours a day business.
Uh getting into food.
We currently have uh in our portfolio that we manage, we have we have over a dozen restaurants, and the trend we're seeing is square footage are going down in restaurants.
In Murphy alone, you've lost you lost Christina's, you lost uh boomer jacks.
Dining rooms are going out.
Uh DoorDash, Uber Eats, Grubhub are picking up.
That's that's the new trend.
You know, COVID made that the norm, and uh, and it's not it's not going away.
Those drivers don't live in Murphy, they zoom in, zoom out.
Uh in our current management obligation, we have Pizza Hut Pizza Hut deliveries, we have dominoes deliveries.
Once again, those drivers are temporary workers, they come in, they come out.
So the the logic for traffic makes zero sense.
And I and I apologize if I if I seem rude to the AI CP that you guys have.
I have a lot of respect for them.
I've served in in several boards before and looked up to planners, but that is not true.
Uh traffic will definitely increase and it will increase all hours of the day.
Uh I don't live that close to there, so it's not bother me.
I live north of there on Parker Road.
The uh the other sh uh item that I'd like to share with you in 2003, I had the privilege to serve in Planning and Zoning Commission and Lucas, and we did the same thing at Parker and Country Club, and that was in 2003.
It's taken 23 years for someone to come and develop that that corner.
And Tom Thom was the one that made it possible.
They decided to go there.
There was uh a young lady that spoke about the new homes that Centurion is building on the South Fork property.
Uh and those are gonna be beautiful homes uh walking distance to where I live.
The the target neighborhood, the the target area, the market that they will be closer to than this intersection will be Parker and Country Club, where Tom Tum will be along with 45,000 square feet of neighborhood shop space.
So make sure you're cognizant of that fact.
You can't compete with demand generators and synergy that occupy 45,000 square feet where there's so much more choice for the Murphy consumer to go at go shop at.
They're not gonna remember that they have to spend their money in Murphy, they can go to Lucas and patronize the Tom Tum and the other shop, the 45,000 square feet of shop space.
So that's something to keep in mind.
Um at the end of the day, my message to you guys is I I trust that you'll be good stewards.
At the end of the day, we're we're temporary stewards.
We're not taking any of this property with us when we go.
Okay.
But while we are stewards, we need to make sure that we're doing the right thing.
Having three acres on the Southeast Quadrant and having three acres that Mr.
Syed has on the Northwest Quadrant is going to bring shop space.
It's not going to bring a demand generator.
It's not going to bring in Aldi or a Trader Joe's.
There's not enough room.
If you guys had five-acre corners, I would be all in support of neighborhood services.
You would bring in a demand generator that would support the shop space, the neighborhood services.
The neighborhood services that you guys are planning, I see it sitting waking for 20, 30 years, and I don't want to see that.
That's nobody wins in that situation.
Uh absolutely nobody.
You won't get your sales tax that you're thinking of.
Uh there may be super optimistic developers like Mr.
Syed that will buy and put up 8,000 square foot retail buildings, three, four at a time.
There's a lot of money floating around out there that wants to invest, but a vacant building does not help the city.
It it hurts everybody.
It welcomes crime.
And the final uh message I'd like to send with you or or share with you is you don't succumb to what PNZ succumbed to.
If you if you think that vision that the city planner or the planning uh firm has put up with you with the walkability, and and that's not gonna work.
Okay, it's it does it doesn't it works at Legacy West, it works at City Line because you have 2,000, 3,000 multifamily units.
You've got young people that won't do that.
Murphy is a bedroom community, and we have to face that.
One final word.
I as a courtesy, I turned in a co-star report uh that Jared mentioned, CoStar LoopNet is the same firm now.
Study that report, study the metrics, numbers don't lie.
Forty-five thousand square feet currently sits vacant in Murphy.
Uh Jared is right, there's only a nine percent vacancy if you combine all the big shop space, the Aldi's, the the Walmarts, the targets, the Lowe's, the home deep, they're all full.
There's no doubt, okay.
But when you add up shop space, the neighborhood services, the dentists, the tanning salon, the hair salon, the cleaners.
It's 21%.
It's 21 percent.
Straight average is 9%.
Montfee is 21%.
So you're I'm sorry.
One last thing I'll share with you.
In in the real estate world, there's a lot of crazy money chasing property.
Uh and if they chase that corner and put up more spec retail, we're all in trouble.

And I am still for the town homes, they would speak to mostly.
I think um buyers that are downsizing in these large homes and small homes to have a newer home.
But I'm speaking to you, not as a professional, but as a person also as a resident.
And I see the need for this, and I really am sorry that I don't agree with the majority.

So I didn't want to come back, but uh looking um just watching uh the same almost the same planning and zoning commission who approved this particular uh uh zoning uh area unanimously, a few years back, again uh setting it upside down uh unanimously without any discussion.
Just few questions were there from one uh one uh member, rest of the people were quietly just listening, no question uh and no um uh thought and no discussion, just the vote.
I was really surprised.
If there was uh if you are changing your vote, you have to give at least some reasoning.
Why did you vote it uh differently uh few years back, and why are you voting just reversing your vote without any discussion or without any reasoning.
So I would like uh just uh uh to uh say uh to the city council, uh same means most of the people who were there, uh because I have attended all those meetings and they were back and forth, and three, four meetings were there, and initially it was commercial, he was he proposed, and then I had uh objection, and then the planning and zoning commission had an objection, and then uh uh he came back and then initially he wanted to put some in the front uh commercial and then in the back, and then the same planning commission members opposed that and then wanted it to be a neighborhood uh all the residential area give uh giving the same concerns about uh about the traffic and all other things, and now today without any discussion, planning and zoning commission approved it.
So uh that's really concerning that le uh that uh raises a questions on your credibility and uh what exactly you are look uh uh you are uh voting on.
So uh I would like to watch how the how the city council votes on it.
Definitely it's uh any change in this is going to create uh uh whatever the decision I took based on uh your decision a few years back to in invest to build our home and to raise our kids in the neighborhood uh residential neighborhood, and is definitely if it's going to be commercial, uh you don't have to even think about the people who are in that area.
You have to think about the kids who go to the Murphy Middle School, Macmillan School who are going to be suffered by this commercial area.
Their future is at stake, and I would uh request uh the city council to consider everything, just not uh something specific which is which may be in uh someone's mind, but look at the future of all the kids who will be coming to Murphy Middle and Murphy uh and Macmillan School who are who whose life will be at stake because of this commercial area which you are going to propose.

You know, from my point of view, these things come up, and I'm gonna look at them objectively try to use critical thinking, you know, when I when I go through these piece of property for years has been um under discussion.
Originally, I think that this the four corners were meant to be retail, or they were meant to be commercial.
Um there was a reason.
Um there was a reason, you know, when when years ago when this developer brought this to us, it was there was a lot of things that were uncertain.
We didn't know about the South Fork property.
We didn't know it was going to be homes, and we didn't know what what was going to go on it.
Um, you know, so at the time when we council looked at this, you know, we we looked at objectively what you know what kind of looked good.
Um we you know work for the developer, you know, on that.
Times have changed, you know, since then.
Um and we have to look at it from a clean slide because so much time has passed, you know, on this.
So, you know, I trying to be objective personally, I'll make my list of pros and cons, you know, on this.
We've got you know, on one hand, we've got a high quality product that the developer has worked, you know, to put together.
Um that's a you know, that's one thing.
Um, you know, I'm I'm a little uncertain about we about some of the businesses that might go in there.
Although we do have this is a this is a planned development, so we are going to control what goes in.
There will be no big shops, there will be none of you know none of those those uh the things that were mentioned, you know, up here, you know, I've concerns about saturating the commercial market, but on the other hand, we're gonna be seeing a lot more traffic on Betsy.
We've got HEB coming in on the south, they're gonna be opening up McMillan, the McMillan bridges.
Suddenly we're gonna have all these people coming coming through there.
Um there's gonna be a lot more traffic.
Um allow us to capture some of that retail the of the people that are avoiding 544.
Um, you know, I I get it that Lucas, you know, has the development going up there, but that's for the local area here, including South Fork Ranch, what's going on up there.
I don't see why like retail does not I see that as something that they would that they would use.
Um personally, I've always had a little issue with the density of putting density there, the little wall of homes is not something that I've was really that interested in seeing.
I know we worked with the developer to try and have a nice product, but at the end of the day, it's all wall, you know, of homes.
Um I think to some of the residents' concerns about the residents and Oasis Springs, you know, that made an investment in building in Murphy.
There still is an empty lot in between those homes and what we're looking at here.
Um and also too, I think with the PD plans that we have in place, we'll do everything that we can to minimize minimize disturbance on that side.
Um that's just my pros and cons.
I have I wanted to share with the group because I'm I'm not I'm gonna think this through and make sure that a decision, you know, is the right decision for this.
I want to thank everybody for just coming out and speaking, giving your point of view, your opinion.
That helps.
It doesn't make it easy when you're sitting in this position to hear both sides, but I do appreciate that people providing their thought out, you know, how would impact them, how will impact the quality of your life.
Um having said that, um, as Ken said, you know, our city has changed, you know.
The sad part about this is that leaving this room tonight, someone is gonna be on what they consider the losing end of this.
But when we make decisions, or when I'm making decisions and thinking about this, I'm thinking about the future of our city collectively, us, our, because this is our city.
This is not just one group, one person, it is our city.
And so I think it's our responsibility to make sure that going forward, we're looking at this as a zoning issue, but I'm also looking at this as like planning.
Where do we see ourselves in the future?
Where do we see ourselves going from here?
So I'm gonna continue to mold this over.
Um, like I said, both sides of this have brought up great ballot points.
One of the things that I want to make sure that is that you know, my kids live here, I live here.
I would not want to live anywhere where there's vape shops and things like that.
So I would hope that you guys would know that we wouldn't allow something like that in our city.
You know, that's not what we want to see here.
This is of course, as you say, family first, that's how we will keep it.
Um, and just know that when, you know, and I'm just gonna speak for myself, you know, maybe I think for everybody else up here too, but when we make these decisions, we're thinking about everyone in the community and how it will impact everyone.
And so we want everyone to have a great quality of life.
We want to see our community continue to thrive, uh, be fiscally responsible, um, have great places for our families to gather, so that's not just residential.
Um so um just know that these aren't decisions that we just take lightly um and that you know we're trying to change with the wind, you know, and I can see how that can come across, but I want to make sure that we're making the right decision for everyone here, um, and like I said, for the future, how we're gonna plan to build from here on out.
So we continue to mull before we had to make this decision.
So I have a couple of comments as well, and really echo what Janine said about just being a difficult decision here for us, especially so passionately.
Um again, we're residents as well.
Um, I live on that side of town, I live in the Maxwell Creek neighborhood, and one of the things that I think about a lot is that 90% of the services that we use, we have to go to 544.
And for me, taking it somewhere that I can bike really quickly from my house, and a kid could bike really quickly from the house, whether it be a coffee shop or a restaurant, not a bake shop.
Um, you know, I I see a lot of appeal in that of having something close to me that first of all I don't have to drive the 544, and second of all, might not have to drive it all.
Um when we have talked about the master plan, there's been a lot of discussions around well-based development and walkability to things, and we all know traffic is a problem in this city, and a lot of creative thought has to go into some somehow how to offload some of that.
And I I do think having small pockets of services that's that do more serve that area, whether it be the new houses in Parker, Rolling Ridge, or Maxwell Creek or the ranch, you know, I I do think there's value in that.
And as Ken mentioned with the Escrave opening up on McMillan, they're good.
Betsy and McMillan are both going to be much more of a thoroughfare than they have been historically, and there's an opportunity for us to capture traffic going through there that want to avoid 544, and then they're going through there where can potentially diversify some of our tax revenue.
So I think about those things.
I I am sympathetic to the people who live right there, but also as Ken mentioned, there's there's a property between those.
There is um, you know, and that entire corner isn't residential anymore.
We're having a big mosque put in, which changes the feel of it to a certain extent as well, and we could capture traffic from those people as well if we have services right there for them.
So I don't know, those are just my thoughts.
So this comes down to me uh what for the town that I've been on California much less this last term.
We've spent a lot of time focusing on a strategic plan for the long term for this city of Murphy.
What we believe and what we think is that we want that the citizens want, and that involves town hall meetings.
There's been a lot of input to the city.
We developed this strategic plan as a master plan, and this is what we feel is the best way to move forward in these particular areas.
And so for me, I feel like it is a uh something I've been a part of and watch go through, and now uh uh I think it's just fulfillment of that to what the city and the residents of this city want.
Everybody that's talked tonight about how long they lived at the city 13 years, 15 years.
I applaud you.
I have been in this city for 54 years.
I moved to this city city when it was a rat hoe with a mom hall grocery store at the corner of what is now 544 in Murphy Road.
I have seen tremendous improvement in those 54 years, and I still enjoy living on the property that I bought then just as much now as I did 54 years ago.
I think we're heading in the right direction with the master plan, and I'm on I'm on board.
Yeah, I just want to say that the master plan needed to be updated.
It was from 2008, and so the time was right, we have very limited land left in Murphy, and so I think it it was very um the timing was right in order to do this so that we can make sure that we have the best use of what the land is available.
I do believe this is the highest and best use for the land based on 2026 U.
So that's my opinion of where we're going with what we're proposing on this piece of property from mod 11.
So I just feel like that's where I kind of stand.
I echo Ken, you know, weighing out the pros and the cons as far as like which way, but um this is just what I feel for the uh the best use for that piece of property at this point.
Oh I'm not gonna go long on this.
Um I remember uh when we were building uh the the stuff that was in uh next to the 7-Eleven there, uh my kids who are young at the time asked, you know, is there gonna be anything interesting?
Are you people um coming over?
Is there gonna be anything interesting?
And uh that it's always been leased out, I think they're very successful, but nothing really interesting for uh you know uh 13-year-old kid riding their bicycle to go visit.
Um so and this is this is a question that you get kind of holistically in the area.
There are real hopes that we that something like that can happen uh in this space.
Uh we've got a lot that's happening on North Murphy Road.
Uh it's now gonna collect connect directly all the way up through Angel.
Uh and we've got a lot happening going on uh that's E Road, but it's gonna connect all the way out to uh to Wiley.
Uh and these are gonna become more and more kind of collectors or Broadway type collectors that are gonna provide traffic.
So it's a unique position, a new unique place.
Really didn't exist five years ago.
So we know that this was a tough one.
I knew this was gonna be a hard conversation.
I know there's some expectations that are uh that are being gosh uh, and I truly don't know how the vote's gonna go.
Uh but that's those are the reasons that uh, you know, taking a step back looking at the realities of 2026, looking at what's kind of developed in the area and how our future land use looks holistically, which is what we tried to do looking across all open uh properties within the city on how we manage what little remains is how this ended up on the list.
Um and so for that uh I will call for a vote for a motion on the Senate.
Uh city initiated zoning change for 3.221 acres of property located at the southeast corner of North Murphy Road and Betsy Lane and legally described as lots 123 block A Oasis Plaza.

Hold a public hearing and consider andor act on an ordinance to approve a city-initiated zoning change for 11.56 acres of property located at the southeast corner of Citigall Circle and North Murphy Road, and legally described as track 12 abstract A, 0582, James Macwill survey, and lot one block A, Murphy Municipal Center.
Again, this is your final uh agenda item for tonight.
Uh so again a city initiated rezoning request.
This is two tracts of land that are directly south of where we are uh tonight.
There's a seven and a half acre track that's directly adjacent to us.
Um that is owned by the developer of the of the previous track.
Um and then there's an ad then there's an additional almost four-acre track there that uh sometimes affectionately it's owned by the city of Murphy.
It's sometimes affectionately known as Mount Murphy because it has the uh all of the uh surplus dirt from different uh public works projects.
Uh so this overall rezoning is for both of those tracks.
Um you can go ahead.
Um so overall that's 11 and a half acres.
Uh this is the concept plan for that seven and a half acres that was previously approved uh in 2022, uh June 2022.
Uh that was for 53 townhomes.
So like the other one, uh like that we previously did a portion of this property is not in compliance with the previous concept plan.
Um and that is the city owned track, which is different this time.
That city on track uh was was not in compliance uh with that previous plan, and it's not in compliance with the new master plan.
So this zoning change would bring both of those tracks uh into compliance with the new master plan.
Um again uh following that local government code, uh section 2011 2110404.
Uh so that our zoning is in compliance with the new master plan.
And similar comment is last time that uh upzoning to commercial and mixed use typically increases the land values.
Um there in your packet was a fairly extensive set of planned development regulations, uh, along with um you saw these uh exhibits and renderings uh at your joint work session a couple of weeks ago.
Uh it's envisioned as uh a mixed use area that can have several options from uh offices and retail in the front, potential hospitality hotel use uh in the front, and then um potentially some brownstone townhouses in the back.
And then can you flip to the next concept plan, or it can be interchanged and become uh kind of an office campus.
Uh again, all of these kind of pieces can be mixed uh around and interchanged with each other uh to create a cohesive uh town center environment.
Uh there's even a special set of uh good grief, I just lost what they're called.
Um development standards.
Well the development design standards, sorry.
Uh so the development standards that's the PD uh requirements that outline all the different land uses that are allowed.
And what is unique to this and unique to Murphy uh with this particular development is the set of design standards that's included that'll govern the architecture uh of the buildings that would be built on the two tracks of land.
So um I know it's been a long night, so I'm not gonna bore you with any additional information.
I'll be happy to answer any questions that you have related to this uh zoning item.
And this one I don't believe on public comment forms.
I don't know if we have a total in that, but I think the majority of these, I believe the majority of the reply forms on this were in favor of the zoning change.
I have one question for you, Chair.
Um the entire pack, and I assume that the not only is the zoning map being changed, but also the use description and all that, all of that depending on what we do.
The one question I have for you is on page 28.
Where did we come up with the arbitrary number of 65 roundstone units on this property?
That's who's responsible for this number because it's always been about density.
Murphy isn't that number um was was drafted already in our previous director.
And that was the number of units that were able to fit um within that area.
Uh that would be the match unit.
It is something you can obviously.
Yeah.
So that would be at the whole thing where not this mix and match that you're showing.
No, the this is all that area in gold and yellow that is 68.
With the new planning on this, we're we're protected from lessons learned over a lot of years.
We're protected with a lot of very good SPPs on this, and I would assume.
And the there is an SUP.
It is a case by case.
None of the residentials allowed by right at all requires an SUP.
So the process could not be developed in S U.

So I'm really excited about this part of it.

Um, the master plan when we spoke about it last time.
You know, I see so much opportunity in this area, and you know, having since we don't have a downtown, it's kind of serving as our rule, I guess, downtown, I guess, um, small town downtown.
Um, and then also tying that with uh property across the street to make this more cohesive.
So I think it's fabulous.
I would love to see what we come up with that.
Um, but yeah, I'm in favor of it.
I'm also really excited about this.
I mean, we've seen cities around the Metroplex create a downtown or revitalize their downtown that had become sort of nothing really add a lot of character and interest into their town, and I'm I'm just really excited that through the master plan and taking that step back and looking that we've brought this opportunity forward.
And as well, I think it's uh a great uh great addition to Murphy.
I think it's a lot of work has been put into this, and certainly certainly in favor of this.
Well, like you know, Andy said he's been here 50 something years.
I've only been here half that amount of time.
23 years.
But I was excited 23 years ago when I moved here, and that was all gonna be town center.
Yeah, yeah.
And so I know the economy ebbs and flows and and kind of what our future looks like changes, but I'm glad that we're going back to something that's mixed to use.
It could be something that's very vibrant and such a good thing for the city.
That's all it ties back to our strategic initiative of character and uniqueness that we were talking about a year ago.
And I also think walkability and connectivity two things that will come out of this being a town center versus the original idea.
That's a really good point, too.
Okay, Ken's favorite uh uh never drops it idea of the potential of a dark line dart station there, too.
I'd like that that's open.
It's open for discussion for future citizens of Murphy.
That we won't be making a decision that precludes that.

The City of Murphy held a joint meeting on March 10, 2026, at 6:00 p.m. to consider the adoption of the 2026 Murphy Master Plan and two city-initiated zoning changes. After a public comment period and executive session, both bodies approved the master plan and the rezoning of 11.56 acres near City Hall, while the rezoning of 3.221 acres at Murphy Road and Betsy Lane was approved by the Planning & Zoning Commission (6-1) and later by the City Council (tally not specified, but a supermajority was required). The meeting adjourned at 8:34 p.m.
Public Comments & Testimony
- Item 6A (Master Plan): One speaker (Jazz) requested more detailed presentation materials for the public, noting that the slides shown were not sufficiently explanatory.
- Item 6C (3.221 acres – Murphy Road & Betsy Lane): Numerous residents and property owners spoke. Opponents included:

- Several other residents expressed concerns about traffic, property values, and potential nuisance businesses (vape shops, etc.).
- Supporters of the rezoning included:
- Valita Logan, Michael Padilla, Bentley Vergeese, and others who argued that commercial development would diversify the tax base, provide walkable services, reduce traffic from residential density, and implement the new master plan.
- Item 6B (11.56 acres – City Hall Circle & Murphy Road): Only one speaker (Mary Pat Elliott) commented, expressing support for the mixed-use town center vision.

- Item 6A: Adoption of 2026 Murphy Master Plan – Abra Nesser (LJA consultant) presented the 15-month process: community forums in July and November 2025, updates to future land use including a new Murphy Opportunity District (MOD 11) at the southeast corner of Murphy Road and Betsy Lane.
