Meeting Transcript
All right, good afternoon. I'm going to call this meeting to order. This is a public hearing of the Metropolitan Board of Zoning Appeals, Division 1. I am Peter Nelson, Chairperson of Division 1. I am the only board member present today. Senior Counsel for the board today is Chris Steinmetz. Staff members present today from the Division of Planning are Eddie Onea, Principal Planner 2, Robert Ulenhaik, Senior Planner, Noah Stern, Senior Planner, Kaya Mullins, Associate Planner, Desiree Iricozi, Principal Planner, Marty Weiste, Senior Board Specialist and Secretary to the Board. The board has copies of the zoning ordinances that'll be incorporated by reference into the record of each case heard today. Anyone at this hearing who thinks complete and proper notice hasn't been given and would like a petition continued due to lack of proper notice must bring this matter to the board's attention at the beginning of the hearing. Please be advised that contacting members of the board regarding a matter pending before the board outside of this public hearing is prohibited. It does require three votes to take action on any request. So unfortunately, today we cannot hear any of the cases and take action on them. So the board will consider transfers and or continuances in the order that petitions are listed in the agenda. If no request is made regarding a transfer or a continuance of a petition, all of the petitions will be automatically continued to the March 4th hearing. Is there anyone in the audience that has any questions about our procedures today? All right. There being none if there are any transfer or continuance requests, I'll hear them at this time. Thank you, and good afternoon, Chairperson Nelson, Joe Calderan, 11 South Meridian, Indianapolis. I represent the petitioner in 2025 DV2 or DV1002, 8751, Michigan Road. Uh with no additional notice. All right. Is there anyone in the audience with interest in 2025 D V1002 regarding the transfer to the February 11th hearing? All right, staff. Is that hearing date okay with you? That works with staff. All right. There's no action today, so we will consider that transferred to the February 11th hearing. Thanks so much. Harley means uh counsel for petitioner in 2024 DV1045 as indicated on the um meeting agenda. We'd ask that that uh matter be continued to the March 4th hearing date. Anyone in the audience with interest in 2024 DV1045 continuance to the March hearing. And staff, are we okay with the March transfer or continuance? Excuse me. Yeah, thank you, Chairperson Nelson. Uh staff has no objection. All right. We will then consider that one transferred to the excuse me, keep saying transferred, continued to the March 4th hearing of Division 1. Thank you. Good afternoon. My name is Kevin Buckheit. I'm a planner with the law firm Craig DeVault here as agent on behalf of the sixth item on your petition, number 2025, DV1001 at 4235 East 46th Street. Have two requests before you if you can um handle those today for us. Um the first would be uh a transfer to next week's division two meeting. I'll let you address that, and then I have the a quick second request on notice. All right. Um anyone in the audience with interest in 2025 DV1001 with interest in the transfer request to the February 11th hearing of Division II. Seeing no one's staff, are we comfortable with the February 11th transfer? Thank you, Chairperson Nelson. Uh staff has no objection to the transfer. All right.
