He acknowledged the petitioner was a good neighbor but noted the business activity had increased.

- 2018-DV2-048 (4405 and 4505 West 96th Street): Falcon Realty LLC requested a variance to build a 14,629-square-foot addition to an auto dealership without installing sidewalks, citing safety concerns and lack of pedestrian activity on the heavily industrial corridor. Petitioner Fernando Falcon and attorney Andy Baroker argued the area is not pedestrian-friendly and that sidewalks would be impractical and dangerous. Staff recommended denial, stating the site has no extreme difficulty for sidewalk installation and that sidewalks would provide safe pedestrian access for workers and future commercial uses. This is the public hearing of the Metropolitan Board of Zoning Appeals, Division II. I am Mark Young, Chairperson of Division II. The other board members presence are Alicia Ruder and Margaret Banning to my left. Mary Kelly and James Duke to my right. Legal counsel for the board today is Chris Steinmetz. Recording these procedures today is Ryan Hampton. Staff members present today from the Division of Planning are Heather Stefan, Senior Board Specialist and Secretary to the Board. Larry Callaway, Principal Planner 2, Robert Ulanhake, Senior Planner, and Paige Story, Senior Planner. Keith Holwart Holdsworth is the current planning administrator. The board has copies of the zoning ordinances that will be incorporated by reference into the record of each case heard today. Those who intend to testify will please remain standing and be sworn. Petitioners should be on your left and remonstrators on your right as you face the board. Those who testify will state their name and address for the record before beginning to testify. Petitioners and persons appearing in support of the case being heard shall have a maximum of 15 minutes for presentation of evidence, statements, and arguments in support of the petition. A person may file a wit and request to receive notice of a filing of a petition for judicial review of a decision of the board. The written request must be filed within five days of the board's decision and must include the person's full name and correct mailing address and a reference to the board's petition number.
