The Indianapolis Board of Zoning Appeals Division Two convened on April 9, 2019, with Chairperson Mark Young presiding and board members Alicia Ruder, Margaret Banning, Mary Kelly, and James Duke present. Consent Calendar / Administrative Actions
- Case 2018 UV 2025 (2940 Cold Spring Road): Marion University, through representative Roger Kilmer of Ice Miller, requested withdrawal of its variance petition because the university now intends to pursue a rezoning. The board approved the withdrawal and authorized transfer of the already-paid variance filing fee to apply to the future rezoning filing fee. Staff supported the request.
- Case 2019 UV 2005 (6158 West 10th Street): The board continued this petition to the May 21, 2019 hearing to allow time for proper notice. The motion included additional notice.
- Case 2019 UV 2001 (1151 West Thompson Road): At the petitioner's request, the board continued this case to the May 21, 2019 hearing without additional notice.
- Case 2019 DV 2003 (1140 Ohio Street): The board acknowledged a timely automatic continuance filed by a registered neighborhood association.

I am Mark Young, Chairperson of Division Two. The other board members present are to my left, Alicia Ruder and Margaret Banning, and to my right, Mary Kelly and James Duke. Legal Counsel for the Board today is Chris Steimens. Excuse me. Recording these proceedings today is Ryan Hampton. Staff members present today from the Division of Planning are Heather Stefan. Senior Board Specialist and Secretary to the Board. Larry Callaway, Principal Planner 2. Robert Eulin Hake, I'm assuming we'll come up later. Senior planner and page story, uh, senior planner. Keith Holesworth is the current planning administrator. The board has copies of the zoning ordinances that will be incorporated by reference into the record of each case heard today. The proceedings of this hearing are governed by the board's rules of procedure. The expedited cases will be heard immediately after all requests for continuances or withdrawals. As each non-expedited case is called petitioners or remonstrators interested in that particular case will please stand. Those who intend to testify will please remain standing and be sworn. Petitioners should be on your left and remonstrators on your right as you face the board. Those who testify will state their name and address for the record before beginning to testify. Petitioners and persons appearing in support of the case being heard shall have a maximum of 15 minutes for the presentation of evidence, statements and arguments in the support of the petition. Remonstrators and persons appeared in opposition to the petition shall have a maximum of 15 minutes for the presentation of evidence, statements and arguments in opposition to the petition. Staff will then present the administrators' comments regarding the petition. Please limit your testimony and evidence to the matters covered in the statutory requirements, which must be met in order for the board to grant a variance. A person may file a written request to receive notice of the filing of petition for judicial review of a decision of the board. The written request must be filed within five days of the board's decision and must include a person's full name and correct mailing address and a reference to the board's petition number. Forms are available and may be obtained from the board secretary. Please be advised that contact the members of the board regarding the matter pending before the board outside of this public hearing process is prohibited. Good afternoon, Mr. Chairman, members of the board. My name is Roger Kilmer. I'm a land use consultant with Ice Miller, offices of one American Square, Indianapolis. Draw your attention to the first case under continued petitions today. Case number 2018 UV two zero two five. I'm here representing Marion University, the petitioner on the case. Petitioner's desires and long term for the long-term use of this parcel have changed, which has resulted in two items I need to bring to your attention. First is that we are going to be withdrawing the variance petition as we are now going to be pursuing a rezoning of the property. And the second item is that we would request that the board approve a transfer of the filing fee that was paid for the variances to be applicable toward the filing fee for the rezoning.
