34:25So you you're the one that needs to check the ID.

34:31They but there's a requirement to have an employee permit if you're checking and verifying age.
34:39So they need to have they either, if they're not going to serve the alcohol and have an employee permit, whoever's acting as that server, which would be you, you you're the one that's required to check the ID.
34:52And in regards to that, the report says that they didn't check at all.
34:57So he didn't even attempt to check.

35:04So you say that that your employees now, you're the only one that has a permit and they don't have permits.

39:53Yeah, so Clark Kirkman with Clark Quinn Law on behalf of Indianapolis Burn LLC with me is uh the general manager, Julio Galvan.
40:00Um in September of last year, they received some a violation.
40:07The main the there was some signage issues, minimum food.
40:11The main issue was one of their managers had had her employee permit revoked, and they were that the business was unaware that that had happened.
40:23And in the incident report, it actually says that she was told by another member of the Indiana State Excise Police two weeks before that it had been revoked.
40:33She just didn't tell business.
40:35Um causes someone to have their license revoked.
40:42So I will say that we actually just were visited by XIS on this past Friday as part of the detail, and um Leo had put together their binder on you know there.
40:59Um had all the minimum, you know.
41:01So basically the the issues that they they checked all the issues that had been in this you know year ago violation, minimum food signage, and um I have pictures of the signage if you want to see it, but they received no no violations.
41:15It sounds like it was a quick visit.
41:18How so in this case it was the manager that didn't have their employee permit.
41:23I mean, typically managers are the ones checking the other employees.
41:26Who checks the manager?
41:28Uh the general manager, this person was the bar manager at the time.
41:33She used to be a former bartender, and she made us aware that she wasn't gonna be able to serve alcohol because we were only told that she had two uh OWIs, but actually there was a third one that was pending.
41:51So we decided based on the information that we had to put this person as a manager that we were wrong because she didn't have the qualifications and the requirements by law to hold that uh position.
42:09Uh once we receive that violation, we look into moving her uh into the humidor management, but then we were told by excis that because the setup in our establishment, she has to go through the bar, you know, around that, and that couldn't be you know an option.
42:33So we ended up letting this person go uh a year ago.
42:38So now everybody has all the correct paperwork?
42:41Yes, everybody has that.
42:43Um we've been facing some safety issues in the area, and um we you know we knew that we eventually they were gonna visit again, then we needed to have the food requirements and the signage and another great step that we took uh on is requiring everyone to retake their training uh for alcohol serving, which at the time there was confusion because we thought that that was only one time that you need to take in order to get a liquor license, but then we find out that you have to renew that every three years along with you know your liquor license.
43:23So everybody was required in the last few months to do that, and it is great because now they are aware that any time that there is a violation, you don't it not only affects the business, but it affects them.
43:38So when it comes down to any violation on their personal licenses, um there can be up to termination for them because they can lose their license for a while.
43:50Um we because the nature of our business is smoking, so you uh need to be 21 to smoke, and you need to be 21 to drink.
44:01We also run security there to a busy night.
44:05I have up to six guards, so there is two people at the door checking IDs.
44:10Then we also found out that even if they are checking IDs at the door, they still the servers are required to check IDs again to serve alcohol to anyone that appears to be less than 40.
44:22Um so anyway, it was just great for us to make everyone aware of all the intrinsics of serving alcohol and certainly uh the smoking in addition to that.
44:35Um and and just so that you're make sure that you're aware, there was a recent law change that requires the the dorm and that are checking IDs, they also have to have a lot of people.
44:44Right, and and I do have also all their licenses in here.
44:48We were made aware of that about I would say three, four months, and uh and and all the new guards are required to have their license or the alcohol training along with us.
45:01And I do have the things.
45:03On the on the food piece, can you talk through that?
45:06Because I've been there.
45:07Sometimes I got food, a lot of times I don't.
45:10So we don't what is this?
45:11So technically we don't serve any food, right?
45:14We allow food to be brought from the outside, but by law we have milk, we have soup, marchan, and uh you have some throw some pizza.
45:23So it can be served at any time.
45:26You have over 25 servings at any point of any of those in the past that has been abundant.
45:33Yeah, so could we because technically you're a restaurant, it's a restaurant permit, you're required to have food required to have that available and serve it if it's asked for.
45:42So you you've got to have that, not only just have it there, but if someone asks for it, you have to be able to provide that for 25 people.
45:53And you can have the food trucks all day long in addition, but you have to have that minimum requirement.
45:59Yes, and um I would have the pictures of yes, there has been some incidents in the bus with the uh amount of food and you know, location was expired.
46:11Whose responsibility is it now um to make sure that you have enough food in there and that it's not expired?
46:19Sure responsibility.
46:22You there every day?
46:24Uh no, I'm there five days, and then I have a water manager and a humidor manager.
46:29And they are aware of all these procedures as well.
46:32So on the last visit with exercise last week, I wasn't there.
46:36There was my humidor manager, and he was able to go through all the information with the officers.
46:42And they didn't have any issues when they were in we had a great visit.

48:53Would they get the employee acting without the permit for that, or is it does it come down to if they're acting without a permit, that means your permit was either they didn't have one or it was expired or revoked?
49:10So what we have here is employees acting without a permit.
49:14Um we've got two, so we've got two separate violation reports.

49:20Because the only one that was coming up in the search was the gaming.

50:00There was a there was an invoice um that was sitting at the TikTok lounge from um Bigsies and they just violated us for sharing of the alcohol.

55:18So the license was expired, so you couldn't purchase because the wholesalers wouldn't deliver to you.
55:23So you purchased from you purchased beer from a store?
55:29No, she's I don't think that's what she means.
55:31I think it's like she had already had purchased uh enough before.
55:37So she just shut down after that.
55:39Uh when when the violation occurred, she just sat down after that and then so she's just reopened her backup once you go to the extension, uh once you go with the extension uh approved.
55:49And uh so she still has inventory available to sell.
55:53Okay, and you have those invoices showing where you bought the beer from.
56:02And then you've got a patio that was not on your floor plan.
56:08That was another issue.
56:10Did you add a patio to your to your restaurant?
56:15But we put it there.
56:20Um but I thought uh yeah, but they they were not they just had it, they had it out there, but they're not selling alcohol out there.
56:34Well, they're can't have it if it's not a part of their original floor plan.
56:38That's why it's on the list of violations.
56:42So they're not going to be able to do that.

56:48No, the patio is not part of the the floor plan we can.
56:53See, when I wanna electron, then they call it.

57:14So that I guess the question is does it have to be included if they're not gonna be selling alcohol out there?
57:19If you're not serving alcohol out there, then it does not have to be on the floor plan.
57:24But the you know, the I'm looking to see something like one that's I because the issue was in the violation report is you don't have carry out and and one of the officers was allowed to carry beer out onto that I think onto that patio.
57:49So um I mean you have two options.
57:53Either we can get the patio added to the floor plans as long as it meets the requirements, and then you don't have to worry about that.
57:59People can actually go out there and drink beer.
58:02Or you're going to have to be very diligent about it and not let anybody out that front door to go out there with beer.
58:10I think it's yeah, I think it's the uh I think uh just because of uh and it's it's a training issue.
58:16So whoever's in there right now knows nobody leaves out the building without within any alcohol.
58:21I think it's there's so much traffic out there, you you have to be required almost to put a barrier to to prevent the public, then the the sidewalk just becomes impossible then.
58:33Yeah, I'm sure I I vaguely remember.
58:35You kind of vaguely remember that it's so expensive.
58:39Yeah, it's what's to do with the patio.
58:41So yeah, we so they have like you know a chair outside, people who sit down out and do whatever, but uh as far as it being uh you know safe to sell alcohol is another easy altogether.
58:52Because like I say, yeah, they have to have put um barriers out there which which won't interfere with uh you know public truck.
59:01So what was the thought process behind adding the patio to begin with?
59:05Because it sounds like a headache, honestly.
59:09So what was the thought process when you first put it there?
59:14I mean I I could speak to that because I was there.
59:16Um it's just the whole atmosphere.
59:18It's it's up here in front of Farn Square.
59:20So the whole atmosphere was that it was just facing people outside, right?
59:25So people want to eat their the stuff outside, so just a few chairs outside and some of the other uh businesses around the way have the same kind of uh atmosphere, now whether they sell alcohol or not is another easy, but uh you know, you just the atmosphere outside was the same way.
59:43Yeah, and we're not talking about a large patio, it's just a couple of tables and chairs.
59:48I mean, you think about a store, a guy just brought out a chair and sat out.
59:52I mean that's basically that's what it is.
59:54And it wasn't, you know, and that's like I said, I told them that's just no way that we are gonna be able to block the street to be able to make it, you know, presentable to be able to sell alcohol.
1:00:09See most of those button or looking at yes, and that's exactly what we're talking about.
1:00:17So yeah, so we have a few, you know, just make it look a little bit more you know, inviting.
1:00:22Uh but really it's more cosmetic, and I don't think it's going to fit the criteria for an area for sounding alcohol.
