Welcome to the City of Johns Creek Board of Zoning Appeals meeting for May 2026. The meeting will now come to order. Let the record show that we have a quorum. All members are present. I'm glad to see everyone here. We have our agenda for the current meeting and the minutes from our meeting in April. If all members have had a chance to review any changes to the minutes or agenda or a motion. I'll make a motion to approve the meeting. Mr. Talibali has submitted a motion. All right. Everybody in support of the motion, please say aye. Aye. Any opposition? The meeting minutes and the agenda are approved as presented. For the public hearing portion tonight, we have one case. After the staff presentation, the applicant will have 10 minutes to present their case. Any opposition will have a total of 10 minutes. If the applicant does not use their full 10 minutes, the remainder can be resolved for rebuttal. Anyone that wishes to speak should step up to the podium. Our first case out case tonight is V 26-0006. We will begin with the staff's presentation. Good evening forward. And it's located at 4810 Johns Bridge Udo Drive. The subject property is located within Transbridge Ud subdivision. The passage size of this lot is 0.235 acres. And zoning is R4 single family residential. With auditional single-family homes in the Roswell Mill subdivision directly to the north. It is shown on the survey. While the two images at the bottom shows the extended home. And this case was later brought before the Johns Creek Municipal Court. On February 24th, 2026, the court ordered the uh property owner to apply for a variance to request for the unpermitted home audition to remain in its current location. The applicable code requirements come from City of Transcript Code of joining ordinance. According to Section 6.6. The development standards state that the minimum rear yard is 25 feet. Here is the side plan. Is the 25 foot rear yard setback? And the property in blue is a home proposed home audition encroached into the real yard setback. And the variance request tonight is to allow 9.8 foot encroachment into the 25-foot rear yard setback to retain a home audition. The home audition resulted in approximately 122 square feet of encroachment within the real yard setback. Variance review criteria. According to tuning ordinance section 22.3.1. There are two considerations for granting a variance. A relief, if granted, would be in harmony with or could be made to be in harmony with the general purpose and intent of the zoning ordinance. Or P the application of the particular provision of the zoning ordinance to a particular piece of property due to extraordinary and exceptional conditions pertaining to that property because of its size, shape, or topography, would create an unnecessary hardship for the owner while causing no detriment to the public.
