to order um a pc meeting for november uh 13th at 545 um if you could call row please or everybody oh it's ready just acknowledge your presence you got me up here i it's still not pulling up behind me down can y'all do me down there if you just I did I think it worked okay okay moving forward um first item on the agenda is uh approval of many minutes from the previous meeting um is there any comments on that or do I have a motion style motion to approve styling second roll call on that one uh you can just a voice vote yeah okay all those in favor yeah all right aye the same we can vote on okay let's go ahead and do that okay sorry yes ma'am just tell me what paper aye okay the meeting minutes passed okay first item on the agenda is a final subdivision plan for the uh applicant of Travis McAllister is requesting approval for frog pond subdivision of 24.81 acres proponent uh good evening mega mallister uh with McAllister engineering seeking approval for a final plat for frog pond subdivision okay thank you city planner uh yes sir we have reviewed it this is for um it's zoned R1 is 24.81 acres uh there are 39 lots they have met all the requirements of the subdivision code all improvements are done both lifts of asphalt are down and we do have a maintenance bond so we would recommend approval okay commissioner comments anybody ready with the motion make a motion we approve forward second we have a motion and second if you could please record your vote until I don't vote I was pushing the wrong button I'm sorry your final subdivision has been approved thank you thank you next item is uh rezoning's first rezoning request is RZ 2515 uh shamin Wilkins is uh requesting rezoning for the property from I I'm assuming that's probably I one I1 to C2 at 213 North Main uh proponent this is Sammy um I'm uh helping him okay basically if you just state your name and then tell us what you're wanting to do uh my name's Wade Gay uh what we're wanting to do is we have a piece of property that's is the uh red brick building we we've got it surveyed off it's it's already it's not moved the lines or anything like that it's everything out there is industrial and we're wanting to make it C2 because what we're trying to do the building already has six parking places has six doors and we're wanting to remodel the inside as far as paint and flooring and add two showers to the two bathrooms inside we would like to bring it in as a short term rental property because of uh what he does as he brings in uh contractors a lot of times they'll bring in crews and uh they rent from him basically they lease the the building while they're here in Jonesboro working uh the building itself has not had a tenant in five years while it's uh previously uh industrial one and so we're hoping that uh uh by making this it would also give us some different uh avenues if if the rental part of it doesn't pan out on a C2 but uh we're wanting to uh help the area the area down there is kind of depressed in there it's got a lot of rental it's got a lot of um duplexes residential uh uh rental properties in that same area and uh we have

5:00

While it's uh previously uh industrial one, and so we're hoping that uh uh by making this, it would also give us some different uh avenues if if the rental part of it doesn't pan out on a C2, but uh we're wanting to uh help the area, the area down there is kind of depressed in there.

5:15

It's got a lot of rental, it's got a lot of uh duplexes, residential uh uh rental properties in that same area, and uh we have sent out the designated amount of uh registered letters.

5:34

We do have the sign up down there stating that we want to rezone, and uh basically I think it'd just be a uh improvement on the property itself and the area, it would benefit the area.

5:49

I don't think that we'd would have to go into a traffic situation or anything like that to to do this.

5:57

Okay, thank you.

5:59

Um City Planner, you have any comments on that?

6:02

Yes, sir, we do.

6:02

We've reviewed it and um it meets all the six criteria for rezoning.

6:10

Um so we would recommend approval with uh the following stipulation that the proposed development shall satisfy all requirements of the city engineer, satisfy all requirements of the current stormwater drainage design manual that density shall not exceed lot maximums that the applicant agrees to comply with recommendations for right-of-way, and that'll be okay.

6:37

Before we go to the commissioners' comments, this is a rezoning request.

6:40

Is there a body here from the public to give comments about this request?

6:47

I see none.

6:48

Uh commissioners, questions, comments.

6:52

I have a question.

6:54

Darrell, what does C2 say about residential?

6:57

I don't think he's talking a residential gym.

6:59

I think he's talking about not living there but having contractor offices there.

7:04

Oh so nobody nobody would be spending the night at this place?

7:08

Uh possibility they would be.

7:10

Okay.

7:11

I mean, if they they pull them in from different areas to come and work here.

7:16

Like kind of like an apartment.

7:18

Uh could be.

7:20

Could be used as an apartment.

7:21

Okay.

7:22

Yes, so short term.

7:24

It would almost be like an extended stay hotel.

7:27

Well, it's not big enough for that.

7:30

You know.

7:30

Residential is not going to be allowed in the C2 zoning.

7:33

Yeah.

7:34

It's not going to be allowed.

7:35

So it would have to be uh basically it would just be rental to the contractors.

7:41

They can keep they can have a contractor office there, they can keep equipment there, but they cannot live there.

7:49

They can't spend the night is what he's saying.

7:52

I got you.

7:53

They would have to have a sprinkler system as well, wouldn't they?

7:56

And it would be a different occupancy.

8:05

Is that inconsistent with the intent of this request?

8:12

The intent is to bring uh contractors stuff to the area.

8:18

When the when they build uh out areas here, uh they do have offices and uh some of them do have uh places to stay.

8:29

So you know uh if it has to just be for office purposes, I guess that that's the way we would shoot it.

8:40

So to be clear, what what Daryl is saying is that the rezoning request for C2, C2 does not allow for any overnight stays in the building.

8:54

Just to be clear, that's what we're telling you.

8:56

So in the article of what I read, that's why I was looking down for C2, it does state that short-term rental is um allowed.

9:11

Give us one second, we're going.

9:13

Yeah, I've got it right here.

9:18

I think there's something you could ask for that would allow for that, but it's probably not C2, I don't think that.

9:35

Uh the and the reason we did ask for C2 was because it was recommended that it would be more versatile.

9:46

You see it.

9:51

Maybe on the back.

10:04

Well, this I've got it, Mark.

10:07

Sorry.

10:08

Okay, that's part of it.

10:10

Where's the other part?

10:22

Anyway, C2 does show that it can be residential short-term rental.

10:29

That's what I was looking at.

10:31

Do you have it?

10:32

What is the article from?

10:35

From the uh zoning, the city zoning.

10:39

From the Johnsborough zoning.

10:41

Okay.

10:42

Yeah, I'm trying to find a proof.

10:45

We're pulling it up right now.

10:46

We'll okay.

10:47

But just give us one sec.

10:49

Because uh when I went in talking, I was talking, do I need C3 or C2 and I was recommended C2 because of that?

11:01

Yep.

11:02

Okay, so it is short-term rentals.

11:08

Is allowed in C2.

11:10

Yes, yeah.

11:12

It is on the chart.

11:13

So yes.

11:14

Okay.

11:15

There may be some additional building code requirements that's true.

11:18

With that when you're spending the night.

11:20

And they'll have I think you are going to have to have a fire spree.

11:22

They'll have to go through that as a go through the remodel process.

11:27

So just be aware that what we're voting on tonight is the rezoning, and and and there's there's criteria that will come if you try to do what you think about it.

11:40

Okay.

11:42

Any other comments?

11:46

Is anyone ready with a motion?

11:54

Little, I move to approve the rezoning.

11:59

Motion and second.

12:00

If you could please record your vote.

12:21

Okay, your rezoning request has been approved.

12:23

You'll need to get on the city council's agenda for the next meeting, which is next Tuesday.

12:32

Next Tuesday.

12:33

But would be what's the date?

12:35

So you you probably need to get with the city clerk or get with planning tomorrow to get on that agenda.

12:42

Oh, okay.

12:42

Okay.

12:43

It would be everything will be down there.

12:46

I understand.

12:47

I'm just wondering what her deadline is with this meeting being delayed.

12:51

She'll advise you whether you can get on the first meeting in December or whether it has to be the second.

12:57

Okay.

12:57

Um with this meeting being delayed from Tuesday to Thursday.

13:00

That may have missed the deadline for the city council meeting.

13:05

But she may have extended it.

13:06

I just don't know.

13:08

Okay.

13:09

Thank you.

13:10

Thank you.

13:10

Appreciate it.

13:11

Thank you.

13:14

Okay, next item is RZ25-15.

13:18

Um applicant uh Jen Scrambling Jr.

13:23

is requesting rezoning from the property from R1 to C3 at the 2000 block of West Matthews in Washington.

13:32

Proponent?

13:33

Uh yeah, this is Jim Graham.

13:35

Uh represent Andy Kraft and Ron Kraft.

13:39

Um this is uh some property in between Matthews and Washington.

13:46

Um as our staff report says this is sort of commercial area out there.

13:52

We're asking for uh C three.

13:55

The staff report shows that it meets all the criteria.

13:59

Um we did have, even though it's not multifamily, we did have a neighborhood meeting.

14:05

We notified all the neighbors in the area, nobody showed up, so um there wasn't any concern there.

14:12

So happy to answer any request any questions anybody has Jim, while you there is this identical to the next one on the that's right.

14:23

There just two different tracts of land, but it's the exact same request, exact same neighborhood area.

14:29

That's right, join each other.

14:31

Contiguous properties.

14:32

Okay.

14:35

Okay.

14:36

Um city planner.

14:38

What'd you just say about multifamily?

14:41

Oh, I said uh even though this wasn't a multifamily request, I went ahead and have a neighborhood meeting.

14:49

I always do the neighborhood meetings.

14:50

A lot of folks don't do it even though it seems to be required, uh, or they'll do it for neighborhood or for multifamily.

15:00

That's all I was just saying that you know, even though this isn't multifamily, we still did the neighborhood meeting.

15:06

City planner?

15:07

Yes, sir.

15:08

Uh, we've reviewed this and um it does meet the land use plan.

15:13

Um it meets all the criteria, so we would recommend approval.

15:18

Okay, again, then a rezoning request.

15:20

Is there anybody here to give public comments?

15:25

I see none.

15:26

Um what I'll go in C three again.

15:29

That's what I'm gonna look up again real quick.

15:33

So we were just looking at C2, so I was gonna look at C three real quick.

15:37

I have it pulled up if you a lot of things, a lot of things, offices, um care general, animal care limited, auditorium or stadium is a conditional use, teller machines are permitted, bank or financial institution, bed and breakfast, car wash, cemetery, church, college, communication towers, conditional, convenience store, daycare limited, daycare general, adult entertainment is a conditional use.

16:13

Umeral home, golf course, gov there's almost nothing that's not allowed.

16:21

You can't have a firing range, you can't have medical marijuana cultivation center.

16:27

Um you can't have vehicular storage.

16:35

Yeah, I mean, it's almost the whole list is allowed, pretty much.

16:40

No, no industrial, other than a couple of conditional uses.

16:45

You can have a farmers market.

16:46

That's an agricultural use.

16:53

Yes, sir.

16:54

Uh come to the microphone if you would please and state your name and address.

16:59

Um no residential uses if you were asking that question.

17:04

I guess he missed that.

17:05

Uh I did open up for public comments before we talked.

17:07

Did you?

17:07

Yeah, yeah.

17:08

Go ahead.

17:09

Yeah.

17:09

So uh my name is Brad Partee.

17:11

I'm one of the elders at Washington Avenue Church of Christ, formerly downtown.

17:15

Don't get nervous.

17:15

I'm not I I do have a question though.

17:18

Are there and this may not be the right meeting, but are there plans yet as to what will go there?

17:23

You just want to zone it commercial.

17:25

Sir, sir.

17:27

Okay, we're not legally we're not allowed to have a lot of things.

17:29

Okay, that's fine.

17:30

That's fine.

17:30

They can volunteer it if they want to, but yeah, I'll just say just going to commercial, we have no issues with that.

17:36

Okay.

17:36

So okay, thank you for your comments.

17:38

But changing that from R1 would basically remove any multifamily from it would remove all residential.

17:48

From how many other acres this is, correct?

17:52

That's correct.

17:52

Yeah.

17:54

And they couldn't have multi-family.

17:57

Right.

17:58

Yeah.

18:02

Jim, is this the wooded lots that's just past the church on that's these are these the wooded lots that are west of the elks or east of the I believe it's west.

18:19

West.

18:21

Pardon?

18:22

East of the Elk Lodge.

18:23

East of the Elk Lodge.

18:25

West of the Elklaw is the farmer enterprises, I think.

18:28

Just on the back side of those apartments, correct?

18:33

It backs up to those apartment that's next to that church.

18:37

Yeah.

18:39

One of the tracks.

18:46

Any other questions?

18:48

Comments?

18:49

Commissioners.

18:51

Anybody ready with a motion?

18:56

Board move to approve.

19:01

I have a motion and a second.

19:04

Would you uh log your vote, please?

19:43

Okay.

19:44

Your rezoning request has uh received a positive recommendation.

19:48

You know, to get on city council's agenda.

19:50

Next meeting.

19:51

So did I hear you say we need to get the ordinance in by tomorrow?

19:54

I would check with with our city clerk in the morning.

19:57

I don't know what she did with deadlines with today's meetings being moved to Thursday.

20:02

Tomorrow, no problem.

20:03

Yeah.

20:03

Thank you.

20:03

I just don't know if it usually the it's Thursday at 10.

20:06

Right.

20:07

But we met after that.

20:08

So I don't know what she's doing.

20:09

Okay.

20:12

So I mean that had to go on, so maybe she was trying to get finance out by 5 30, so I don't know.

20:19

Okay.

20:20

Uh next request is rezoning request 25-17.

20:24

Uh same applicant and James Gramlin requesting rezoning the property from R1 to C3 in the 2000 block of Washington and Matthews.

20:33

So this is next door.

20:36

That's correct.

20:36

Go ahead.

20:38

I don't have anything to add.

20:39

This is right next door, so same considerations.

20:42

Happy to answer any questions.

20:46

City planner.

20:47

Uh again, it meets uh the land use plan, it meets all the rezoning criteria.

20:52

So we would recommend approving.

20:55

Okay, and again, uh public comments that anybody here to have okay.

21:01

Okay, move to approve.

21:04

Motion to approve.

21:06

Little second.

21:07

And a second.

21:08

If you could please record your vote.

21:18

Again, you've heard favorable request.

21:23

Thank you.

21:23

Thank you.

21:27

Any other business?

21:29

Uh just remind everybody there will be no meet second meeting in November or December because of the holidays.

21:38

So we won't have a second meeting this month, and we'll only meet uh on the first meeting of December.

21:44

So then Mr.

21:45

Ford.

21:47

You putting that on your calendar?

21:49

Me.

21:50

Yeah.

21:50

He said me.

21:51

Just call me if you need.

21:54

I'm close by, I'll come on down.

21:58

Move for adjournment.

22:00

We're adjourned.

22:02

Yeah.

Planning Commission Meeting Summary - November 13, 2025

The Planning Commission convened on November 13, 2025, to approve meeting minutes, finalize a subdivision plan, and process four rezoning requests. The meeting featured discussions regarding the distinction between commercial zoning classifications (C2 and C3) and residential uses, with specific clarification on overnight occupancy limitations in the C2 district. Two rezoning requests (RZ 25-16 and RZ 25-17) involved contiguous properties in the Washington Avenue area, while a fourth request concerned a short-term rental proposal in an industrial zone. All items were approved with recommendations to proceed to the City Council for final adoption.

Consent Calendar

  • Approval of the minutes from the previous meeting was granted via a voice vote.

Public Comments & Testimony

  • Brad Partee (Elder, Washington Avenue Church of Christ): Commented on the rezoning of RZ 25-16/17 properties. Expressed no issues with the rezoning from R1 to C3, despite noting that the change would remove potential multifamily zoning and restrict residential uses. Asked clarifying questions regarding specific future plans and confirmed the properties back up to existing apartments.

Discussion Items

  • Final Subdivision Plan (Frog Pond): Travis McAllister requested approval for a 24.81-acre subdivision containing 39 lots. City Planner confirmed all infrastructure (asphalt, maintenance bond) is complete and code requirements are met. The applicant expressed satisfaction with the process.
  • Rezoning Request RZ 25-15 (213 N. Main St.): Wade Gay (representing Shamin Wilkins) requested rezoning from I1 to C2 to facilitate a short-term rental for contractors.
    • Clarification on Position: Commissioner Darrell stated that C2 zoning does not allow overnight stays or residential living, restricting the use to contractor offices and equipment storage. This contradicted the applicant's initial understanding that short-term rentals were permitted under C2.
    • Re-evaluation: City Planner and members later reviewed the zoning chart, confirming that short-term rentals are listed as a permitted use in C2, though it requires strict adherence to fire safety (sprinkler systems) and occupancy codes. The discussion established that while the zoning allows the use, the building must meet rigorous commercial/retrofit standards.
  • Rezoning Requests RZ 25-16 & RZ 25-17 (2000 Block West Matthews/Washington): Jim Graham (representing Andy and Ron Kraft) requested rezoning from R1 to C3 for two contiguous tracts of land.
    • Context: Applicant noted that a neighborhood meeting was held despite no specific requirement for multifamily projects, resulting in no public opposition.
    • Public Comment: Brad Partee inquired about future development plans, specifically regarding residential use. He received confirmation that C3 zoning prohibits residential uses, including multifamily housing, but allows a wide range of commercial uses.

Key Outcomes

  • Final Subdivision Plan: Approved unanimously.
  • Rezoning RZ 25-15 (I1 to C2): Approved unanimously. Next Step: Applicant must schedule a City Council hearing (likely December, subject to City Clerk deadlines regarding the meeting delay) for final ordinance adoption.
  • Rezoning RZ 25-16 & 25-17 (R1 to C3): Approved unanimously. Next Step: Applicants must contact the City Clerk immediately to ensure inclusion on the City Council agenda (deadline uncertain due to meeting rescheduling).
  • Administrative: The Commission announced there will be no second meetings in November or December due to holidays; the next meeting will be the first Tuesday of December.

The intent is to bring uh contractors stuff to the area. When the when they build uh out areas here, uh they do have offices and uh some of them do have uh places to stay. So you know uh if it has to just be for office purposes, I guess that that's the way we would shoot it. So to be clear, what what Daryl is saying is that the rezoning request for C2, C2 does not allow for any overnight stays in the building. Just to be clear, that's what we're telling you. So in the article of what I read, that's why I was looking down for C2, it does state that short-term rental is um allowed. Give us one second, we're going. Yeah, I've got it right here. I think there's something you could ask for that would allow for that, but it's probably not C2, I don't think that. Uh the and the reason we did ask for C2 was because it was recommended that it would be more versatile.
