0:00Alright, we're ready to get started here.
0:02Can we have roll call please?
0:14Okay, thank you very much.
0:15Need a motion to approve the minutes from the last meeting.
0:40John Neely with Associate Engineering on behalf of Herc Rentals.
0:45We're asking for a variance to put a gravel storage area next to the existing Herc Rentals on MLK Boulevard.
0:54Put down a class seven base fence and screening.
1:01So you're going with a uh the fence?
1:06Um guess a non-C-through fence.
1:12Uh or is it just chain link?
1:14Is it gonna be just chain link or is it gonna have chain link with with the green screening?
1:19Okay, with the screen.
1:20Yeah, that's what that's a word I was looking for.
1:24Well, we've done this for other parking areas, and especially in industrial areas.
1:32Uh you got any questions?
1:39Darrell, do we have to landscape?
1:46If you submitted that you're not going to be able to do some, we put a landscape plan in the cell.
1:50Yeah, there was the only problem that we've come up with is that this is a separate lot.
1:56It's not tied to the building itself.
1:59So they've basically got two options.
2:02They can replant this into one lot, or they're gonna have to go to MAPC and get a conditional use permit for the parking lot.
2:14Well, I am sure they're still gonna want to want it to be gravel even if MAPC grants it.
2:20Okay, so can we can we step in front of them for we have before?
2:28Is it the whole the whole L?
2:30Is that the lot you're talking about?
2:33So all of that would be the class 7 and all basically the whole the whole lot would be and is your provided there's not anything on the east, well, the east side is our detention or stormwater mitigation.
2:47Where's the building currently?
2:49The rental place currently is it on is in the other.
2:53On the other side of the property on the south side.
3:15It's the South property is Herc Rentals.
3:19The L shape we're dealing with is uh Max Duckis family trust.
3:41What are you gonna use this for?
3:42Just a park equipment and stuff like that.
3:50Much like Sunbell rentals or the cat rentals, stuff like that.
4:07Kevin, do you remember?
4:08Do we still have we still made them curb it?
4:11That just because we're granting the the variance for the chat doesn't mean we're disallowing the sidewalk or anything outside on front.
4:20Is that correct, Darrell?
4:22We're just granting the variance for the chat.
4:25Not putting the asphalt down.
4:34Well, it'll all be it'll all be staff approval.
4:36I mean it's not big enough to go to MAPC.
4:39We'll look at it for everything else, make sure it's complying everywhere else.
4:45So you you think if they don't replant, Darrell, to it will come back to MAPC for conditional use.
4:52Well, the reason I asked that about apparently uh the ownership you're not gonna be able to replant it in the one lot.
4:58Yeah, you've got two different owners.
5:00So it will have to come back for it will have sort of MAPC for conditional use.
5:05For gravel parking, it's conditional and I one is conditional use.
5:14That's what's confusing me.
5:16So we're an I one, we're not in C three.
5:19Right, you're not I want to get the conditional use, do we still have to get the variance?
5:27Yeah, they can't vary the only thing they could do is approve the parking lot.
5:31They can't vary the pavement type.
5:35You just said conditional use of the gravel mark.
5:38No, it just the parking lot's conditional use, any type of compartment.
5:48Chair, I'd move that we grant the variance as requested.
5:55Second, can I have a roll call vote, please?
6:14Tell us what's going on.
6:15Um, I'm building a home on 1200 West Matthews Avenue.
6:19Um I'm requesting variants to change the ceiling height on the bottom floor to nine feet and the ceiling height on the top floor to eight feet.
6:28Okay, and currently that's uh in that area is 12 feet.
6:32It's 10 and a half on the bottom, 10 and a half and nine on the on the top.
6:38Because it's in, if I remember it's in the neighborhood transition district, everywhere else would be a 12 foot bottom floor.
6:44Neighborhood transition, we changed to 10 and a half because there's not just a lot of houses down there that have 12 foot ceiling heights.
6:52Not many houses in John with Club for the line at all.
6:58But the others that he had requested on here being in that uh redevelopment district, they didn't they didn't apply because the setbacks and everything, he's fine on his setback.
7:09Yeah, it's just his ceiling height that we have that uh we could he came up right.
7:17Yes, it's in that whole redevelopment area, yes, sir.
7:23Darren, I think we've granted this variance on more than one occasion.
7:33So we're going from well, what did you say it was from 10 and a half to nine on the first floor and from nine to eight on the second floor?
7:50My family will live there.
8:05Yes, my parents built a house on the corner of Washington and Matthews.
8:09Um lives around the corner.
8:11Aunt lives around the corner, she lives on Washington and Isbitt.
8:14Corner so we'll all be in that little three-block stretch there.
8:26Anyone would like to speak for or against this uh variant?
8:34All right, come on, dear.
8:35Just go ahead and slide, let her speak right there, please.
8:42My name is Meg Sebastian.
8:44I own the the house next door to this.
8:47I just have a few questions.
8:49Um I'm not trying to crush anybody's dream.
8:52Uh just trying to understand.
8:54Uh this is the first I've seen of the elevations.
8:59Orr left a note, very polite, lovely note on my door.
9:04And I had asked him, can you please show me the elevations?
9:08I love the idea of a young family living next door.
9:11Who wouldn't want that?
9:13Uh asked for the elevation's a site plan, and I I've never seen it.
9:17This is the first time it looks adorable.
9:19Um what I saw in the variance was, or the the variance application was that he was looking for changes to the setback requirements, and so what I'm just trying to understand is what's actually being asked for, right?
9:36And because I live next door, I'm I'm just trying to see what's actually being asked for.
9:43And is there a site plan that's actually got a PE stamp on it?
9:47And what does it look like?
9:49And there wouldn't be a site plan with a TE stamp for a single family home.
9:53That's not required in Jonesboro.
9:55Um you have the one plan that he site plan that he provided.
10:11It's very difficult.
10:14So it does so what he left me was he was asking for a variance with that he was changing the setback requirement that he was asking for a variance on setbacks, but what I believe I heard you say is that he's he's not asking for that any longer.
10:27Yeah, he doesn't need any for for setback.
10:29He's plenty off the street in every direction.
10:33So the only variance is ceiling height.
10:41You got any other questions?
10:44Anyone else like to speak?
10:48Come on back up, Mr.
10:55You have any more questions for this gentleman.
10:59I'll make the motion that we accept the variants.
11:21Did I call you up here?
11:25John said you'll spot Rob has for Stone Bridge construction.
11:30We'll represent the owners, Strom saying for a property at 3225 South Careway Road.
11:39The the kind of explanation behind this.
11:42I know we've been in a couple times.
11:43We've had a couple of things we've had to ask for throughout.
11:46And there was some discrepancy in the overlay district maps versus the verbiage.
11:55So when we had talked to the city early on, they had told us that this fell outside of that.
12:01So we had not had any concern regarding signage because of that.
12:05But when we actually went to apply for the permit, and I and Daryl and I've spoken about this, the verbiage reads a little different from where this site is as far as where it is, where the overlay district from the interstate.
12:24And Darrell may be able to put a little shed a little more light on that.
12:28That's really what we're looking for.
12:30We've got a road sign that they've already clients had already purchased and had built based on the information that we had from our earlier discussions.
12:39But when they went to pull the permit, it brought up another concern that there was a kind of a discrepancy between the maps and the and the verbiage and the code.
12:55Um the uh maps that you can find on our website um show a um a corridor along I-555 um showing the overlay district.
13:07Well, it's supposed to be 300 foot from the edge of the right-of-way of I555.
13:14I think I got the right number of fives in there.
13:17Um the right-of-way for it actually goes all the way to Parker Road, but that's not what's shown on the map.
13:27It just took from the center of the interstate and 300 feet each north and south.
13:33So we're in the process of updating that to actually show what it should be instead of what is shown now on the map.
13:42So um Stonebridge came in, they were working all with the maps, even my people were working with the maps, and um they looked at the signs and and you know didn't see anything wrong.
13:55And I happened to walk by and look, and I said, Why is this not a monument sign?
14:00And he said, Well it's outside the overlay.
14:02Well, it wasn't outside the overlay, but that's not what was shown.
14:05So we had recommended coming to y'all, getting it straightened out while we get the maps fixed.
14:12Okay, so they are in the overlay.
14:14They are in the overlay calls for a monument.
14:18And you're y'all, what kind of sign are y'all wanting to do or have bought?
14:22It's a it's a pylon sign.
14:24A pylon with LED uh yes, it has a uh for it basically it's one sign for that entire site, so that it actually has the building the gas station as well as uh golden chick adjacent and b all the all the signage for that whole site is on one part.
14:45Yeah, because we're we've kept that site as one parcel so there wouldn't be another sign on that entire site, period.
14:52So and how tall is that sign?
15:0035 35 feet, which is I think shorter than what's across equal to what's across the street and way shorter than the other ones around on uh go and uh other ones in the so has he you're gonna change it to where he would be in the overlay, or you're gonna change it to take him out, it would take it.
15:21Oh, it's gonna be in the overlay district, but everything he did was basically what my staff told me.
15:27So we need to take responsibility on this thing.
15:30I mean, because if Stonebridge would have known, they would have they would have done the monument side.
15:39Um we let it get to the point that you that wasn't an option.
15:44I mean, if you've already purchased your sign, it's already set in there waiting to be installed.
15:48Um I'm not gonna be the guy that tells you no, you're you're gonna get rid of that one and you're gonna come back and build a build a new one when our the information we gave him wasn't right.
15:59And then the overlay is just for the interstate, or is there an overlay on caraway?
16:03There is not on Carawadi.
16:06Um, but there is a long interstate.
16:08It's the main corridors, and I don't know how we skipped caraway, but we did.
16:12Um, but it's um I mean Red Wolf Stadium, um John Southwest.
16:17That that's where the overlays are, um, and all of I555.
16:22And like I said, the ordinance that was adopted by city council says 300 foot from the edge of the right-of-way, and when that was drawn on the city maps, it they just went to the center of the interstate and went 300 foot each side.
16:39And then it did not reach.
16:41It did not reach them.
16:43So as they're looking at it, they're saying, well, here's the overlays north of this, and it's really not.
16:47Well, and it's even farther because there's the the exit ramp and then there's a green space, and then there's so it's even farther.
16:56It's probably 600 feet from or more or more, probably closer to seven or eight hundred feet from the interstate, uh, because of where it sets.
17:04But like I said, we we reached out and we've had we've had multiple meetings with the city regarding this project from the beginning.
17:12So this is one of those that we reached out specifically.
17:15I did personally, and to check on signage to make sure, because I assumed at the time that it was in the overlay, and I was instructed it wasn't.
17:24So I'll let my clients know that we can proceed on with the pylon.
17:29Where's the sign going right there on the corner?
17:30It'll actually be where that tree is shown at the be on the north side of that entrance on Caraway Road.
17:36Where that black where that black tree is?
17:40Uh is that where Jersey is?
17:41No, no, on the other side.
17:45Actually on Caraway.
17:46It'll be about it'll be on Caraway, but it'll be off of care, yeah.
17:49Just off a little bit, because too tight to put it on in front of the gas station.
17:55I don't know that we've got the capacity to remove a piece of property from overly.
18:04But again, we're not taking the property out of the overlay district.
18:07We're asking for variance for this.
18:09Is it sign variance?
18:10Is what we're truly asking for?
18:11That's all we're asking for is the sign.
18:13We're not asking for anything else.
18:14Yeah, everything else is in compliance.
18:16Everything else can't.
18:18I thought I thought we had done that previously.
18:30Across the street, you got the same thing.
18:32So yeah, we're fine with it being limited to the sign only.
18:41There's nothing else.
18:42That's the big deal with me, is that we're not taking the piece of property out of the high district.
18:45We're just branding the variance on the sign.
18:49At the end of the day.
18:51It's the height of the sign.
18:59Sign is that how we do it?
19:01Yeah, that but that's all we're that's all we're dealing with today.
19:08I'm gonna make a motion that we accept the variance for the sign.
19:12Maybe we have a second second.
19:17Roll call vote, please.
19:28Have any other you're gonna make it twenty foot tall, tall wheel?
19:31Uh no, sir, not today.
19:32We'd like to wish everybody a Merry Christmas.
19:36First piece is thirty five, the second piece of Merry Christmas, y'all.
