0:37Okay, I'll open up for the discussion of the minutes from the June 9th meeting.

0:49The the names and the attendance did not quite go with the names of the voters.
0:56There was a little conflict there.
0:57I think they just got the name switched, so might want to get those corrected, but other than that, it looked great to me.

1:10So I nominated stuff and then, but yet I was absent.

1:16So what do we need to do about that?
1:22The rules as I go back and change fix the adjustments and we can approve them.

2:18PP 2609 Savannah Hill Subdivision Phase 6 has been with it's been pulled until the next meeting.
2:25So we will move and dive right into the vote.

2:30He withdrew it before we took action on it.
2:33It's been withdrawn until the first lift of asphalt gets on the street.
2:36So it may not be the next meeting.

2:42So we'll dive right into the rezonings.
2:44The first rezoning we have is RZ26-09.
2:46The applicant, NK and Sons Investments is requesting rezoning property from C3 to RM12 at 2038.
2:55It says North Caraway, but that's North Church Street.
2:58We have the applicant for this item tonight.
3:00Yes, Jim Gramling, uh Gramming Law Firm.
3:04So this was originally RM16.
3:07That says RM12 wheat.
3:10So let me back up just a second.
3:11We had a neighborhood meeting.
3:13Only one person showed up and he was in favor of the project.
3:16Um but then in the pre-meeting, there was some current concern expressed about density.
3:25So we sort of went back to the drawing board and what we've come up with a proposal for RM12, but with a limited use overlay that limits the property to 12 units.
3:48Uh if I if my math is right.
3:51So the limited use overlay would limit it to 12 units.
3:55For the entire 1.4 acres?
3:58So the entire property be RM12, but limited use overlay to limit it to uh 12 units.
4:05This property is currently zone C3.
4:09So you know, and there's there is old uh some old uh property nearby with 18 units.
4:21So I think the 12 units is a good compromise that would fit the property, still out to be a viable project.
4:29Um but I'm happy to answer any questions if anybody has any.
4:34Okay, anybody have a question at this point before we proceed with question with I let Daryl talk a question for Darrell.
4:44Yeah, I open up for the city's comments on this.
4:47Uh yes, we have reviewed it and we would recommend approval with the um it um also it meets um five of the six um planning criteria.
5:00It did not meet it for um it's a moderate intensity zone, which the most it allows is RM8, which would allow 11 units per acre.
5:07Um so we would recommend approval with the following conditions.
5:12That would be actually a total of 11 units, right?
5:16Uh that the proposed site shall satisfy all requirements of the city engineer, all requirements of the current stormwater drainage design manual and floodplain regulations regarding any new construction, a final site plan subject all ordinance requirements shall be submitted, reviewed, and approved by the planning department prior to any redevelopment of the property.
5:37Any change of use shall be subject to planning department of in the future and the limited use overlay will limit this to 12 units total.
5:50Now, before we open up for comments, is there anyone here to give public comments on this?
5:55Okay, none seen, so I'll open up for commissioner questions of staff or the applicant?
6:00Darrell, if it was rezoned single family, whatever R that would be, but this acreage, how many single family homes roundabout do you think would fit he's using a calculator?
7:05If you went to RS4, it would be uh five.
7:12If you go to RS six, it would be eight eight houses.
7:36So I have one for for Jim.
7:40So Jim, if it if it was an RM eight and would be eleven units, would y'all be willing to consider that?
7:49That way it would the rezoning would check all of the boxes.
7:55That's that's you losing one complex or double.
8:02Number one, you know, we had this issue when we were at RM 16, RM twelve, it was 23 units and then 15 units, and it I'm not a builder, but according to my client, it's much better to have an even number of units than to have an odd number of units.
8:24So if it's 11, then you know it might end up being 10.
8:29And and you know, the second thing would be you know, there items approved all the time that don't have every single box checked.
8:42And in this case, you know, we're one unit away.
8:45RM eight would be eleven units.
8:48We're just asking for 12.
8:49And you know, we'd come down.
8:51Nobody in the neighborhood is objecting.
8:53I saw a news story where uh they interviewed two folks, and one person said I don't want it because of traffic.
9:00Of course, the C3 is gonna be uh, and the other person said yeah, I'm in favor of it.
9:05I think it would help the neighborhood.
9:06So I would like to keep it at 12 for those reasons.
9:18Any other commissioners have a question?

9:27I've lived in that area most of my life, and that lot has basically set there at a wooded lot.
9:36And I don't see any commercial thing moving too much in that direction north.
9:43So I move we approve it.

10:48Applicant John Easley is requesting a rezoning for property from R3 multifamily residential to C3 General Commercial District.

11:03Asking for a rezone on the old Lexington Place nursing home on Browns Lane.
11:08It's currently our R3.
11:10It's the only residential in the area.
11:13We're asking for C3.
11:16City Planner, you have the staff comments on this one?
11:20Uh it does meet all the six criteria for rezoning.
11:25So we would recommend approval with the following conditions.
11:34All requirements of the current stormwater drainage design manual and floodplain regulations regarding any new construction.
11:40A final site plan subject to all ordinance requirements shall be submitted, reviewed and approved by the planning department.
11:45Prior to any redevelopment of the property, any change of use shall be subject to planning department approval in the future.
