1:20First item we have tonight is a preliminary subdivision.
1:22This is Southern Oaks phase two preliminary plat.
1:26So have the proponent for this item.
1:37So I guess that's on the screen what I'm wanting to do.
1:45I'm wanting to uh rezon the lot one to commercial.
1:48Right now it's on residential, but it joins commercial to the left.
1:51I'm building a group grocery store right next to it.
1:54Across the street, it's commercial.
1:56So it's uh and this may be the only thing I ever did in 50 years that I didn't have opposition.
2:04So this part's just for the plat approval though for what you're about to ask for the rezoning, correct?
2:10This is just for the plat for what you're about to ask rezoning for in a few minutes.
2:15City planner, you have comments on this?
2:18It meets all the requirements of the subdivision code, so we wouldn't recommend approval.

3:06So this is for a rezoning request for the property from R1 to C3 limited use overlay at 1400 Southern Ridge.

3:17City planner, you have staff comments?
3:20I do uh it does meet all six criteria for rezoning, so we would recommend approval with the following stipulations that the proposed site shall satisfy all requirements of the city engineer, all requirements of the current stormwater drainage design manual and floodplain regulations regarding any new construction.
3:36A final site plan subject to all ordinance requirements shall be submitted, reviewed, and approved by the planning department prior to any redevelopment of the property.
3:44Any change of view should be subject to planning department approval in the future and um that's it openly it is not overlay.
3:57With this being a rezoning request, is there anyone here to give public comments about this rezoning request?

4:11Um so uh this is my first time here.
4:14Um I actually live in Southern Oaks uh as well as my neighbor here, and uh this was all very new to us.
4:21Uh we got this letter in the mail, and I quickly ate I I AI this to see how it could affect me.
4:28Um so my main thing is uh what exactly is planned because it's still like it doesn't give any clear answers on what they're wanting to build, and I don't want something that's gonna impact my house specifically being the first house in that subdivision with lighting or the type of uh facility that they're planning if it gets very noisy.
4:48So that's just my main concern.
4:50I know that a city grows and I'm all for that.
4:52Uh I'm from a big city.
4:54Um but yeah, I just wanted more clarification on that, and uh I don't know if you have any other things.
5:00So this is a limited use overlay.
5:02There are a few restrictions.
5:03Does someone have the list of what is approved or Carol?

5:30So we're requesting the permanent use to be animal care, um, a assisted living uh uh bank, church, daycare, government service, library, medical service medical service, nursing home, office, parking recreation, pharmacy, restaurant, general, not fast food, and uh retail or or uh general service.
5:51So those are the items that would be permitted to, not so those are per that's what you're gonna permit.
5:57That would be yes, so that was on the list for okay.
5:59So what are you what are you limiting it?
6:03Everything but those things that's not more than less so those are the only things that it could be.
6:09So that means it could sure you can have those.
6:23So it basically seems like anything, right?
6:26Well, there are a lot of things that there's a couple things that are not on there, and I will just say just they're south of that street.
6:31Is it C3 L U A L U O?
6:33It matches what's on the south side of that street.
6:37So there's Southern Ridge Boulevard on the south right here.
6:40C three L U L's the same permanent uses from here to here.
6:45So are these the same limitations that were on the lot that's gonna have the grocery store, or do you know?
6:50That's not the well, the grocery store is a part of Southern Hills Planning development.
6:56It's not a part of the planning development.
6:57So you're saying the other ones that set outside the development?
7:01You're saying the other lots that sit outside the development that are C3 are also these limitations.
7:07There are C three L U O lots east of Southern Hills private plan to development.
7:12These match those permanent uses on the same street.
7:19And legally, we're not allowed to ask exactly what they're building.
7:23We're not on a reason.

7:26No, not just a lot of people are confused by that, but legally we can't say, so is it gonna be a Burger King or a McDonald's?
7:32Like, you know, but they've limited fast feed.

7:38But um we're not allowed to like require people to tell us exactly what they want to build there.
7:44We have my main thing was just being the lightning and us being speaking to lighting literally like the second house in that subdivision.

7:52We would like to make comments 21.
7:54We'd like to address that as far as lighting.
7:56Uh we look at that during the development phase, and normally we limit the lighting to um where it doesn't bleed off onto other properties.
8:05That that'll be looked at as when they decide what they're gonna put there, um, they'll submit a site plan and we'll review that, and part of that site plan will be a photometric page that'll show the lighting and um what we're looking at is the boundaries of that property, especially against the residential boundaries of the property, not having a high lighting number um at the at that residential should be at zero, is what we're looking at.
8:32So that keeps it from going over to the neighboring properties.
8:35Okay, and then my final thing would just be sorry, the the speed um or traffic going through there.
8:44I imagine there would be signs put up so that doesn't affect our Jackson drive street, or how would that work?
8:51There's already a subdivision plan out there that the street side uh streets uh speed limits have been approved.
9:00Okay, and so those are right there.
9:01If the signs aren't up, they will be coming up in the future.
9:04Yeah, because I know there's a lot of tens, there's a lot of young families moving into those neighborhoods.
9:09Um, so it doesn't concern me as much, but I just think about those families and how you know you don't want something ugly to happen.

9:20I was just gonna say is there also a requirement there there's screening between commercial and residential properties.
9:26Normally, if it's commercial against residential, there will be some type of screening too that would be looked at during the SAP plan review process.
9:33I got one more I got one question for you.
9:35What was just concerned that it was too much light that you concerned with or not enough light?
9:40No, too much sliding.
9:42Yeah, I don't want something where because um I don't know if you guys are familiar with that neighborhood, but those houses they have um windows, three sides, like three small windows, and you don't have anything that you can cover those up with.
9:57So that would really negatively impact how I'm able to, you know, rest.
10:02Um and then I'm not sure it won't be just me, but my other neighbors as well.
10:06So that was my main thinking too.
10:10Carol, do you have any comments to address any of that?
10:12Um this is on the three-lane street, not uh, so it's uh set up for commercial traffic.
10:19It's an arterial street, and then um I own these 17 lots residential, so I'm certainly not gonna build something that's gonna have uh hurt her.
10:29It hurt me 17 times more.
10:32So uh I am very you can look what's out there so far and say that I'm not this is a first last development.
10:41So I wouldn't I won't sell lots more houses to the R.
10:48So any other public comments if you would say yes, come up and state your name for the record.

10:55I'm also a neighborhood.
10:57Um my concern is related to the fencing and the uh height of the construct potential construction because we I mean the privacy of this residential now.
11:10Uh how will be and it will be gonna be notified of the while they are constructing their how we'll be affected.
11:22Uh I mean our daily uh sure basically the trucks coming and going during construction.
11:30And the next question is related to the to the price of the house.
11:37Uh really what I've I've read is in some documents, the houses that are next to those type of construction can be affected, but overall, I mean, should be benefit because it's growing, no, but sure the one that are next to uh let's say if it's a big parking lot that is gonna be there or something that creates noisy or something, could affect you know the the prices of or of the of the of the houses or how we can uh be quite so this is my my my main concern.

12:16That kind of goes back to what you said about your lots that you're putting right against it yourself.
12:20I would think there's a 30 foot buffer all the way around it, and uh we're adding detention that we may not have to, but we want to help more downstream than what's approved.
12:33So that uh big square at the rectangle is more detention.
12:39So to me, this is all improvements is what this is.

12:47I I think uh an explanation of the buffer for for them to would be better of what they can expect.
12:55Um so do you understand what Carol is saying that there's gonna be a 30-foot buffer between the development and the back of the residential property around it, and so I don't know what that buffer is gonna consist of, but um y'all might speak to that, Carol.
13:16So all around here shows up, doesn't show on that, but anyway, there's a 30-foot buffer all the way around that has to go in plus screening.
13:25So there'll be stuff from the yeah, all the limits.
13:29Yes, I think y'all live back over here a block away.

13:35Okay, and then the traffic won't be going down Jackson when something's built here, and I don't have any plans right now of what's gonna be built there.
13:42If I did, I'd tell you, I did I'd give you a side plan.
13:45So this is just you know, future and uh supply and demand, and um I'm just making it better.
13:55I would like to at least come to the mic uh to have uh uh continuous communication like that.
14:03I mean, we appreciate that we you have taking consideration just too to keep uh posted on what what's coming, what they play, what to I mean to follow the the recommendation, the petition that everything improved, but we need to make sure and be notified like this notification, or what is the because uh right now we don't know what is what is coming there, no what is gonna be the business that we're gonna be the development.

15:19This is a site plan at Citadel Minor Phase 1 at the proponent for this item.
15:29I'm the engineer for the developer.
15:32This is a R3 zoning piece of property that used to be Woolham Drive or Willem Street, and it has uh several trailer on it, trailer parts.
15:45And we are removing those trailer parts totally out, and we want to build uh some apartments on this property.
15:52Right now we want to do phase one.
15:54We want to do six unit uh six buildings on the north side of the private drive.
16:01Okay, city planner, do you have the staff comments for this site plan?
16:06Um we don't have staff comments on the site plan.
16:11The reason we're it's here is because of the site of the number of units in um so we wanted to bring it before you we will review this as usual and make sure that it does meet all city codes, but um because of the number of units it's um our ordinance requires um MAPC to review it and uh before we go any further.

18:04Uh this is from the um DPZ, the people that are doing our comprehensive plan, and it's some uh a lot of the information that they've come up with up to this point.

18:22Umorrow they're gonna have another meeting at noon, and it's gonna be for the um it's gonna be for the um gosh.
