Today I'm honored to present this resolution recognizing Tracy White for more than 36 and a half years of dedicated service to the city of Kansas City, Missouri, and our municipal court.

Miss White began her career with the city on July 3rd, 1989, starting as a stock clerk and advancing through several roles in her current position, a senior administrative assistant and facilities manager.

Throughout her career, Tracy has been a steady behind-the-scenes professional who made sure the courthouse functioned smoothly, maintaining supplies, coordinating building maintenance, and solving countless problems along the way.

She played a critical role in managing millions of paper tickets, paper tickets, and later helped lead the court's transition to a paperless system, overseeing an archiving of the more than three million records.

Beyond her job duties, Tracy has been a true team player, decorating for the holidays, serving as an unfortunate official court historian, and enthusiastically supporting the charity of campaigns and staffed events.

Most of all, Tracy has served with warmth, professionalism, and kindness, leaving a lasting impact on the city and everyone she worked with.

On behalf of the city council and the mayor, we thank Tracy White for her remarkable service and wish her a very happy and well-earned retirement.

For six decades, Christian Tabernacle has gone beyond worship by providing programs and services that strengthen neighborhoods, restore hope, and meet real community needs.

The church's legacy continues today under the leadership of Bishop Keith Newton, whose ministry reflects compassion, service, and a commitment that reaches both locally and globally.

Christian Tabernacle's impact extends well beyond its walls, touching lives across greater Kansas City and abroad through ministry and public service.

It is my honor to recognize the bishop and first lady Newton and the other members from the church.

Honoring Lafonda El Tequido, restaurant for nearly 50 years of service, culture, and community on Kansas City's West Eye.

Oftentimes these special actions are purely celebration.

This one is a celebration, but it also comes with a bittersweet note because we are recognizing the end of this chapter of a Kansas City institution, and that is La Fonda, El Taquito, located at 17th Street and Summit right on Southwest Boulevard.

Originally opened in 1978.

Whether Sunday mornings, eating manual, whether going for political events and big important names coming through at that location, cramming that building, probably beyond what the fire code will allow, but with a lot of people there to support, many, many good memories.

And so while I thank you all for all the work you've done day in and day out, I know the restaurant business is tough, and you've done it for a very long time.

There's part of me that is still sad that you're closing down and not going to continue forward.

And that's that La Fonda has been affectionately known as the Mexican Cheers, a place where everybody knows your name and we're owners, Maria Sheron Medina and Sandy Medina have welcomed generations of patrons, not merely as customers, but as family.

And over the decades, La Fonda El Taquito was welcomed, has welcomed neighbors and families alongside local, state, and national leaders, including mayors, city council members, governors, members of Congress, and presidential cabinet members, as well as athletes, musicians, and business leaders.

I will say one more thing.

You've seen all the work that we're doing on Southwest Boulevard right now, millions of investments, and stuff that's long overdue.

Sidewalk improvement safety improvements, making it more green.

One of the major reasons that happened was because of a conversation I had with one of you all, who's not here with you today, but it was with Chris, with Chris Medina and I sat in that restaurant, and we talked about the years that you all stayed on the boulevard when the city was not investing.

And I I mentioned the idea to him about being part of a community improvement district, and he said, Why would we invest more of our tax dollars when the city hasn't invested in over 30 years?

And I thought, you know, that's actually a very, very good point.

But you all stuck it out through all those years.

Um, and I am excited that now you'll have the opportunity to get some rest and relax a little bit.

Hopefully, you'll still find a way to make some delicious food that we can have every once in a while.

But I appreciate everything you've done for the community.

Well, unlike my colleague who only remembers 1978 is something he read in the history books.

I actually graduated from college that year.

Um, and I I've been a frequent visitor of yours.

I've always enjoyed, and I always judge a Mexican restaurant by its great margaritas and its chips, and you guys were our nun.

I might just add on this.

The uh the idea here is a fairly simple one.

Kansas City is building a great many things.

Uh this council had uh an ordinance not unlike this with landfills at some point before too, where we elected to ensure that we would have further discussion at the city council level, uh preempting perhaps any further planning and zoning discussions to determine whether this is the sort of thing that the city would wish to pursue in this situation.

I think this is the sort of thing that would merit further council attention.

This moratorium ensures that it would have to come back to city council prior to any uh approvals and other such related items relating to detention facilities that are non-municipal.

Councilman Duncan, actually, sorry, Councilman Willett.

Um normal moratoriums go through CPC.

Um, but the landfill one, can you re fresh me on that one?

I'm trying to recall the landfill moratorium.

If I mean the the broader approach that we used was it came at the end of a legislative session in Jefferson City.

We introduced one at City Council.

I believe we use the same day adoption tool in connection with that, and so this is not a process that has not been used prior.

Um, I think it's important that you know the community understands where we stand on facilities that will harm our community.

And um we will continue to use and I will continue to look for every possible lever at our disposal um to ensure that we decide what is built in our city, um, that we decide which facilities will benefit and which facilities will harm um our community, and uh I look forward to to to approving this and to to working in due diligence with our community members um to fight things not only in our district in the 6th district, um, but anywhere in our city.

I think though I might suggest, not that I want to go full closed session remedy, I would welcome some debate and discussion on that, likely in a closed session forum, given that at some point it could be relevant to what the city's position might be if you're so inclined.

If councilman Willett is asking for that to be answered, I would be more inclined to go into closed session because I think we did have litigation tangentially involved in that um some years ago last term.

Regulatory authority usually does it merit closed session in your opinion, or would you prefer uh there's always a vote no option or abstention too, but whatever you would like to go in closed session talk about legal there'll be a there's a motion for closed session pursuant to probably the provision of legal advice?

Yes, just uh requesting an explanation for what is essentially a change of location of what has been previously publicly stated for the detention center, long-term permanent municipal detention center.

I think I'll take a stab at it, then certainly welcome any others in connection with it.

The city has studied extensively the front street location.

Of course, that's come out of the temporary detention facility discussion in a number of ways that satisfies what have been some of the questions that we had prior on detention facilities.

A long part of our detention facility discussion has been finding a place to site it.

We have site control.

We have uh site remediation and uh site preparation costs that are uh uh less than what we see at the uh 40 highway site, at least a 25 million site prep plus 2.3 million dollar uh site acquisition costs.

So you have a 27.3 million dollar shorter or lesser cost, and then of course you have a program that's already being built out.

There's also been uh a study that speaks to the fact that this site fits a detention facility that uh meets our permanent detention facility needs.

I think I don't pretend to be extensive, but I think that's some of what's been discussed.

And there was a mention of a preliminary report that I think that is the basis for what you're describing as the difference in uh preparation costs.

My information comes uh from staff representation as to our difference in preparation costs.

Okay, and uh, but uh I'll ask you or the city manager what are the site preparation costs for the front street location?

Um the property at uh 40 highway, I believe, is within the floodplain, and so the cost is there's significant cost in bringing fill and raising it out of the floodplain uh prior to even considering other elements of set preparation such as in printing utilities and those kinds of and and that kind of work.

Um and the preliminary estimates that we've seen for the construction for jail at US 40 highway.

I think the site preparation costs were estimated at 25 million dollars, so that would be uh a cost that we would not incur if we would consider an alternative site uh and front street.

I think, and I've asked my staff to share with the council the preliminary citing study uh for a detention facility of Front Street.

Uh there I'm not sure if everybody's received it yet or not.

It came to me very early, uh, early this week.

Um, but it does show that there is capacity and room uh at uh at front street to to fill to to construct a new detention facility.

So I understand that side of the ledger of preparation costs on the site at I7040 Highway.

What is the cost for preparation at Front Street?

Well, we are still waiting on the on the cost estimates for uh uh site preparation of front street, but you we know it's we it's a site that's currently leveled and site that's out of the floodplain.

Uh it is serviced by utilities, uh water sewer, uh, electricity.

Um so those those costs would be avoided.

Uh should we choose this location?

So why would we take this vote before we had that information available?

I mean Councilman O'Neill.

Well, I I think um I think it's important to spend a reasonable amount of money on a J a detention facility.

But I also think it's in our it's in our best interest to take the best uh spend the least amount of money we can and do it right.

This project over uh over on Front Street is going to cost approximately just a r rough, but based on the current cost of 136 beds, we're looking at under 30 million dollars.

We're talking about doubling that to 270 beds for somewhere under 60 million dollars every every time we've talked about 40 highway, we've talked about 220 million dollars or 200 million dollars for the same amount of beds.

I walked the site two days ago, I think on Tuesday or Monday, and I saw the the facilities that they're putting in right now for the temporary facility.

They're they look as good, they these are the the modular the modular facilities are as good as are the same modular facilities they put in a brick and mortar jail.

Um I don't see how we decide to spend 200 million when we even if they came back and said we can do it for 150 million, we're still looking at a 70, 80 million dollar cost saving.

So I think it's really important that we build this responsibly and utilizing those dollars for uh public service uh the public safety sales tax and utilizing those for things that we really need as well, such as fleet new fleet, new new uh midtown uh uh jail, or I mean um we're not been in jail in midtown.

At least control division.

Lack of a better word.

Um I think those that that gives us more money to spend on the other things that we really need as well.

So that's all I said.

And I appreciate that.

I mean, I'm open to changing my mind any time I have new information.

I'm just trying to get that new information.

We're hearing about a preliminary study, we're hearing about these discrepancies and costs.

Maybe we don't know what it would cost to build one of these uh modular facilities at I-7040 highway.

Um, there is no guarantee that we get this option back on the land when it expires uh at the end of the month.

And you know, I I'm just trying to understand why we need to vote on it today, if it sounds like the information that we're speculating about is forthcoming.

And I think the other reason location is important is because we spent a lot of time when we selected I-70 and 40 highway around community engagement.

We had six community engagement sessions, um, we did a survey.

There's extensive community engagement about that location.

I'm not aware that that has occurred on this location, unless I'm mistaken.

What I will point out is that when we recently did community engagement on the South Water facility, which is within very close proximity to this site, they had pretty large group of folks show up uh from that area who were concerned and had questions about the water facility, and we haven't done that with this site, and so I'm just wondering again why why same day adoption today.

So, I mean, I think I'll just speak to some of it and understanding that material disagreements may just be an issue that uh pervades through vote on this ordinance.

I think as a threshold matter, fundamentally, there's this question, and there is actually a deadline that we face soon, which is January 26th for the expiration of the option.

The question before council in its clearest sense is should we potentially still encumber 2.3 million dollars or discuss the encumbrance of 2.3 million dollars to pursue a site that will have at least a 25 million dollar additional cost in terms of constructing a detention facility.

I think that is actually in and of itself the open question at issue.

And so you can either look to it as just the 27.3 million dollar question, which suggests that we should give the city manager the authority, and I will note this by the way give council directed authority to the city manager.

You have mentioned a few other items over time that did not come from council direction.

Council did not direct actually any site at any point as to a permanent facility.

That's actually not correct.

Okay, fair enough.

I'll finish.

We've had several resolutions.

You can correct me when I'm done.

So uh council, right, needs to have an opportunity to actually give some clear direction to the city manager.

This permits it.

This also allows us, I think, to move efficiently in some way and making sure that we explore and chase down and drill down what is the site at issue.

And so I would suggest that both you have cost savings, you do have efficiency in terms of trying to make sure that you can deliver a better site at some point soon.

You also have the opportunity to piggyback on what is existing construction at the site now.

And so I think when you look through these number of steps and the question before council, and the clear question before council.

If we have spoken to uh an ordinance as to the site that we are evaluating exclusively, I'm not sure I have seen it.

This would be the first, I think, that at least has one site exclusive to others, and that gives that clear direction to staff going forward.

So it's both the deadline, it's the cost issues.

I think you throw those together, and that suggests why it's before us today.

Yeah.

I I'm failing to understand the connection between the deadline and what we would want to move forward with on Front Street.

I mean, and unless the decision the city manager is faced with that, but for this passing, he feels compelled to move forward with renegotiating an extension rather than just letting it expire, which I I won't speak for the city manager, but I don't know that that direction has been given.

So which is relevant to whether or not we would recoup the 2.3 million dollars.

I I think we've been waiting to hear back from Jackson County on whether there's not interest on an extension, and we haven't heard back fairly recently, and so I've just I I don't know why this is so pressing today.

Um given that this was a major issue during the renewal of the public safety sales tax.

I mean, we we represented time and again that I-70 and 40 highway was the location.

That's what we told voters.

It was a non-controversial location, and I think it's what made that campaign easier.

And now we're gonna change that location without having done any community engagement about a new location.

I have a serious problem with that.

I don't think it's transparent, I don't think it's honest with what we told the voters uh back in April of last year.

And so um those are my concerns.

I I think everyone knows where they stand on this, but um you know I think that's unfortunate.

No, I and I don't remember the exact chapters because there's traffic ordinances are in one chapter, and then other stuff is in the other chapter.

It cites both chapters, so it would include not just traffic violations, but pretrial release for a domestic assault or theft or something.

That seems like overkill.

I just don't understand why would we we would require for pretrial release for a domestic violence situation to prohibit the defendant from operating things that are already unlawful.

Why would we also include them, you know, not to smoke prohibited substances?

Obviously, that's a no-go.

I just don't understand why we would.

I mean, understand why we would reinforce it for folks who have violated an ordinance related to unlawful operation of certain vehicles.

I don't understand why we would include that for everyone.

So we previously voted on this exact ordinance several or a slightly maybe different version of it several months ago.

Um the the reason why I brought this forward is because of the difference between pretrial release and it being a conditional pretrial release versus being a condition on probation.

Uh it wasn't the intent to include the requirement for or I keep calling a requirement, requiring the prosecutors to request the condition on probation.

We had had discussions about that.

I don't know, and Connor and I researched it.

We couldn't tell if just the wrong committee subject.

Sub was uploaded or if we just didn't strike that language and it should have been struck.

Um Judge Wackel reached out a week or two ago and asked if the intent was for it to include the requirement on probation.

And when I learned that that was actually online, that's why I'm filing this now to change.

And so that's just the context of why this is coming back.

We already voted on it several months ago.

The intent is for it to only be uh requiring our prosecutors to request the condition for pretrial release.

To your point on why um the policy choice is to impose it across the board.

The basis for why um I chose to go that route is because when I was in the prosecutor's office, uh it's 2017, the state legislature uh eliminated the CCA statute and still carry it was a charge we could file before 2017 after we could not, and it was a great charge that we could file because it allowed us to get a lot of guns off the streets.

And so when that changed, the prosecutor's office made a policy decision that when we went before a judge, whether for pretrial release or for approbation, in every case, we were going to request that the defendant have no contact not being the possession of uh weapons, firearms, or ammunition, and that by imposing that across the board on all crimes, it would better allow us to get guns out of folks who had them and and were you know shouldn't have them.

Um similar idea here in that we've had two consecutive summers, springs and a summer of um street racing uh uh side shows, street closures, ATVs, dirt breaks, people have gotten hurt, so on and so forth.

And so, what this ordinance reflected when I filed it several months ago is that decision that we're saying we care who you are, no matter what, we don't want you driving on an ATV recklessly putting people at danger, and one way we can do that is by requiring that condition on pretrial release.

Uh, the proposed amendments establish development standards and a new definition for large format uses as any large-scale industrial use facility with a continuous building footprint of 500,000 square feet or larger.

Currently, large format uses are not defined or addressed in Chapter 88.

Kansas City has as we all know, has been seeing an increased demand for large format development.

In addition, the proposed amendments establish development standards and a new definition for data centers as any building dedicated to the storage management, processing, andor transmission of digital data, including supporting equipment related to digital data operations.

Data centers with a continuous gross floor of more than 500,000 square feet will also be considered a large format use.

Currently, data centers are included in the communication services establishment use category, which is permitted in a variety of zoning districts, including R80.

There was a significant amount of uh stakeholder engagement that occurred.

Um I know we all received a lot of uh emails and phone calls in regards to this.

Uh, in response to that, uh, we a couple of weeks ago held uh additional business items where we heard from Evergene from the water department, as well as environmental quality department to better understand and educate ourselves in terms of the impact of data centers.

Um Tuesday, we we discussed uh and I actually asked staff to join because some of you were asking me any questions.

I wasn't confident in answering, uh, but on Tuesday, we had uh significant discussion, and you will see an ordinance uh or I'm sorry resolution that we will be introducing today that will task the city manager and staff to uh provide us more information in regards to um environmental impacts as well as uh even incentive impacts uh on the incentive process, economic incentives as well, and we'll bring that information back to us.

Uh the neighborhood planning development committee reviewed and recommended do pass, and uh we have Ms.

Reinhardt here to answer any questions.

Um I believe this is a step in the right direction, as we heard from a lot of different constituents, confused on the data center process.

One, you may go for your rezoning, two, you may go for your incentives.

Uh, we did, as uh Mayor Pro Temp talked about, we did have Evergy and our water department come and talk about us or talk about the work in front of uh of us.

But the thing that I would like us to keep mindful of for our school districts, especially, um, this is a new type of development we're seeing, and I do think we do give out way too much um abatements um for uh especially on the school district side for data centers, and I think we should also be hearing from Port Casey, who does most of these um incentive packages.

I would like to be more uh have more scrutiny over that.

A lot of times constituents see us passing the rezoning as a approval of that package, and that necessarily is not the case.

I do like the special use permit, especially for major uh data centers.

As I said before, many times you have more um community engagement to rezone to put a fast food chain on a on a uh North Oak than you do an actual uh multi-million or half a billion dollar data center.

Um, but this is no um endorsement of necessarily a new project going forward, but this is to better uh guide the process and give constituents and community uh members more input to this if there are to be more um data centers uh attempted to be built in our city.

Uh this this addresses some of the zoning issues, so how big they can be, how much foot square footage or how how much of a floor plan they can take up on the first floor, um, and the process by which there would be approved.

What it doesn't do is address the concerns over their environmental impact uh as well as the economic development uh policy as uh Council Willett highlighted, and so there was robust discussion around that um as a follow-up, and we had a great presentation two weeks ago from uh Jensen Adams from the environmental uh office of environmental quality um who gave I think a pretty a really good overview and an honest overview, and this is really important because we've we've had probably thousands of emails on this topic over the last uh couple of months, and so this is just one step in this process.

Um, but uh it was refreshing to hear sort of like the reality of the situation over the last uh couple of weeks.

So um uh you know, we we've called for reviews of chapter 17 and uh as well as economic development policy around it.

So there will be more work, uh there is more work to be done to understand this and make sure that folks have uh their voices heard on this particular issue and that we truly address what the issues actually are.

Um, what are the problems that these actually present?

And so I'm looking forward to having that conversation in the future.

Um councilman O'Neill and I met with um members of of city planning and we discussed um additionally that other municipalities are looking at a decommissioned provision so that if for whatever reason these facilities need to be discommissioned, um, that there's a provision to include that the operator is responsible for that decommissioning rather than the city having to pay because these are large facilities, sometimes very large facilities.

They are built for a particular purpose, they won't be able to be repurposed or modified in anything else, and so if there is a bubble that is to pop, um we shouldn't be left holding um the bag with giant facilities that and then we have to pay um potentially millions of dollars to decommission and uh to to use to use those parcels.

So more work to be done, uh, but great work um by city staff and and the and the committee on this.

So step the right direction.

I'd like to record to reflect that I agree with Councilman Willett.

Bernie Sanders, President Trump sort of thing happens all the time.

We'll start with uh councilwoman Patterson has so I think pursuant to the discussion that um we hadn't really informed the neighborhoods about this you know permanent move, and I've gotten text messages from constituents in the area, and so I want to be responsive that um we should let them know what we're planning and give them an opportunity to weigh in and also give the manager a chance to give us recommendations to mitigate any disruption to the area.

As you know, um the northeast neighborhoods have um an overrepresentation of homeless shelters and other types of you know free meal activity, so it's a very welcoming community, a very diverse community, but I think they deserve a chance to give feedback and understand what's happening in their neighborhood.

And this is also near school.

So we should we should let people weigh in on that and explain how we're gonna be good partners since now a detention center is gonna be we're proposing it's gonna be permanent.

So hopefully you all see this as friendly because we should be doing community engagement.

We already have an ordinance, so I cited the mayor PogTim's ordinance and the resolution that we should do that anyway, as a matter of the cult.

I'm still trying to wrap my mind around that.

We just voted to unilaterally move the jail and put it in someone's neighborhood with zero community engagement.

That happened, and when you make important decisions without vetting and doing your due diligence, this is what happens.

I am also getting text messages from folks in the Northeast who fought against the homeless shelter, fought against the mental health hospital, all projects that we that we rented and viewed on their merits and decided to either move forward or not move forward on.

But we didn't have that process at all.

We've got a high school, 3,000 feet down the street from this facility.

No one spoke to them.

No one.

And we just approved it with the same day adoption.

I think this resolution should be our action at the very least.

I consulted with Nelson and learned that because I was not on the winning side, the prevailing side, I could not make the motion to reconsider.

Um if given this additional information, someone is willing to do that.

I think you'd have some supportive uh folks in the northeast area and in that area.

Uh but at the very least, I suppose we could do the community engagement after the fact to tell them that the jail is going to be down the street uh from their school and from their neighborhood.

And again, this is what happens when you do same-day adoptions on important issues uh without doing our due diligence, and here that was a community engagement.

Not a single one of us would be okay with putting a jail somewhere in our community in our district without any community engagement whatsoever when you have a non-controversial site already selected that we spoke about publicly.

Yeah, I that was the reason for my vote earlier.

I didn't get it, didn't stand up in time to speak before the the vote was called.

But uh that's that's all I just I I think that the case for spending a fraction of the amount of money is incredibly compelling.

Um so to be clear, but we're gonna get some concerns.

We had concerns about the the new water treatment facility and the the east bottoms and the impact that that's gonna have.

There are there are actually residents down there.

Um there are uh not a ton, but folks who who are you're very concerned about things as they change.

I know it's an industrial area.

I think it happens to probably be a good site for a lot of things, but I just want to make sure that we're doing our work in order to make sure that the community can buy into this.

Um good projects can go to can can die because of because of poor community engagement.

So just want to make sure we're dotting our i's and crossing our t's, and uh wanted just pump the brakes just for a second on that, which is the reason for my vote and somewhat of confusion.

So I'm in agreement with my my colleagues and um appreciative of the councilwoman for bringing this forward, and that's why I seconded it.

Um it was great concern of mine as well when that was brought up and thought of not um conducting any community engagement or listening to the community anything before we made this decision.

That's why I was a little hesitant on the same day to adoption to go ahead and vote for it, but it was a little hesitant on that.

Um I almost stood and asked to see if we could note to what we had previously.

I mean, no, no, we can't do it now, but I almost stood and asked that.

Um so my concern was with that amendment.

There was we were acting within 20 days, was that correct?

I didn't know if we had enough time to do the committee engagement beforehand that the city manager has stepped away, so we have assistant city manager here.

Is that give you enough time to do some community engagement before we start?

An amendment as to this 60-day ordinance for community engagement.

So is that what this new new ones is 60 days?

So this would request 60 days.

Right.

So that that's what I'm asking the amendment here to make the key committee engagement sooner than 60 days.

Um it's it's supposed to commence faster than that, and then giving them a chance to compile everything and give it back to us within 60 days because they got to go through everything they heard and everything like that, but it's it um it commences faster than that.

Okay, because then it was 20 days in order to come up with negotiations for the land purchase itself.

So I just want to make sure we're doing this in the proper timeline.

Yeah, yeah, I think the 20 days was just a report back period to us about just status of work that they have learned on the other side.

It it I don't had any it had no contractual duty or obligation within the 20-day time frame okay, literally just a report back to council.

So report back to council that doesn't give authorization to start negotiations.

I don't believe it.

I it depends on how you see it.

Obviously, I you would still need a separate ordinance to enter into some sort of agreement to build a different facility to build a new facility, anything of that sort.

Okay, I just want to make sure we're putting the focus and the importance on the public engagement yeah, right.

The city manager at some point will have to bring a new ordinance to do all of the extra stuff or permanent this ordinance puts community engagement, I would assume before that.

Um so when back when we heard uh 251070 um for the um the additional dollars for the construction of the modular jail or front on front street uh and uh 250890 which indicated 22 million for the modular detention center.

Was there no community engagement that occurred with those ordinances?

I'm unaware of that because we you know previously heard those uh and so I'm really just trying to understand if there was no community engagement that occurred when you know I mean I know we received emails from people and calls from people back then, but was there no community engagement that occurred when back when we were considering that the front street location back uh when we did 250890 and 251070?

Which I think if I may the modular facility, I'm sorry, the current modular facility that we're constructing now.

Uh I'm not aware that community engagement happened during that process either.

I think the difference for folks right now is now we are saying not just the temporary facility that we had been discussing is going to be located there, which a number of those folks advocated for, and now we're saying the permanent facility, which is spelled out in the ordinance we passed today, is going to be located there.
