The Kearney City Council met on December 19, 2023, at 5:30 p.m. in City Council Chambers. Mayor Claus presided. Council members present: Mayor Claus, Vice-President Randy Buschkoetter (Bush Cutter), and Council Member Lear. Council Members Nicola and Moore were absent. The meeting included a public hearing, approval of the consent agenda, and postponement of a regular agenda item.
Public Hearing
- The Council held a public hearing on the proposed acquisition of a Permanent Right-of-Way and Utility Easement granted by Timothy J. Norwood Sr., member of Fox Creek Development, LLC, for a tract of land in Section 19, Township 9 North, Range 15 West, Buffalo County, Nebraska, dedicated for Access and Utility Easement purposes. Director of Utilities Anton Yalmanek explained the easement is for the Arborview Third Subdivision (approved the prior week) and will complete public infrastructure for the subdivision. No members of the public offered testimony. The Council closed the hearing and adopted Resolution No. 2023-182 unanimously (vote: 3 ayes, 2 absent).

- Award of Cemetery NE Addition Irrigation Project to Tilley Sprinklers ($125,000.00).
- Resolution 2023-187: Repeal Resolution 2023-131 and adopt updated Comprehensive Fee Schedule (overnight hangar space fees at Kearney Regional Airport).
- Resolution 2023-188: Consulting Services Agreement between Kearney Police Department and Dalgle Law Group, LLC.
- Resolution 2023-189: Setting interest rates for 2024 special assessments and policy for developer infrastructure reimbursement.
- The vote was unanimous among those present (3 ayes, 2 absent).

It pertains the proposal, uh proposed acquisition of a permanent right-of-way and utility easement granted by Fox Creek Development. Tony. Good evening, Council. Uh Anton Yalmanek, Director of Public or Director of Utilities, City of Carney, 1220 East 26th Street. In accordance with Nebraska State Statutes dealing with the city becoming in part with or having rights to public property. We have to uh have a public hearing on a right-of-way and uh utility easement for the Arborview Third Subdivision, which you approved last week at City Council. This is an extension from Avenue R South to the existing utility easement. This will complete this project and allow for public infrastructure to be built and for future avenue R right away. Okay. I hear you're taking over another department too. Is that um just for your smirks? Well, you get plenty of those. Yeah. Uh this is a public hearing. Is there anyone in the audience we should read public hearing one? Okay, do we have a motion?
