Kearney Planning Commission Meeting - January 17, 2025

The Kearney Planning Commission met on January 17, 2025, at 9:00 a.m. in City Council Chambers. The commission considered two major agenda items: a rezoning and conditional use permit for a historic property at 320 East 31st Street, and a subdivision vacation and plat for properties at 405 & 407 2nd Avenue East. Both items were approved with conditions.

Consent Calendar

  • The minutes of the December 20, 2024 meeting were approved unanimously (9-0).

Public Comments & Testimony

  • Item 4/5 (320 East 31st Street): Ron Messparker, speaking on behalf of his parents (neighbors for over 50 years), expressed concerns over traffic volume from the proposed office use and questioned whether the conditional use permit would allow other types of businesses in the future. He noted the Hilliards have been excellent neighbors and maintain the property well.
  • Items 6-8 (405 & 407 2nd Avenue East): No public testimony.

Discussion Items

  • Rezoning 2025-01 and Conditional Use Permit 2025-01 (320 East 31st Street): Craig Bennett (Miller & Associates) presented the application to rezone from R-1 (low-density residential) to R-1D (residential district) and obtain a conditional use permit for a general office. The property is a historic home (on the National Register since 1983) owned by the Hilliard family. The family wishes to keep the building within the family by converting it to office space for their advertising business. Key points:
    • The property is at 320 East 31st Street, on a collector street (31st Street) with high traffic.
    • Existing impervious coverage is 37.3%, well under the R-1D maximum of 55%. Proposed parking lot expansion would keep it under 50%.
    • Off-street parking: 8 spaces required (including one ADA). Existing driveway and garage can accommodate 8+ spaces.
    • Hours of operation: Monday–Friday, 8 a.m. to 5 p.m.
    • An elevator provides ADA access to second floor restroom; the ramp requires extension to meet slope requirements.
    • Staff recommended approval with three conditions: (1) hours of operation, (2) eight off-street parking spaces including one ADA, (3) elevator maintained operational.
    • Discussion among commissioners: concerns about future changes in use, signage, enforcement, and potential impact on surrounding neighborhoods (e.g., Pioneer Park). City staff (Melissa) explained that conditional use permits run with the land, transfers require city consent, and compliance checks are performed.
    • Vote on rezoning: Approved unanimously (9-0).
    • Vote on conditional use permit: Approved 8-1 (Commissioner Gargan voted no).
  • Subdivision Vacation, Preliminary Plat, Final Plat (405 & 407 2nd Avenue East): Trenton Snow (applicant) presented a request to vacate a portion of Lot 1 of Fast Phil Second Addition and replat as Gardner Schroer Addition. This will allow the owner of Whiskey Creek Restaurant to purchase the parking area he has been leasing from the adjacent gas station. No changes to buildings, utilities, or zoning (C-2). Staff recommended approval.
    • Votes on vacation, preliminary plat, final plat: All unanimous (9-0).

Key Outcomes

  • Rezoning 2025-01 (320 East 31st Street): Approved unanimously. The property was rezoned from R-1 to R-1D.
  • Conditional Use Permit 2025-01 (320 East 31st Street): Approved 8-1. The permit allows a general office with conditions: (1) hours M-F 8-5, (2) eight off-street parking spaces (one ADA), (3) elevator maintained operational.
  • Subdivision Vacation 2002-01 (405 & 407 2nd Avenue East): Approved unanimously.
  • Preliminary Plat 2025-01 (Gardner Schroer Addition): Approved unanimously.
  • Final Plat 2025-01 (Gardner Schroer Addition): Approved unanimously.
  • The meeting adjourned after reports (none).
