Planning and Zoning Commission Regular Meeting - May 12, 2025
The Planning and Zoning Commission of Killeen, Texas, held its regular meeting on May 12, 2025, at 5:00 p.m. in the Utility Collections Large Conference Room. All commissioners were present except Preston Ellis and Andrew Giacomozzi. The commission unanimously approved the agenda, the consent agenda (minutes of April 14, 2025), and two public hearing items: a conditional use permit for a daycare and a city-initiated rezoning for transitional housing.

Commissioner Wilson asked whether rezoning would trigger ADA or fire safety upgrades; staff confirmed no upgrades are required solely from rezoning. The commission approved unanimously.
- PH2 – City-Initiated Rezoning for Transitional Housing (Case #Z25-12): Staff presented a request to rezone 6.789 acres at 506 Liberty Street and 2607/2703 Atkinson Avenue from R-1 to R-3A (Multifamily Apartment Residential District). The property is intended for the Reunification Project, providing transitional housing and supportive services for individuals and families experiencing homelessness. Staff noted floodplain and environmental constraints but found the request consistent with the 2040 Comprehensive Plan. No commissioners had questions. The commission approved unanimously.

I'll call the uh meeting to order for uh the regular meeting to order for the clean planning zoning commission meeting for May 12th, 2025. Uh let the record show that all commissioners are present except Commissioner Ellis and Giacomozy. Uh we do have a quorum. Uh first item on the agenda is the approval of the agenda. Chairman move to approve the agenda. I have a motion to approve the agenda and a second by Commissioner Rowe. Any discussion? All in favor. Motion passes unanimously. Uh next item on the agenda is citizens' comments. Did anyone sign up for citizens' comments? Uh okay. Uh next item is uh consent agenda CA1 consider minutes of the regular planning and zoning commission meeting of May, or I'm sorry, of April 14th, 2025. Chairman will move to approve CA1. I have a motion to approve CA1. I have a second by Commissioner Spree. Any discussion? All in favor. Motion passes unanimously. Uh next item on the agenda is uh PH1 hold a public hearing and consider a request submitted by Trey C. Hanson on behalf of Academy of Exceptional Learners. Case number Z twenty five eleven to rezone approximately six point six five six acres uh being lot one block one Fowler Elementary School Subdivision from R1 single family residential district to R1 single family residential district with a conditional use permit. CUP to allow a daycare facility as a permitted use. The subject property is locally addressed as uh 1020 Tremer Road, Colleen, Texas, and I'll turn it over to staff. Good evening, Commissioners. Case 2511. We're going from R1 to R1 with a conditional use permit. So the applicant, Dr. Hanson has submitted a request for conditional use permit to authorize the operation of a daycare facility on the premises. The site currently has a private K through uh 12 school serving children with special needs, and it does include an associated daycare component uh for children aged six to twelve years. Uh the daycare facility currently on the property is non-conforming. So the properties are located within the neighborhood in fill on the area on the growth map and designated as campus on the future land use map of the 2040 comprehensive plan. This is the location map showing you approximate location of property. This is the aerial site uh giving you a view of the entire property. So this is a view of the school from the uh across the street of Tremere Road. And this is looking down Tremere Road, looking to the south. And then this is from Hermosa Drive in the rear, uh looking towards the playground back towards the school. And this is standing out in front of this of the school looking towards the uh north towards Terrace Drive. So there on are there are no surface waters or wetlands that are listed on the national inventory map and the these proper for these properties, and there is no visual evidence of environmental impediments uh that is apparent on the properties at this time. Staff did notify 114 surrounding properties regarding this request. Uh to date, staff has received two written responses in support of this request. So this is our notification map to give you the area that we notified. Uh as I explained in the uh uh you know meeting earlier. Just the we have the nonconforming use of the red, which is not so an apartment complex that's zoned commercial, and a business daycare in the orange down in the bottom left. Uh that was an old church. So why is staff recommending approval? Well, the subject property is repurposing the old Fowler elementary school, uh, and it does uh represent a productive and appropriate repurposing of the school site, and the addition of a daycare also addresses and demonstrates uh is a demonstrated community need. So staff finds that the request it could is consistent with the city's future land use map uh designated for the area, and staff recommends approval of the request to rezone the properties from R1 single family residential district uh to R1 single family residential district with a conditional use permit to allow for a daycare facility as a permitted use.
