0:01This is your Knoxville Beer Board.
0:02Today's Tuesday, February 17th, 2026.
0:06Welcome everyone here and those watching at home.
0:10Johnson, would you please call the roll?
0:13Councilman DeBartelabin.
0:20Councilman Honeycutt.
0:24And Councilman Thomas.
0:26All members are present, Chair.
0:30The minutes of the last meeting were distributed by email.
0:33Are there any corrections to the minutes?
0:37That will be move approval.
0:39Oh, you're just gonna be able to do that.
0:40I'm just gonna say they will stand approved as distributed unless you want to make a motion.
0:44We can do it either way, ma'am.
0:51Anybody signed up for public comments germane to today's agenda?
0:55There are none, Chair.
0:58Seeing no one is signed up.
1:03I don't have a report myself, but I'm gonna ask our internal auditor, Savannah Kirk, Miss Kirk, she's gonna speak about the cast audit.
1:16Um I think some of you may have been involved in hearing the report of this audit at the audit committee, but some of you have not.
1:24Um and as you will have likely seen on your agenda, there are some under other there were some um noncompliant cast class um permittees.
1:35Um I've since heard that they're all in compliance at this point, so you're probably not gonna hear from them today.
1:41But just to give you a heads up as to why they were on your agenda, um, and you will be seeing them in the future.
1:46Uh so um last year the audit committee um added to the work plan to review compliance of the alcohol seller training class, which all permit holders have to do annually.
2:01Um there were at that time 747 active beer permits.
2:07I reviewed roughly 50 percent of them in the sampling, and of that 50 percent, 34 percent were non-compliant.
2:16And so what that looked like in numbers was roughly 126 of the the ones that I reviewed were noncompliant.
2:24Um since then, this report is also at your seats.
2:28So if you want to look at some of the detail, um those that information is under the highlights.
2:34The next few pages are gonna be the actual permits that were non-compliant, and then some recommendations that were provided.
2:41Um since that time, the uh clerk of the beer board has been sending out letters, certified letters to noncompliant permittees and communicating with both the beer inspector and the revenue office to ensure everyone's in communication and to try and get those individuals compliant.
3:03Um so the the those that were listed on your agenda tonight were had received those letters.
3:11Um, and I I can let uh Mr.
3:13Johnson speak to it more, but basically the letter says if you do not attend the class, then you need to come before the beer board and say why you're non-compliant.
3:21Um and so they have attended the class, they have come into compliance, um, and I think everyone is working diligently to get all of these in compliance.
3:29So that's it, unless you have questions.
3:36I don't I don't have a question.
3:38I would just say apparently the letters got the intended result, so that's good.
3:42Yep, I think that worked.
3:45Any more questions for Ms.
3:52Report of the beer inspector, Officer Presley.
3:57We had some alcohol compliance issues this uh month.
4:01Uh patrol actually responded to a call and issued a uh charge for uh sale of alcohol to a minor.
4:08That was back on the first in that investigation, and that was on uh the corn at the corner market at 1316 Maribel Pike.
4:16So that was actually done through a patrol call.
4:19Uh on uh February 7th.
4:22Uh myself and my office along with ABC did a alcohol compliance check.
4:29Uh we checked 15 businesses here in the city for those sold alcohol at that time to a minor.
4:35We had uh Cedar Lane Sitco, Flock Beer and Wine, Backdoor Tavern, and Union Jacks that all sold to the minor, and then Union Jacks was also cited for a cast compliance at that time.
4:55And report of the clerk, Mr.
5:00I will uh add to Officer Presley's report that Union Jacks will appear on your March beer board agenda for an administrative hearing.
5:06They were cited twice in a two roll uh two-year rolling period.
5:11So they'll be on your March agenda.
5:13Uh the report that's at your seat is the uh report of the beer board clerk, and there are no active suspension or revocation hearings.
5:22The last one that was outstanding at your January meeting, day our markets, they have since paid their fines, so that uh case has been resolved.
5:31Um the status of the beer fund is that the beer fund stands at 266,000 dollars.
5:37Um we are at nearly 156 150 percent of fines budgeted for the year.
5:44We were budgeted at 10,000, we're nearly at 15,000 for uh in terms of revenue.
5:51Um related to the question of the um letters that were sent out to the businesses that were non-compliant about the CAS class.
6:00Um we have since started using the beer fund to fund the postage for those, so you'll see those charges on this uh report um for the future.
6:10And that's all I have unless there are questions.
6:17Next matters of business or items to be postponed or withdrawn.
6:21Byrd, are there any applicants requesting a postponement?
6:25There are three um items 8C and 8D, uh, both Crafty Bastard Brewery, and uh item 8G, Rosaritas Mexican Cantina.
6:37They would all like to be postponed to the March meeting, please.
6:41Without objection, items 8C and D and 8G are postponed as requested.
6:48Bird, do you have any requests in withdrawal?
6:50Uh no, ma'am, there are none.
6:55Before we get started, I have a few announcements.
6:58When I call the name of the businesses applying for the permit, please come to the podium and state your name and address clearly into the microphone for the record.
7:05Of applicants who are approved pending final documentation, need to bring their completed documents to the business tax office during regular business hours.
7:13Applicants that have their permit approved tonight can pick up their permit at the end of this meeting.
7:18Approved pending final documentation means one or more requirements is in or incomplete for a beer board permit.
7:24In order to get your certificate of occupancy, an applicant may need to apply for zoning changes, meet parking requirements, submit architectural drawings to plans, review, and inspections, and make modifications for building codes and codes compliance.
7:39This may entail hiring an architect and or contractor and submitting plans for your site for review.
7:47Staff at this meeting, I think we have Ashley from Metropolitan Metro Drug Coalition today.
7:54If anybody has any questions relating to that, she could help you with, they are always here to help.
8:00And let's get started.
8:03So special events request.
8:08We have the Dragonfile Aerial Aerial and Circus Art Studio, 5th District.
8:15Heather Quincy, I think is another name on there.
8:26Uh so hi, uh Heather Quincy.
8:28Um my address is 311 Carson Avenue, uh 37918.
8:34Uh business addresses 509A Dutch Valley Drive.
8:46Uh that file is complete.
8:50Well, that was quick.
9:01David, I did want to ask.
9:02I'm sorry, that's your last time.
9:06Quincy, just for a second.
9:07I wanted to give you an opportunity to tell us about your gala.
9:10Uh so this is uh Dragonfly's 15th anniversary this year.
9:15We've been doing this um fundraising gala for the past three years, but this year is a little bit more special since it's our 15th anniversary.
9:22Um, it's basically just a fundraiser to help support our nonprofit um, mostly to provide scholarships for students, um, which we're hoping to expand to doing scholarships not for just for children, but for adults who can't uh necessarily afford to pay full student price for our classes.
9:45Um it also helps with community outreach and other programs that we provide.
9:51Okay, that's a great cause.
9:53What's the date of your event?
10:11Please state your name and address for the record.
10:13Uh Travis Ferguson, uh, home address 6911 Nubbin Ridge Drive, Knoxville, Tennessee, 37919.
10:20PO box 22072, Knoxville, Tennessee, 3793.
10:29That file is complete.
10:31I'll move to approve.
10:50Kind of stumbled over there.
10:56My name is Davis Parker.
10:57I'm at 1630 Highland Avenue.
11:10That file is complete.
11:20You're approved, and you are good to go.
11:34Melissa Hinton, um, 3839 Delwood Drive, 37919.
11:38And then Trees Knoxville is uh do you want the P.O.
11:49That file is complete.
11:55Um, I'd like to take a lead from uh Councilman Thomas and ask if you can talk about the festival that you're getting the permit for.
12:05Um, so our it's Tree Fest, and it is April 24th at Baker Creek Preserve from four to eight, and it coincides with the National Arbor Day celebration.
12:13Um, and it's fundraiser slash outreach for us just to bring awareness to the urban tree canopy.
12:19So there'll be um it's a free event for everybody, it's all ages.
12:22Um there'll be games, tree walks, and there's also a tree giveaway.
12:26So free trees can be adopted.
12:32Oh, I don't think we're doing okay.
12:35Is that all the discussion?
12:38Oh, sorry, good lord.
12:44I don't think it's a major thing.
12:46Um, I just wanted to simply say that those Paw Paw trees that y'all gave me last year made it through the winter, I think, and they look like they're gonna be doing really good.
12:56But uh seriously, though, uh, they give uh tree giveaways periodically, and it's native trees, and uh so uh take advantage of that if you would like.
13:06Help with the tree canopy, and thank you.
13:09I ordered extra pawpaws this year because everybody loves them.
13:12So there'll be plenty of pawpaws at Tree Fest.
13:14Yeah, I took three, that's all they would give me.
13:16No more for Charlie.
13:17Okay, no more for council members.
13:20Any more discussion?
13:22All in favor, opposed, I seven.
13:30Young Williams Animal Center.
13:33Former councilwoman Janet Tasterman is here today.
13:38Good afternoon, everybody.
13:39Janet Testerman, 3201 Division Street, Knoxville, 37919.
13:48Uh no record, we're dismissing the cast class.
13:53Uh my file is complete.
13:59Pending final documentation.
14:04Right, yeah, that that cast class would be.
14:07Your motion needs to say pending final documentation.
14:10Pending final documentation.
14:12Yeah, just a little tidbit on that.
14:14Uh it says file is complete, so except for what was added here, the councilman wouldn't have known.
14:21So I'm just asking him to add it to his motion.
14:25Yeah, oh yeah, he didn't know because it looks like files is complete.
14:31In your second discussion.
14:35Yeah, I would just like to ask uh former council uh woman testament just to kind of talk about the Marty where I've I've been able to participate um these last couple years for the first time.
14:46I'm bringing my dog this year.
14:49Um yeah, if you don't mind just kind of sharing us, you know, sharing with us what Marty Brawl is.
14:54Thank you for asking.
14:55Um it'll be the 19th annual Marty Grow, that Young Williams Animal Center is hosting.
15:01Um I think we're kick off to festival season, which is fine.
15:04But it is uh pet parade that will be starting at Covenant Health Stadium this year, going down Jackson Avenue into the fair park.
15:12Step off is at 11 o'clock, and then from 11 to 3, we have a festival at the World's Fair Performance Lawn with multiple vendors and food trucks, obviously.
15:21Hopefully, beer, um alcohol.
15:24So um, it's a really fun time.
15:26It's hard not to put a smile on your face.
15:28Uh the lunch pen is good weather, so hopefully you'll send good vibes our way.
15:33But it's a really fun event.
15:34The festival is no charge.
15:36Um, there's a registration fee for the parade part, but um, so we'd love to see all of you there and all pet owners, you know.
15:51So moving on to vote.
15:54Oh, yeah, we do need to vote.
15:55Sorry, there was so many comments on there.
16:05Moving on to the regular beer permit request, 808 music group.
16:19Hi there, uh, my name is Brian Coakley.
16:21My address is 513 Panorama Drive, and the business address is 808 Sevier Avenue.
16:31We need a copy of the sales tax registration, certificate of occupancy, approval from the health department, and a copy of the liquor license from uh TABC.
16:49Given all the items that were listed as being needed.
16:52Um we have to wait for those to come in pending final documentation.
16:58So I okay, so I can all right.
16:59Then I will move to approve pending final documentation.
17:11So you know to see Mr.
17:13Bird and you got you got off.
17:25It's appropriately named.
17:31I'm Sam Juani 2126 Florest Avenue, Knoxville 2637916.
17:41We need the certificate of occupancy and health department approved.
17:47Move to approve pending final documentation.
17:59Thank you, everyone.
18:01So you know what you have to do, right?
18:08And these are the replacement ones that we have been postponed.
18:24Good evening, everyone.
18:25Uh my name is Kara Patel.
18:27My uh current address is 5324 Bowersville Tri Uh State of Virginia.
18:31And the story address is uh 713 17th Street.
18:42Uh we would just need the Department of Agriculture approval.
18:48Move to approve pending Department of Agriculture approval.
19:02So when you get that, you know who to see, right?
19:05Think approved pending final documentation.
19:23My name is Miguel Nunez.
19:25It's 45 O Fight, Ashville Highway.
19:29Knoxville, Tennessee at 37914.
19:37We just need a copy of the sales tax registration and health department approved.
19:45I'm going to uh approve pending documentation.
19:57And you will be approved pending final documentation.
20:02Rosarita's Mexican Cantina.
20:05Oh, that's a postponed one.
20:06Sorry, sorry, sorry.
20:19You don't see any of these people here.
20:21Anybody here from Yeehaw Brewing?
20:29We can move them to the end of the agenda.
20:32You'll need to go downside.
20:34We'll move them to the end of the agenda and then we'll we'll see if they're here when we get to the end.
20:44These are addendums to the report agenda.
20:54We had something on the end's market, I think.
20:58Byrd, we had something on prompt.
21:01Bogani had reached out to me today.
21:03He's stuck at another one of his stores in Chattanooga and would request that the beer board kindly grant him an extension for 90 days.
21:13He doesn't anticipate needing that much, but erring on the side of caution, he'll be returning to town next week and we'll get in touch with the cast class and uh CO that he needs.
21:27Yeah, this hasn't been postponed before, and it looks like he's done a lot of work on it, so I would move to approve for uh to postpone it for 90 days.
21:36I'll second the extension.
21:42Can I ask a process question?
21:44Please make that to the May meeting.
21:4890 days, but no, 90 days doesn't check with much.
21:52Extension to the May meeting is what he meant to say.
21:55Is that what I meant to tell us?
21:57And I and that's what I'm saying.
21:58And you meant to second that, right?
22:05Karen had a process question.
22:13Oh, you can ask now if you want.
22:21This will be postponed until May.
22:24Extended till May, sorry.
22:39Uh addresses 1200 North Central.
22:47Do we have a thing on this?
22:49We are just needing the certificate of occupancy and health department approved.
22:59Can you give us an update on where you are?
23:02So my dad actually passed away at the end of the year, so I'll put a pause on everything.
23:07Um, but I'm back in there.
23:08We submitted plans um last week, and I think I actually just got an email that those have been reviewed, so we're gonna be moving forward.
23:17So probably the non-D day.
23:19I don't think I'll need the full 90 days.
23:21Um, but definitely an extension for now.
23:25Okay, so do we have an extension for till I guess May again?
23:33So I'm gonna make it a motion to approve an extension until May.
23:50Remind her that she can pick up the permit earlier.
23:54She doesn't have to wait till May.
23:56Morton, you can pick up the permit earlier if you get done within less than 90 days.
24:04Did we have someone fast hand?
24:08That's the next one.
24:16Kevin Hibbs, Amber Green.
24:24You got an update, Mark?
24:25Well, I have not heard from Mr.
24:27He's not replied to my emails and his voicemail is one of those that says it's not set up.
24:34Uh so it's not possible to leave a message.
24:36I don't know what his uh status or plans are.
24:44Miss Nathan has his line on.
24:48Sorry, I just had a question uh for Mr.
24:51It's my understanding that they originally applied for this in 2022.
24:57I believe that's right.
25:00So they wow for so it's they've been going on extensions for almost four years.
25:06Um I mean I I'm happy to have other discussion if Vice Mayor wants to need to say something, but uh I would be hesitant to grant them further extensions.
25:16Uh it seems like they've had appropriate time to do their paperwork and uh they can always come back and reapply uh at a later date when they're ready councilwoman if you get to the words right out of my mouth.
25:32I was gonna ask, so we just take no action and it goes away without if there is no motion to extend, it just goes away.
25:44All right, so no if you don't want to do it, don't say anything.
25:53We don't have any administrative hearings.
25:55Now we need to go back to going to, yeah, we've got yeehaw brewing.
26:04They're still not here.
26:14You got an update, Mr.
26:16Well, I I fear there may have been some miscommunication between me and Mr.
26:20He was here last meeting, uh, but they his uh his owners didn't inform him that he would have to be deferred, and they're good now, but I don't think he's got the message that he has to attend the meeting.
26:33I tried to reach out to be sure, double sure, to him personally, uh, but I it may have been too late because it was today.
26:40Uh so I don't I theorize that he may not have got the word that he's good to go to attend today.
26:47And then uh that's a guess that so what we do in this case, Ms.
26:58I I make a motion that we ex if the what I let me ask our attorney if they are in compliance but they haven't shown up here.
27:09Can we approve or do we expend extend for the till the to the March meeting?
27:17I think you probably could do either of those.
27:20Are they I mean I have they surrendered the existing permit?
27:25That's the only thing they lack.
27:26They do need to surrender the the current permit that they're using.
27:30And that's something they just really come in, slide the old permit across the table to you, and you give them their new permit.
27:37So in other circumstances, the beer board is approved, people pending final documentation when surrender of the existing permit is all that's necessary.
27:47It is there a legal requirement that they be here when we do that.
27:53I can't I'd have to pull out the book.
27:56Well, I'm just I I that I don't want to do I don't want to do something special if we haven't done something special, but I also don't want to make people come back if all they got to do is turn in a I I feel like somebody should be here personally.
28:10I would think someone wanting to get a permit would be here as well.
28:16I off the top of my head, you know, now that you mention it, they there might be a uh a requirement that someone up here.
28:27I don't think we're gonna they're gonna hopefully they're not gonna go out of business uh in the meantime.
28:33Um just can they still operate under their current license?
28:39It it's actually the same uh entity, they're just sort of re reorganizing uh some trusts and so forth that the within that entity.
28:47So I think they'll continue just fine.
28:49Uh so I would like to make a motion that we extend it to the next beer board meeting.
28:58Postpone till March the March meeting.
29:05Opposed the extended to March can we postpone tomorrow.
29:10Do that for all three of their permits.
29:15Can we actually forward?
29:16I think you probably need to make a motion to consolidate.
29:21Thank you very much.
29:24I'll make a motion to consolidate.
29:31Now back to your motion.
29:34I would like to make a motion to postpone till March.
29:42Postpone till March.
29:43It is the cast class of other business.
29:54You can say that that was dispensed with Officer Presley's report.
30:01The other only other business we had left was the people that were supposed to be here for cast class requirements, and they've all met those requirements, which Officer Presley reported on in her report.
30:10So I think that takes care of this, and we can be adjourned.
