Yes, since the last beer board meeting, uh TABC has conducted four actually alcohol compliance checks here in the city that have uh beer permitted businesses in those.
Uh the first one was on February 26th.
Uh that one.
See the businesses that actually sold alcohol to a minor on that day was Palancho's Mexican.
Hilton Garden Inn, Knoxville, Chesapeake's, Kroger on Broadway, uh, the Marriott Knoxville downtown, Balter Beer Works, and Cumberland House, Knoxville.
Uh the next one was on March 3rd.
That day, the businesses that sold alcohol to a minor was Tokyo Sushi and Steakhouse and Aubrey's and Powell.
Uh there was one on March 11th.
Uh we had some sales on that day.
That was true by Hilton, Knoxville North, the Holiday Inn at Merchant Center Boulevard, and Zelante Taquiera.
And then the last one would have been on March 12th.
I believe there was only one sale on that day, and that was La Pinata Mexican restaurant.
Did we do anything with all that?

Uh in front of your seats, council, you have a copy of uh the report uh from the the clerk.
Uh there is one active suspension replication hearing that is for union jacks.
They're also on your agenda for this evening for an administrative hearing.
They did not file their revised remedial plan or pay their fine by the deadline, which was last Tuesday.
So the law department has filed a non-compliance complaint in that matter.
It's scheduled to be heard for a preliminary hearing in April.
Uh below that there is an overview of the beer fund.
Uh, the beer fund sits at 268,000 when we are at some 169 percent of fines uh versus the budget for fines, budgeted 10,000 for fines, and we're at about 17,000 uh received in fines thus far.

Applicants who are approved pending final documentation need to bring their completed documents to the business tax office during regular business hours.
Applicants that have their permit approved tonight can pick up their permit at the end of this meeting.
Approved pending final documentation means one or more requirements are incomplete for a beer permit.
In order to get your certificate of occupancy, an applicant may need to apply for zoning changes, meet parking requirements, submit architectural drawings to plans, review, and inspections, and make modifications for building and codes compliance.
This may entail hiring an architect and or contractor and submitting plans of your site for review.

As it was explained earlier, this permittee had two underage sales in less than a two-year period.
The city ordinance requires that by a certain date they file a remedial plan, which is to lay out how they are going to uh fix the issue that uh caused the underage sale and to pay their fine.
Uh there's a deadline to do both.
Uh it is my understanding uh that this permittee did neither.
Uh the ordinance automatically uh says that uh if they are late automatically the law department files a non-compliance complaint.
Uh the law department has done so as referenced at the beginning of the meeting.
Uh nevertheless, uh the permitte is here tonight to explain the situation and answer any questions that uh the members of the beer board may have uh at the end of the uh explanation uh and question and answer uh time.
Uh it'll be up to the members of the beer board to uh accept the explanation and take no further action, or if the beer board determines that further action is needed, uh they there needs to be a motion second and passing uh to refer the permittee uh to the uh hearing officer.
Uh yes, uh I sincerely apologize uh when I met with uh Officer Presley at the task.

Not quite uh when I I met with uh Officer Presley about this incident uh at the task class, and um uh I I misunderstood the instructions and uh apparently did not get the mail at my address uh either.

I um I it's complete misunderstanding on my part.
I I just want to confirm that everything that was supposed to be done by the certain date has been done.

But uh if he if you all refer him on to the hearing officer for the underage sale, which is what is before you tonight, then you would uh then he would also have to explain the situation uh there to uh a hearing officer.

Bird and with uh Mr.
Johnson here and everybody that we've got a good address that we can get that to I do need to change my mailing address because uh that is that is not my main office so that that's I think that's a big reason why I haven't been receiving mail you took care of all that but you wanted to provide the address now just that we have it okay sir thank you I can email you um the new certified address form and and thank you Mark yes sir thank you very much okay you're good to go all right thank you I appreciate your time thank you sound like that sheriff Amelia Parker Ms.

So members of the beer board, we're under item 12 of your agenda other business hearings on permittee compliance with CAST class requirements.
As called for in the beer code, uh, you know, when new people, new permittees are getting uh their permits, they have to go through the task class, and that's noted uh in the paperwork, and Mr.
Berg will say if they've done that or not.
But there's also an uh requirement that a person on the permit must do that on an annual basis.
And uh thanks to the audit committee and beer board chair writer uh and the city internal auditor uh and officer Presley, they looked at and we have a number of uh permittees that have not been complying with their annual task class requirement.
So before she left office, beer board chair writer uh sent out a letter to uh the people that were the um most delinquent, and uh if they hadn't gotten their uh class up to date, they were to have been at the February beer board meeting, but the good news was all of those uh permittees did get the task class uh taken care of, and so that was not on your February agenda.
Uh unfortunately, uh you know there's a list of people that uh are on the agenda for tonight uh because they are out of uh compliance with the annual requirement.
Uh Officer Presley will tell you that uh the class is uh given probably 50 times a year every Thursday, uh all of the people uh not in compliance uh received a letter.
Uh Mr.
Johnson provided me a copy of letters that went out on January 28th, uh explaining the situation and about how they needed to come into compliance, and then if they did not come into compliance, a second letter uh I believe was hand delivered uh that was dated March 12th.
And if those businesses have uh not come into compliance, they're supposed to be here tonight uh where they need to be able to explain why uh they have not uh gotten this done in however many years uh Officer Presley might have that uh uh have that information to share.
And uh they're out of compliance.
Uh they you know you all could decide to send them uh to a hearing officer uh to help get them uh back into uh compliance and uh there could be fines associated with that.
So I would go through them one by one.
I have a question.

So if people are out of compliance, are they in effect operating without a permit?
I don't know.
Uh that would be a determination for the law department.
I don't make those decisions.
All right, so that was my question.
So it's like if they go to a hearing, is that what they determine?
They could that just fine?
They could have no, that could be a suspension or uh revocation of their beer permit.

We wouldn't necessarily do that.
That goes to the hearing.
That's done by a hearing officer.

Councilman Parker is that um well, I do remember discussion perhaps at the audit committee or perhaps previous beer board meeting about their annual process for renewing their permit, they have to pay a fee every year or something like that.
And there was we were wondering when they go through that process why they couldn't check to see if they had taken the class at that point.
Um, and that seemed to be not a good not a process that we could move forward with.
Um so it seems like they're able to continue to operate under that permit and believe that their permit uh um is still good even if they haven't taken the class.
Um so it seems like they're able to continue to operate under that permit and believe that their permit uh um is still good even if they haven't taken the class I I understand what you're saying uh council member Parker uh but the uh uh their um as a permit holder uh you're charged with being responsible for knowing the law uh that applies to uh the running of your uh business whether it's a beer permit or another situation uh in my opinion uh the current beer board chair and the former beer board chair um uh gave plenty of notice uh encouraging these places to come up uh into compliance and with two different letters and uh for whatever uh reason uh they did not if they're here tonight they have the opportunity to try to explain uh the the circumstances and are you recommending a certain action well uh no I'm not um I I think you know you could uh depending on what you hear from people uh you could take uh no further action uh or you could uh send them to a hearing officer for a suspension revocation hearing I would anticipate that if someone is sent to a suspension revocation hearing that there's a pretty good chance that they'll go to the task class real soon to try to uh avoid uh the situation just like the gentleman that was here from uh Union Jacks I'm not sure she's done okay so can we call it call them call numbers quality restaurant concepts doing business as Applebee's there you go yeah name is Jared Hickson 2912 Knoxville Center Drive thank you officer Presley can you give us uh yes I I can tell you uh that this business has not attended since April 13th of 2023 so that would mean that they would have expired in the following year April 13th of 2024 I have uh sent them letters from my office I have actually personally served someone myself out there with a letter prior to this process starting to try to encourage them to come uh but we've not had anybody come to attend we've been unsuccessful with that um I I'm I move we send this person to a hearing officer second that's just okay excuse me go ahead and give us an explanation please um midway through the year of 2024 human resources came in and either fired or transferred three out of the four managers for my restaurant um so I was left to run my business by myself and due to time management wasn't able to make it to the class okay I still move that this go to a hearing officer I'll second that in discussion I I do have a question is he already enrolled for the task class have you already enrolled for the two years previous I kept up with it yes sir okay so two years proved okay thank you yes sir any further discussion what two years sorry for 21 and 22 since we took it in 23 years I went missed it for 24 and 25 and have gotten letters and served and haven't been able to find the time to go so I think that deserves letting a hearing officer decide what to do rather than us I think what councilman grant was trying to ask is are you already listed on the beer permit as someone who can actually attend the class or do you need to go through the process of getting listed on the permit?
No ma'am I'm already on the you're already on there I'll just verify thank you.
Thank you thank you I'll I'll add a distinction that the person taking the task class has to already be on the beer permit.

So if he would go down and get on the permit, that would be a real simple, quick resolve for this for this business.
If he just goes down and gets on the permit, and we talked about it, um, he seemed open to doing that.

Um, to speak on why my store hasn't is basically turnover.
I don't know if you guys go into Dollar Generals, but it's mostly one employee, and it's you try to do the most you can.
And my particular man, I've been in this store since 2024, but I just become into management.
My district manager keeps changing.
So since October, we've had a district manager that's kind of given us guidelines and what we're supposed to do.
I did receive a letter in February, I believe.
I showed up to the class, but didn't really have much direction from my district manager, so I didn't know that you had to do cash, so I had the cards, so I left.
Um I haven't had the opportunity to get back in there.
I'm the only manager on duty in my store, and even today I worked till I came here, so it's just hard to get both.
But I have intentions on going to the class.
I just that's that's the reason that location.
I can't speak for the other locations, but turnover and just not having help is the reason my location is delayed.
I don't even know when the last time they were there.
In the class, when he was uh this one was actually five, four of twenty-three.

I went to the city county building and filled out an application.
