The Lake County Council met on Tuesday, June 9, 2026, at 10:00 AM in the Commissioner’s Court Room/Council Chambers, Crown Point, Indiana. The council approved proclamations, numerous fiscal transfers and appropriations, four zoning ordinances, dormant-fund resolutions, and appointments. Most roll-call votes passed 6-1 with one council member absent.
Note: The council was advised this was not a public hearing; the public hearing had been held by the Plan Commission.
Councilman Niemeyer responded that a public hearing could not be added without violating statute, that the special exception ordinance includes a developer-funded decommissioning surety, and that additional public opportunities would occur before the Plan Commission and Board of Zoning Appeals. Councilman Brewer said the Bears stadium could improve emergency response resources along the Skyway corridor.
Note: The agenda listed approval of the May 12, 2026 minutes; no action on the minutes appears in the transcript.
See the item number. There's two of them, right? Or item one. Under 16A1. Madam Chairman, can I give the council an overview of what we're here for today? Yes. Counselors the uh there is a uh I wasn't talking yet. I will I'll be talking in just one minute. I'm just getting to the right page. Yes. Oh, it's under a zone in. Got it. Uh first up is ordinance number 2602. It's Johnson Sunnybrook Farm LLC. Uh it's a no recommendation from the Plan Commission for change from A1 to M1. I want to make the council aware. This is a public meeting. This is not a public hearing. Uh the public hearing component was handled at the plan commission over an extended time period. And the statute, uh, I'm referring to section 608 of the 36-7-4-608, mandates that at the first regular meeting of the legislative body after the proposal is certified, or at any subsequent meeting within 90 days, the legislative body may adopt or reject the proposal. The legislative body shall give notice under Indiana Code 5-14-1.5-5 of its intention to consider the proposal at this meeting, that notice was given. If the legislative body adopts the order or the ordinance as certified, it takes effect as other ordinances of the legislative body. If the legislative body rejects the proposal, it is defeated. If the legislative body fails to act on the proposal within 90 days after certification, it is defeated. If a motion is made to approve or reject, I think the council should consider Indiana Code Section 36-7-4-603, which indicates that in preparing and considering the proposals, the legislative body shall pay reasonable regard to the comprehensive plan, current conditions, and the character of the current structures and uses in each district, the most desirable use for which the land in each district is adapted, the conservation of property values throughout the jurisdiction, and responsible development and growth. So any motion to either approve or reject it should indicate that the council has considered those five statutory obligations. Thank you, Madam Chairman. Thank you. All right. Moving forward. Madam President, I move to approve ordinance number 2602. Johnson Sunnybrook Farm LLC, the land trust company is trustee under trust number 4928 and Barnabas Foundation properties LLC owners, Dinwiddie Holdings, LLC petitioner, uh 520 of 2026, A1 to M1. I had received no recommendation with a vote of 5 to 3. Second. And friendly amendment. Indicate that you the council has considered all five statutory. Yes. Have considered all five statutory. Okay. I suck at that. All right. Motion's been made in second discussion. I just want to add that in those statutory suggestions that this council has allowed other light industrial in that district. Okay. Madam Chair, one comment. If if this receives an affirmative vote, the next step would be the uh special exception process. Is that correct, Ned? If this receives an affirmative vote, all it will do is change the district from an agricultural zoning district to a light industrial zoning district. What's the next steps then? What's that?
