Any opposed item number five presentation by Sean O'Brennan, Chief Advocacy Attorney for the Rights of Older Persons and Persons with a physical disability and intellectual disability or a related condition.

State of Nevada regarding attorney duties and powers under the NRS, Nevada revised statutes, Chapter 427A and Assembly Bill 461 for aging persons and persons with disabilities.

The objective of my office is to support the legal rights of older persons, which is 60 and over, and people with disabilities, to coordinate and provide oversight of legal assistance under the Older American Act, identify and mitigate abuse of older and of vulnerable adults, persons with disabilities, an intellectual disability, or a developmental disability.

And I might point out previously my statute referred to a related condition in 2025 by SB8.

That was changed to developmental disability.

So the law will be revised to reflect that, and I have reflected that on this on these materials.

So in summary, what I can provide is something called technical legal assistance.

And so that I can offer to a board such as yours or in collaboration, say with legal aid, if they would like an issue to be addressed and for me to issue an opinion.

So my statute allows me to do that, and I am considered a subject matter expert.

So that's come in handy a few times when the law may be divided among the different states and there's no clear statutory authority in Nevada, then in that case, my opinion might weigh into the benefit of say an initiative that your board has.

Otherwise, we do not get involved in policy at all, but completely bipartisan.

I can also offer legal resource development.

So one example that was in association with my office before I joined this position was the legal kiosks that you find in the self-help centers and the libraries.

That was an initiative through my predecessor as legal assistance developer with a with a legal aid.

So that's an example of the type of a legal resource development that my office can facilitate.

We also work with interventions and enforcement.

That's complaints, investigation resolution.

So for example, I receive a lot of referrals from adult protective services, also the long-term care ombudsman.

And so I am available.

I do not represent the state of Nevada.

I do not represent those offices.

That is something that I will be working on over the next year.

That's for example the rep pay type of program.

Clark County, for example, Guardian offers a REPE service, but they have a wait list.
