Lincoln City Council Regular Meeting - August 19, 2024

The Lincoln City Council met on Monday, August 19, 2024 at 3:00 PM with all members present except Councilmember Carlson. The meeting covered consent agenda items, public hearings on liquor licenses and resolutions, second and third reading of ordinances, first reading of appointments and claims, and updates on various pending items. The council took several votes, including delaying the Lincoln Airport Authority tax levy request to August 26, 2024, and passing three zoning text amendments.

Consent Calendar

• Clerk's Letters and Mayor's Approval of resolutions from July 29 and August 5, 2024 were placed on file.
• Resolution 24R-356 setting a September 9, 2024 hearing date for a Class D Liquor License for Graze Craze Lenox Village was adopted (6-0).
• Resolution 24R-357 setting a September 9, 2024 hearing date for a Catering License addition to Mellow Mushroom's Class I Liquor License was adopted (6-0).
• Administrative amendments for Advantage2 Trucking Addition and Park Place Estates Community Unit Plan were placed on file.
• Special Permit 24025 for soil mining and excavation at S. 96th Street and Roca Road was referred to the Planning Department.

• All nine liquor license applications and manager approvals were adopted for approval (6-0 each):
  • 24R-358: Big 10 Sports Bar and Grill (Class C)
  • 24R-359: Manager Cory Schaefer for Big 10 Sports
  • 24R-360: Salty's Lodge (Class CK)
  • 24R-361: Manager Thomas S. Rekasis for Salty's Lodge
  • 24R-362: Longwells (special designated licenses for outdoor area on Canopy Street on specific dates)
  • 24R-363: Gate 25 (same outdoor area)
  • 24R-364: Hiro 88 (same outdoor area)
  • 24R-365: Tank's (same outdoor area)
  • 24R-369: Mellow Mushroom (same outdoor area)

Public Hearing – Resolutions

• 24R-352: Approving a tax levy request from Lincoln Airport Authority. The council made a verbal motion to delay action only to August 26, 2024 (6-0).
• 24R-353: Authorizing an application to Nebraska Game and Parks Commission for Land and Water Conservation Fund Grant funding for renovation and expansion of Antelope Park playground. The resolution was adopted (6-0).

Public Hearing – Ordinances 2nd Reading

• 24-104: Correcting the legal description of an area to be annexed by repealing and replacing Ordinance No. 21642. This item had its second reading but no vote was recorded in the agenda.

Ordinances – 3rd Reading & Related Resolutions (Items 7.a – 7.c)

• 24-101: Text Amendment 24009 clarifying accessory building “floor” area in Lincoln Municipal Code. Passed (6-0; Ordinance 21647).
• 24-102: Text Amendment 24010 allowing more than two single-family dwellings on certain lots in specified zoning districts. Passed (6-0; Ordinance 21648).
• 24-103: Text Amendment 24007 converting special permits for on- and off-sale alcohol to conditional uses. Passed (6-0; Ordinance 21649).

Resolutions – 1st Reading (Items 8.a – 8.c)

• 24R-366: Reappointing Ken Fougeron and Heather Seeba to the Procurement Appeals Board (term to September 1, 2027).
• 24R-367: Reappointing John Whitmer to the Electrical Advisory, Appeals, and Examining Board (term to August 15, 2027).
• 24R-368: Accepting and approving the report of new and pending claims against the City for August 1 through August 15, 2024. These items had their first reading; no vote was recorded in the agenda.

Ordinances – 1st Reading

• 24-105: Text Amendment 24011 to expand blanket height permits in the Airport Hazard Area and remove post-construction certification for single-family and two-family homes under certain conditions. This item had its first reading.

Pending List – Date Certain (Items 10.a – 10.w)

• The council received updates on multiple pending items that had been delayed to August 26, 2024 via earlier verbal motion. These include the 2024-26 Operating Budget & CIP (24R-342), fee schedules for various departments (24R-325 through 24R-337), water/wastewater/solid waste rate schedules (24R-339, 24R-340, 24R-341), an amendment to the emergency alarm ordinance (24-97), an occupation tax on refuse haulers (24-98), issuance of 2024 Municipal Improvement Bonds (24-99), and transfer of unspent appropriations (24-100). No action was taken at this meeting.

Pending List – Extended One Week (Items 11.a – 11.h)

• The following Falcon Corner redevelopment items remain on the pending list without a date certain: 24R-18 (Comprehensive Plan Conformance), 24R-35 (Redevelopment Agreement), 24R-36 (TIF appropriation), 24-10 (Tax Allocation Bonds), 23R-638 (Comprehensive Plan Amendment), 23-158 (Annexation), 23R-639 (Conditional Annexation and Change of Zone Agreement), and 23-159 (Change of Zone). No action was taken.
