The amendment would permit 24-hour illumination for seven signs: the monument sign, address sign, parking garage entry/exit signs, mailroom/package room signs, and a projecting sign until 9:30 PM. The leasing office sign would remain illuminated only during business hours. Staff noted that no changes to the number, size, or design of signs were requested, and all illuminated signs must comply with the zoning ordinance's light and glare standards (0.25 foot candles at lot line). Staff supported approval subject to the amended conditions of approval.
Board members asked questions about the term "substantial conformance" used in the conditions. Deputy Zoning Administrator Polk explained the definition from the zoning ordinance, and Chair Forbes clarified its purpose to avoid litigation over minor deviations. Another board member asked why the original condition (9 PM restriction) was imposed and why it needed to change. The applicant's representative, Mark Coletta, Senior Managing Director of Aventon, stated that the condition was part of the applicant's original proposal to expedite production, but now that the building is occupied (30% leased), 24-hour illumination is needed for wayfinding, safety, first responders, and residents returning from the metro or airport. He noted no complaints about lighting and that the signs are no brighter than nearby sconces or streetlights.
Board members expressed support, noting that illuminated signs aid emergency services and are common in similar developments. The board voted unanimously to approve the amendment.
Discussion Items – Appeal of ZCOR-2025-0417 – 39071 East Colonial Highway, Hamilton (APPL-2026-0001)
The appellant's representative, Jennifer Cleary, had requested a continuance because she was flying in from Albuquerque and could not find other appellants to attend. The county staff and the Hamilton Safety Center (the subject of the appeal) agreed to the continuance. The board discussed the process, with some members expressing discomfort with last-minute continuances and concerns about neighbor notification. A motion was made to continue the hearing to the next BZA meeting on May 28, 2026, with the requirement of readvertising and renotification of adjoining landowners by certified mail. The motion passed unanimously.

So the Loudoun County Board of Zoning Appeals is now in session. Before we begin, I would ask everyone present to please turn off your cell phones, or anything else that's going to make noise. It interferes with our sound system and it interrupts our proceedings. This board is composed of five members and two alternates, and today we have present Mr. Kramer, Mr. Walker, Mr. Canonico, Mr. Clark, and um Mrs. Forbes. After each property has been duly posted and after all adjacent owners have been notified by certified mail. It takes three affirmative votes from this board for a matter to pass. And as of this meeting, no public comment has been received related to this application. The subject property is in the broad run election district within the Moorefield Station Development, which totals approximately 580 acres. The subject property highlighted here in yellow is approximately 3.8 acres within the transit related center zoning district and is located at the southeast corner of Claude Moore Drive and Charitable Street. The associated Silver Line Station is located just off the vicinity map to the northeast over here. And the Aventon Moorefield development on site on the parcel is a six-story 425-unit multifamily apartment building. In April of 2025, a sign development plan was approved for 19 signs throughout the site, and that plan is shown here. Since that time, permits have been issued for the signs, and the signs have been installed. The proposal before you does not seek to modify the number, type, size, or design of the approved signage. This request relates to a condition of approval included in the original sign development plan, which limits the use of illuminated signage to the establishment's hours of operations or 9 p.m., whichever is earlier, and this applies to all illuminated signs. The proposal before you would modify this condition to permit illumination consistent with the hours that areas associated with certain signage is used in order to assist with visibility, wayfinding, traffic safety, and directional guidance. So looking at the sign development plan matrix approved last year, 19 different signs were approved, and seven of those included illumination as part of the sign design. This proposal would affect those seven signs by changing the hours in which the signage could be illuminated. So looking specifically at impacted signage. The proposed changes include allowing the approved monument sign seen here to be illuminated 24 hours a day for property identification purposes. The projecting sign would be permitted to be illuminated until 9 30 p.m. The address sign would be permitted 24 hours a day for wayfinding purposes. Similarly, the park and garage entry and exit sign would be permitted 24 hours a day, along with the mailroom and package room, and both of these areas are areas that may be utilized at all hours. And I will note that there's also an illuminated sign for the leasing office, and this would only be permitted to be illuminated during business hours or until 6 p.m. So no significant change with this signage. And I'll also note that all illuminated signage is uh subject to illumination levels in the light and glare section of the zoning ordinance, which limits maximum illumination to 0.25 foot candles at a lot line or row right of way, and there's no proposal to modify that standard as part of this application. Section 101103D of the zoning ordinance lists the approval criteria for which the proposed signed development plan may be approved by the BZA if the BZA finds that this request meets this criteria. And as detailed in section five of the staff report, staff supports approval of the amended SIDP, subject to the conditions of approval that limit illumination as detailed and based on the findings for approval. The application as conditioned is consistent with the Loudoun County 2019 general plan and meets the seven factors for consideration in section 101103D of the zoning ordinance. Um I have a couple. I'm looking at attachment A1, which is the amended conditions of approval. It is behind tab number one. And it is entitled substantial conformance. And what it says is that the sign and sign standards, perennial size, height, location, et cetera, in PRIN for the signs placed on the property shall be in substantial conformance with the new sign development plan. I'm interested in the adjective. What is substantial mean? What is substantial conformance as opposed to conformance? Why wouldn't it just be conformance? Why, why do you what is substantial? What does that add? I I this is a defined term in the zoning ordinance, and it's it's typically associated with any legislative approval in recent memory has to be in substantial conformance with the plans that have been approved. Um I I can uh pull up the uh exact definition, but um essentially when the this these um signs come in for permitting, whatever comes in for permitting has to be consistent with with what has been approved here in the sign development plan.
