We have three public hearings this evening.

0:54

The first one is uh 26-0552, Lotal TLG homes, city initiated street vacation and official map amendments, Dearbrook Lane, Kellner Street, and Homestead Road.

1:06

Paul.

1:07

Okay, um, we'll start with the map.

1:09

So we're the plan commission should be pretty familiar with this area.

1:12

We've talked about it in the past, but the area in the blue cross atch, that is an official map amendment.

1:18

Um, the area in the yellow is an official map and a street vacation amendment uh removal of street vacation.

1:25

Um the street vacation and an amendment to the official map are being initiated by the city of by the city.

1:31

Um this vacation and official map amendment are related to the plan commission's recommendation at their October 22nd, 2025 meeting supporting the plating of Dearbrook uh subdivision, um, which is basically an extension of that the area in yellow, just that that street is being relocated to uh to increase the depth of the lots.

1:53

Um there'll be 16 lots in the subdivision.

1:57

This would be phase one of the subdivision.

1:59

Um this is just basically cleaning up the street pattern on that area.

2:03

You might be wondering, like the east-west blue section that runs westward outside of the city through Vinton's uh Vinton Constructions property.

2:13

That is a separate process.

2:15

I did reach out to Rich Lamers.

2:17

Um, so when they petition, we'll go through that process.

2:21

But we kind of I wanted to keep the two processes separate.

2:24

Um so it's really pretty straightforward.

2:28

It's following the concept plan, it's following the preliminary plat, which we'll be looked talking later on in the agenda.

2:33

Um, we did send out notices to properties affected, and we did not receive any comments, calls, or anything regarding the street vacation and/or official map amendment.

2:43

Thank you, Paul.

2:44

Are there any questions for Paul from the plan commission at this time?

2:50

Seeing none, then this is a public hearing for this specific subject matter.

2:53

If there's anyone interested in speaking on this specific subject matter, you may do so at this time.

2:58

You'll have five minutes to speak on this subject matter going once, twice.

3:05

We'll close this public hearing.

3:07

We'll bring it to the uh plan commission for the recommendation, which is to approve.

3:13

So motion by Dietrich, second by Horning Discussion.

3:20

Seeing none, all those in favor.

3:21

Aye, aye opposed.

3:23

Motion carried unanimously.

3:25

The next public hearing is 26-0553.

3:31

Uh Vogel request rezone from R1 residential agriculture to R4 single and two family for property located at 3215 Packer Lane, Paul.

3:39

Okay.

3:41

The wizard behind the curtain.

3:43

I am we have new technology, so we're figuring it out.

3:48

So on the map, um, the area and yellow cross hatch, it'd be the area for the rezoning.

3:53

A vast majority of it is owned by uh the Vogels.

3:56

There is a little there are two two parcels off of Packer Lane that have split zoning.

4:02

The north part is R4, the south part is R1.

4:06

So that we're gonna clean that up too with the zoning.

The Plan Commission met on Tuesday, July 7, 2026, at 5:00 PM in the City Hall 1st Floor Hearing Room and via Zoom, rescheduled from June 24, 2026. All eight members were present. The meeting included three public hearings, old business, and several new business items. All votes were unanimous (8-0). The meeting adjourned at 5:42 PM.

  • Quit Claim Deeds for Virginia Drive and Joseph Road: The deeds were approved for the consent agenda to facilitate cul-de-sac construction for emergency and plow access (motion by Steinbrenner, second by Diedrich).

Public Comments & Testimony

  • T.J. Potter Trucking Conditional Use Permit (CUP): Members of the public raised questions and concerns during the public hearing:
    • Julie Place (2413 S 35th Street) asked about stored materials, potential silos, nuclear waste hauling by a sister company, and traffic safety on Viebahn and Dewey Streets.
    • Doug Schreiber (2406 S 35th Street) expressed concerns about berm maintenance (weeds), dust from gravel, and landscaping upkeep.
    • Hank Bauman (2440 S 35th) requested specifics on berm length/height, fencing, security, building location, lighting, and hours of operation.
  • An anonymous email from a S 35th Street resident expressed concerns about truck traffic, decreased home values, and the storage yard's impact.

Discussion Items

  • Public Hearing 26-0552 – Lodel/TLG Homes Street Vacation and Official Map Amendment: Staff (Paul Braun) explained that Deerbrook Lane is being relocated to allow deeper lots for the Deerbrook Crossing Subdivision. Notices were sent; no comments received. The commission approved the street vacation and official map amendment, referred to council.
  • Public Hearing 26-0553 – Vogel Rezone from R-1 to R-4: The rezoning of 3215 Packer Lane and two abutting lots to R-4 eliminates split zoning and accommodates a second home. No public comments. Approved and referred to council.
  • Public Hearing 26-0554 – T.J. Potter Trucking CUP: The request for a 32.31-acre site at S. 39th and Viebahn Streets for a crushed stone/gravel storage and transloading area. Staff presented conditions including annual review, landscaping, dust palliatives, berm height approval, and prohibition of barbed wire fencing (with police chief approval possible). Commissioner Hornung suggested amendments: requiring property acquisition, annual review starting January 2028, and fencing language adjustments. The commission approved the CUP with amended conditions, referred to council.
  • Old Business – Chapter 15 Zoning Code Rewrite: Staff reported ongoing review with the consultant; a full draft is expected by late summer/early fall.
  • New Business – Deerbrook Crossing Subdivision No. 1 Preliminary Plat: Approved and referred to council.
