Good afternoon, everyone, and welcome to the Tuesday September 2nd, 2025 technical review meeting for the City of Musquete.

We are going to open with open public comments.

Hello, Mayor Whipple and Council members.

For the record, my name is Raylane Shavana with Nordic Beach Holdings.

First of all, I'd like to say that I did receive the email from the attorney, the city attorney.

Um I acknowledge receipt of the email in which you indicated that you would respond directly to Mr.

Chatterjee based on his prior resin representation of me in matters related to the Mesquite Vistas Association.

At this time, I wish to clarify there's no civil litigation pending between myself and the city of Musquite.

My communications regarding annexation subdivision and governance issues are being made in my capacity as a citizen and a business owner within the city of Musquite.

Homeowners have the right to vote on annexations and have the have the knowledge that the city will follow the laws that govern annexation procedures.

I'm here as a property owner with questions about why annexations and parking issues are occurring without the required vote of the memberships and the laws.

Under 2.4 of the master declaration and the NRS codes 116.

To be clear, I have nothing against annexations in principle.

My concern is selective enforcement being carried out by the association in the city.

Some owners are allowed in without proper procedure, while others are denied rights enforced into costly costly litigation.

This unequal treat treatment undermines both the rule of law and public trust.

And to participate in public proceedings without being compelled to do so through private counsel.

Accordingly, I respect the request and request the city acknowledge and rep respond to the communications I submit in my individual capacity, whether by email, public comment, or written submission to the city clerk.

Of course, should litigation arise against the city.

Um I do want to just show the city for shared parking because I think we're confused.

Um Mr.

Kim is enforcing private CCNRs, not the public code.

That's all we're asking.

Is that he do the public code, not our CCNRs.

If our board president, Mr.

Sites of NV Night Club, wants to talk about reciprocal parking, he can file a private litigation matter against Nordic Beach or Red Hills, and we will deal with it at that time.

The city has a code.

We're just asking for that code to be honored.

I have one item that I would like added to the agenda.

Um just a little background.

On July 22nd, we received bids for the ADA project.

And on August 12th, this was brought before the city council to award that project to Melee construction.

This project, as they got um, it was awarded, and we went back and gave them the agreement, and they started to get their bonds for the project, and their bonding company said that they would not bond them on this project, and it was creating a financial hardship of trying to get uh additional bonding.

So they sent me a letter um requesting a withdrawal from this project.

And following with the NRS, I just wanted to read this comes from NRS 338.13895 subsection three.

It says if any award or after awarding the contract, but before commencement of the work, the public body or its authorized representative discovers that the person to whom the contract was was awarded is deemed unacceptable.

The public body shall rescind the award of the contract and may accept the next lowest bid for the public work for the responsible bidder.

So that's what I would like to have an item on the agenda to rescind the notice of award from Mailee Construction and to award the contract to the next lowest bidder of uh Las Vegas Paving Corporation.

They came in at 1.8 million, and the melee was 1.6.

So we will be paying a little bit more, but unfortunately, that's where we're at.

And following it with NRS, uh that's the item I'd like to place up before the agenda.

Also keep in mind RTC will fully fund this project.

Um and last two weeks, no, last week we had approved the interlocal contract with RTC and the city of Mesquite for two million dollars.

So we're still underneath what we had with that interlocal agreement.

We we need to follow the law of the ADA, so this is something that has to be done by the city.

The the purpose of this meeting is not to discuss the underlying issue.

Can it's not properly agendized to do that?

But if the motion to add it is appropriate, but we should the council should not discuss the issue in this meeting, but they'll be able to fully discuss it during the next meeting when it's properly agendized.

I I'd like to add one code enforcement item.

Um, as you may expect it.

The type title would be the consideration of providing direction for step uh to obey to remove the unhealthful conditions at 574 Condor Street.

So there are rat infestation issues going on.

A lot of agencies right now are working.

The animal control has been uh caught, they caught about 40 rats already.

And uh code enforcement is working to provide them uh senior meals uh because the owners doesn't have uh uh much of uh income and uh Clark County Social Services uh uh reaching out to them.

Uh and we are also talking with the never aging and disability uh services too.

So uh by the city council meeting uh next next week, there will be some changes, but uh if the solves everything unlikely, then I'm gonna withdraw it at the meeting.

But uh it is likely that we're gonna I'm gonna uh go ahead and uh ask you to uh give me a direction to clean that property.

I want to open what hello, Mayor Whipple and City Council members.

I'm Ray Lane Shabano for the record with Nordic Beach Holdings.

Um, 6.3 agenda item.

Um, I'm asking for it to be removed until the homeowners have the chance to vote on that item.

The annexation of a property that's not listed in the PUD that's not annexed in and is not on the list, requires a vote of the membership under 2.4 of our governing document.

So I'm gonna leave this with the city attorney today.

And it also has the list of um annexable properties in the back of the document that can be annexed in without our vote.

So this is not one of those properties that's listed in here.

So I'm just asking that that is put on or taken off the agenda until we, the membership, have a chance to get with our HOA and demand the proper vote to be held.

Um we uh there's a lot of annexations and de-annexations that have happened since 2003.

The developer's reign ended in 2003.

So these annexations that are happening after 2003 shouldn't happen without the proper vote of the people.

So we're just asking to have that vote.

Um HOAs are crazy enough as it is, but with the water pump um having to pump water, they're they're threatening a special assessment.

Um Nordic Beach would pay 30 to 50,000 for that special assessment to pump water.

We have no common areas, we get no maintenance by the master association, we have no landscaping, nothing is done by the master.

There is no common areas in Red Hills or the Master.

So we're just asking that you give us a little bit of time to get some of these things under um control.

Um, the Hardy Way townhomes, the hilltop vistas, uh, there's the point that was de-annexed.

There's just a lot going on here.

Um, and I don't think the city council realizes that the HOA is not following the proper procedure.

So I'm giving you an alert, they're not following that.

I did go to the meeting last week and ask them to do it, but again, we're just asking the city to hold off until we have a chance to enforce the covenants outside of this meeting.

So you're just doing your job on this one, I get it, but we're just asking you to wait because we do have the right to vote.

And the city would be participating in selective enforcement again.

Our lots are required to go through the master plan, PUD vote, our subdivisions, and yet this one's not.

This one's required, but this one's not.

So we're just asking for the right and equal enforcement um from the city for annexations and deannexations, and I'll educate you more as we go.

Met with the management team from Deep Roots Harvest for the whole month of September, they're doing a food drive for the Parade lights, which I think is awesome.

What they're doing is you have to bring in a certain weight of food, and then they'll give you a little bit of discount on the order.

So that's gonna be really good.

Um we've already got, I think, 11 applications for the parade already.

People are really starting to send it in.

So hopefully it's gonna be a great parade.

Debbie's a little bit anxious about the price of food, and I said there's nothing you can do about it.

It is what it is.

You go that you everybody knows you go to the grocery store, you're not getting the same as you did last year.

You're just not getting it.

And so she'll do the best she can.

And we need more businesses in Mosquite to give us a hand to make our goal.

And I'm sure with the help of you guys and the parade, and thank you, Mayor, for helping to get the uh application date and everything.

That was important.
